JLM Charged in the Hannah Graham Case

  • #281
I was trying to figure out what defense experts JM's attorney's wanted to request so secretly and found a similar failed motion for Lee Boyd Malvo (of the "Beltway Sniper" case) from 2003. http://www.baltimoresun.com/bal-te.malvo07feb07-story.html Ultimately lawyers in his case went with an insanity defense, the weakness of which may have been what spared him the death penalty when it came to sentencing. http://www.citypages.com/blogs/how-a-weak-insanity-defense-saved-lee-boyd-malvos-life-6593526

Anyone have any ideas? I was wondering about special fields of psychiatry or medicine such as multiple personality/dissociative identity disorder as a result of the alleged sexual abuse in childhood (as argued in Malvo's case, see above article link) or chronic traumatic encephalopathy from football injuries which has lead to aggression and sometimes murder in other athletes (list at http://www.cnn.com/2013/08/22/health/gallery/cte-athletes/)?

JLM may not have been affluent but, imo this might apply.

"No jail: Ethan Couch pictured here in December, avoided prison for killing four and injuring two more after his attorney argued that he was mollycoddled by his parents so much that he didn't understand the difference between right and wrong"

http://www.nbc29.com/story/30209008/jesse-matthew-defense-presents-motion-for-separate-judge
Article and video about yesterday's pretrial motions in HG case.

Includes video report of news reporter present at the hearing and also video of JM being escorted from the courthouse.

Curious as to what type of experts might help in JM's defence?

"The defense wanted two experts but couldn't disclose names or fields of expertise saying the confidential information could reveal a defense strategy."

DNA? Decomposition? Mental health? Just guesses.

A combination of 'roid rage and PTSD. I got a complete copy of the multi-page Defense Memo that was submitted in the Northern Virginia rape case. Clearly the judge was not swayed, and I picked lots of holes in what his defense team said in order to get him a lighter sentence. Calling him a first time offender was clearly disingenuous as was omitting the real reasons for his leaving Liberty and CNU, and trying to portray his commitment to sobriety. Naming several women with whom JLM had had "long term relationships" clearly flew in the face of what has been reported anecdotally that he would go after the drunkest women in sight or "low-hanging fruit" as a friend remarked to increase his chances...

Has that defense memo been published and can you share it?

Well, there is something I have certainly learned by following WS cases--- they all try to get the warrants thrown out!! It used to shock me and aggravate me and then I realized- it is just part of the game. It usually doesn't work, but they file it every time.

Agreed. SOP. They would be negligent if they did not.

Another possibility is the new prosecutor might not go for the death penalty.

I had previously thought that making this a capital murder case was a prosecution bargaining chip that could be exchanged for a full confession including unnamed/unknown victims of his....
