Probably. But wrt to premeditation, the defense would have a much weaker argument if she used the gun she brought with her for the purpose of killing him. The State is arguing that she used the knife first. Which begs the question of why she didn't use the gun she brought for that purpose. The answer has to be (from a defense perspective) that something happened in the middle to make her go for a knife rather than a gun -- i.e., she was attacked and it was more handy than the gun. Which creates a space between premeditation and something else. Not saying it'll be successful. I think she'll get at least a second degree charge (if the lesser included is even available). But I think the gun first theory would be much better, cleaner and easier for the State. Clear premeditation followed by either rage or panic or both. jmo

I totally agree with you about the premeditation aspect. But the main problem with the 'gun first' theory is convincing people that he would be able to stand at the sink, defend himself against further injuries, etc. etc. , if he had been shot in the head already. JMO

I have an OT question, that Jodi made me think of....

When a woman with breast implants goes to prison, who pays for the care and upkeep of them? Implants only last about 8-10 years before they need to be replaced. If a woman goes to person for life, do authorities just say, "sorry - you have to keep that set in your body forever." Or do they allow the woman to have them removed when the time comes? And if so, I imagine the prisoner would have to pay for that surgery. But how? What if she can't?

That's my totally random Saturday night train of thought. Lol!

The department of corrections pays for medically necessary treatment for inmates. So, an inmate with existing breast implants would have the implants surgically removed if there were a complication that required removal (certified by a physician). They would probably not allow "elective" removal of the implants.

Additionally, if there was a rupture or something, the DOC would almost certainly NOT pay to replace the implant-- only remove it, and probably offer to remove the other implant at the same time. Even if inmates have their own $$ to pay for it, the DOC won't allow inmates to undergo cosmetic surgery during their incarceration.

You know...I have HUGE doubts about the whole "spiderman boys underwear bit" as I'm inclined to think that they actually were ladies undies made to look like boys' (alla Charlie's Angel's - Cameron Diaz) and that she is so strange that she just didn't get it BUT...BUT...BUT...Entertaining the idea that he actually bought boy's underwear...Is it so beyond belief that he might have thought that Cameron Diaz was actually in boy's underwear as well? Maybe he thought that they were cute and wanted to get her a pair and he just thought that they were regular boy's undies on her. And maybe he screwed up the size? THAT sounds much more plausible to me than WHAM, he's a pedophile who (based on the sex tape) obviously enjoyed women???

Just a thought.

I think implants only have to be replaced or removed if they're causing problems. I've had mine for over 25 years and no one has ever mentioned anything about maintenance. :what:

Not sure what the answer is to your question or what medical problems could ensue if nothing was done with them.

I know a lot of peeps disagree, but I think that's exactly what happened. He got a non-fatal shot to the head from a small caliber weapon that may have nicked the frontal lobe and was like wtf just happened to me and staggered to the mirror to see.

I think so too. Once the plan began to form the last of May she thought of nothing else, imo.

I believe JA planned this murder long before the end of May. I think she knew she would kill him even before the day she taped their phone sex. There is no other reason for her to tape him. Yes, obsession is one reason but by that date, she knew she wasn't going to have him or his lifesytle and she hated him. I think she enjoyed the planning and the killing and being the star witness in her own trial.

Agree. It also appeared he was coughing up blood while at the sink, which leads me to believe it was from the injury to his chest, before collapsing to the floor and attempting to flee into the bedroom.

Frigga - thank you so much for your kind words. I truly appreciate it. It can be a little scary to post something that is a little personal, but a little related, and something I feel so passionately about.

I so agree that this community is truly one made of friends. I love it here. It is one of the healthiest, most civilized, interesting, respectful, fun... and we're all are expected to act like grown-ups with manners.

Healthy discourse, debate, the sharing of various theories - just great here. We learn, teach, and then there's our collective hunger to figure stuff out! And importantly, keeping the victim, family and friends in mind with compassionate respect and hope for justice.

We do get off topic in here now and again (me -- > trying to look innocent and failing :blushing:), be it recipes, 6 ft. tall ornery (jk) ratites, racy stuff, pets, Swiss chocolate, fad candy snow, etc., but I've yet to see it get out of hand - we are all first and foremost here for the primary issue of this trial.

I love it here. Oh wait, I said that already. Oh well! :)

Yeah, there is no flipping way. I have raised 4 boys and little boys butts are very small and trim. Jodi had a very womanly figure, and there is no way, even if she cut the leg holes, that her butt would fit in the butt of little boy underwear. Maybe teen size underwear, *maybe*.

After wading through another 27 pages of speculation about which came first, the gunshot or the knife, I think the only thing that will help is for forum members to pitch in and pool their funds and hire whatever renowned pathologist you believe will give the correct answer. Obviously Dr. Horn is not believed by a significant percentage of folks and I haven't seen that anyone else with medical examiner qualifications has opined here, so to put this all to rest, it's time to commit some money to the cause.

This will also serve as a test of how important and committed forum members are to finding out which came first--put up some real $$$ to pay for a Dr. Baden or whoever to do a thorough independent and objective review of the autopsy, the xrays, the path reports, etc. and render his/her opinion.

What say you WS members? Committed enough to the cause? You'll have to fund this yourselves because the State of AZ already has an expert opinion. It won't be cheap--you're probably looking at $7K to $10K but you will get an answer.

So far, no spiderman undies have been presented to the jury.

I also do NOT believe it was Jodi's decision, against Travis' wishes to move back to Yreka. None of that fits with her behavior or the relationship. I think she ran out of money and he insisted she move back due to her "psycho behavior".

As a cool lady named Katie once (or twice) said:
