--Sky is married to Chris Hughes. Married for 10 years.
--Good friends with Travis. Met him at church. Was not married to Chris yet. Met Travis when she was single. Around 2001 and knew Travis since.
--Travis came over, slept over, spend weekends and then go to church together.
--Got close to Travis and loved him very much.
--Since 2008 Sky has been interested in the case. She cares about what happens in this case and hopes Arias is convicted.
--Has spoken with the prosecutor's office. Spoke to Phillip (paraleagal) and Juan Martinez.
--Has been wathing it live streamed.
--As she watches the trial she is watching for inconsistencies. Things that she remembers she lets the prosecution know. If it is helpful for Travis and his case she lets them know.
--Contact with the prosection is less than it was in the beginning over the past four years.
--Got a call about Gus, spoke with Phillip. He asked if she knew Gus, told Phillip that Gus works with Chris in Legal Shield. Doesn't remember the time of the call but it was in the morning.
--Then asked Chris for Gus' phone number so that she could give it to Phillip.
--When she was talking to Chris she told him that Phillip needs it. Phillip said that the defence was going to be calling Gus.
--Told Chris that Gus was being called as a witness for the defence.
--Was not present when Chris texted Gus and was not present when Chris spoked to Gus on the phone.
--Told Phillip that Chris talked to Gus, thinks it was the next day or the day after that.
--Chris was doing a seminar and Gus was going to be there. Asked Phillip if that was going to be okay if Chris and Gus saw each other. Phillip said it shouldn't be a problem.
--Gus told Chris that he had information that could help Jodi or could help her. That's all she remembers.
--Advised Phillip of that a day or so later. She called Phillip about something else.
--Called Phillip because she had remembered something and thought Philip should know. Says that Jodi told a friend of hers that Jodi got baptized for Travis.
--Asked Philip if she was going to be needed as a witness for either side. Didn't ask Philip if she was listed as a witness. Philip said
--Was not advised to not watch anything in the media.
CROSS EXAMINATION--Prosector never told her to contact any witness including Gus.
--Any calls were between Sky and Phillip.
--Asked Philip if it was okay if Chris and Gus saw each other at a seminar they were both attending.

--Doesn't know if the prosecutor's office knew she was watching the trial.
--Has had "here and there" contact with the prosecution's office.
--Call the prosecutor's office about "the t-shirt thing" as she received a text from Tyler Searle (spelling?).
--Sky received text messages and emails, Chris did too, from people on Facebook. She would tell Phillip and tell him what people would tell her.
--Any helpful information was relayed to the prosecution.
--Was not advised to not have contact with Gus.
GUS SEARCY TESTIMONY--Nurmi tells judge that the State said that were not interested in Gus' further testimony. The defence is not interested in further testimony.
--Martinez says that he thought Gus was going to testify over the phone and didn't know he would be in court and suspects it is because he wants the limelight.
--Gus was restricted from doing interviews and he is asking for a release from his restrictions.
--Gus is released from his supeona and his restriction from media interviews.
--Gus is seen in court but does not take the stand.
FURTHER MATTERS
--Sky is receiving a supeona and cannot watch proceedings or discuss testimony with anybody.
--Another witness, Jovanne (spelling?) can't get a hold of her, her number is not working.
No further witnesses.
--Nurmi does not have any further for this matter
--Martinez is asking that the court find that there is no prosecutorial misconduct.
--Nurmi now wants to go to the arguement portion of the testimony.
--Nurmi is asking for a mistrial based on prosecutorial misconduct, and there has been so much and he could go on for hours but instead he will go on with a greatest hits list.
--Nurmi is saying that the state brought forward two surprise witnesses to get information on Gus Searcy and Abe A. Nurmi says that the state's defence is ignorance which is not a defence.
--Now talking about the text messages that didn't exist.
--Testimony of Flores, Flores said that that Dr. Horn originally said that the shooting came first. Flores said it was a misunderstanding of Dr. Horn's opinion. Either Flores misunderstood or he substituded his own judgement.
--State has yelled at witnesses and thrown evidence on the ground.
--As the evidence shows today, Martinez violates a court order, witnesses are not to watch the proceedings. Martinez that Chris and Sky Hughes were on the witness list and weren't supposed to be watching the trial. Not enforceable in Utah but Martinez knew. Paralegal was having contact with Sky Hughes. Phillip knew Chris and Sky Hughes were on the witness list. Says that Martinez is therefore in violation of the court. Martinez is now getting coached by a witness with tidbits that she thinks is helpful. Nurmi says that to impose no sanction is to condone the behavior and is not appropriate. Arias' life is at stake and Martinez is violating the order. Mistrial is a severe remedy but the defence is asking for it. Attorney's office should withdraw from the case because they have procured information
--sanction can be to remove the death penalty from the case. Removing the sentencing option is a sanction the court can consider.
MARTINEZ
--These witness were not supeoned at the time.
--The rules are not to be for the state to call anybody in the world and say they could be called.
--Even if they were witnesses the state can contact them. There is no prohibition about lawyers contacting witnesses.
--There is no rule to say the prosecution cannot call witnesses.
--asking for a dismissal from the sham allegation.
NURMI--This is far from a sham. The misconduct upon the state and then claiming victimization is almost laughable.
--Just because somebody is on the witness list and may or not be called...???
--It's about information obtained that he knews is in violation of the court order.
--It's a matter of violating a court order and obtaining information.

--Case law says that it is the cumulative nature that brings
--Chris and Sky Hughes were listed on both disclosure notices. Judge asks Nurmi if he called Sky and Chris to tell them not to watch the trial or have contact.

--Defence did not know if they were going to contact Chris and Sky or not, it would have been futile to tell them not to watch the trial.
--Judge says she did not hear Sky say she was providing information from viewing the media trial. She and Chris Hughes received emails, text, telephone calls and they contacted the prosecutor's office. Nurmi says that there was portion of her testimony where she says she had other contact and there was a portion of her testimony where she said she was watching a trial.
--Sky was looking for inconsistencies and contacting Phillip. Is Phillip now a witness? He was having contact with Sky. It does not absolve Martinez from violation.
JUDGE'S RULING--some of the other ground have already been addressed by another judge and in other proceeding.

Same here! I have to sit in complete silence to hear! My dog started barking during the phone sex recording yesterday, I couldn't hear a thing over him! Heaven forbid the fridge comes on making its noises, then I really miss a few minutes!
