Ok, after as angry as Travis was at JA at the end of May, I am still struggling with them having sex on June 4. Especially when there is no other evidence of them having taken those kinds of pictures before. This is the current theory I am working on:

Travis did not know JA was going to see him. She shows up as he is on his computer. They discuss things, she tries to seduce him, and it doesn't work. She is there for a few hours, and acts like she is leaving. Travis then goes up and goes to sleep. JA sneaks back in and goes up to his room. Sets the KY on the bed for staged pictures, but he wakes up. Her thoughts were to use this as blackmail. He gets out of bed and goes down to his office, telling her to leave.

She stages the pictures of herself using the timer. She reverses the time on the camera. Remember how she was so adamant about the emails being 7 hours off? She knew how to reset times on devices. Plus, the pictures where you can see her face do not look like someone playfully having her picture taken. Her face looks more like she is concerned if it the pictures are going to come out all right.

She goes to confront Travis and kind of blackmail him into taking her to Mexico or just committing to her. Doesn't work and Travis goes up to shower. It's then she decides that she will have to kill him because her other plan didn't work. She takes the majority of the pictures of him in the shower without him knowing. When he does see her, she is armed and ready to go.

She deletes the photos before she leaves so there would be no evidence.

I really do not think they had sex that day. I think he spent a good part of the day trying to ignore her, thinking she would finally just leave.

I know there are probably a ton of reasons why this could not be the situation, but it's the best I've got right now. :)

I'm not discounting your theory, but I've asked this question several times and no one has been able to answer it...why would she take pictures of Travis in the shower without his knowledge especially since no one was ever going to see those pictures?

I've posed the same question to those who think she's holding a knife or gun on him while taking the shower pics. Why?

My own theory is that she planned to kill him in the bathroom (specifically the shower) to cut down on the amount of evidence. The shower pics are the ruse for her being in the bathroom with him. She meant for him to die in the shower, which is why she dragged him back in there and rinsed off his body. However, it didn't go how she planned it (obviously).

I think the "dropped camera" pic could actually be her setting the camera down while she gets the knife (or gun, I haven't decided which came first, but I'm leaning towards the knife). I think she meant for him to be seated while she killed him, but he got up before the first stab wound or she stabbed him in the head as he was getting up.

For those of you who are curious, the police reports/interviews that was linked a few pages back indicates that his roommate's girlfriend was feeding/watering Napoleon. Also, it was testified to that Travis had a doggie door for Napoleon. In the interview with LE, his roommate indicated he thought it was odd because the baby gate had been put up on the stairs blocking Napoleon from going upstairs, which Travis never did. Napoleon always had free range of the home.

An assault that leads to death is a homicide - probably would be manslaughter, rather than second degree murder if the intention was not to kill the person. For purposes of charging a defendant, if death was the result, they would not be charged with assault - they would be charged with some form of criminal homicide. The assault is "merged" into the homicide.

There is no requirement that assault be premeditated.

The distinction between assault and murder is that one results in injury and the other results in death.

The only reason assault is brought up in this case is for the purposes of charging felony murder - there has to be an underlying felony, during the commission of which the victim was killed. In this case, the primary underlying felony is burglary, and assault was also mentioned as a possible underlying felony. The actions that would have constituted assault were also the actions that led to Travis' death, but in Arizona the initial assault is sufficient as the underlying felony in a felony murder charge -- even if that assault is what led to death.

Your confusion is well-founded, and I did not think assault would have been viable as the underlying felony until I read the judge's ruling and the caselaw that was cited in support of her ruling.

Thank you for answering my questions! They didn't express my confusion the way I wanted it but surprisingly you understood exactly what I meant. I must say, Dutch law is way simpler. :floorlaugh: Here we only have two possible charges when someone has been killed.

I have changed my mind about my earlier position. Now I think that if the "self defense" defense doesn't work, she could actually be found guilty based on both of the two charges filed.

I agree with your theory. But I'm one of the few that think she shot him first and when he didn't die quickly enough, she panicked and started stabbing him to get him to "die already".

There is a crime scene photo of the wall where Travis' bathrobe is hanging. On that wall is a blood drip that seems consistent with plunging a knife into someone and then pulling it out, at that point the blood went from the knife onto the wall. (obviously I am not CSI) lol

It is my believe that she stabbed Travis' in the heart right outside the shower door.... or as she said, one leg in and one leg out of the shower. jmo

Not necessarily. People notice what they notice. Not seeing something doesn't mean it's there or not there--it means they didn't notice it (or the absence of it). There could have been items of JA's covering up the back seats. As for floor mats I doubt anyone pays attention to that when getting a ride in a car.
Could be right on that ... but the smoke smell noticed by the rental car agent would have been noticed. Arias made the 515 mile leg from SLC to Sparks Nevada in 7h 37m according to the gas receipts, most likely indicating that she did not stop, other than for gas in Winnemucca NV. But after Sparks is where the big gap is ... Arias leaves Sparks NV at 10:34am on 6/6, but doesn't arrive in Redding until 6/7 @ 12:28 PM. Did she return to DB or MM's house or get lost in the woods/desert for awhile to destroy evidence ?

Well, she said it was because she was talking to this other guy and Travis "freaked out" because she accidentally sent the other guy's text message to Travis. From the texts between Jodi and Travis, it's obvious he was not jealous because he knew she was lying about the message that was supposedly meant for that other guy (who most likely did not even exist).

However, I think there was something more that he was mad about.

When I read/heard the content of his texts during this fight I remember thinking they sounded remarkably similar to texts I sent when I found out my best friend had been sleeping with my boyfriend. It made me wonder if he had busted her boning a close friend or associate. Who knows, just a thought.

One thing that occurred to me when JA was telling her lie about the skateboarders/license plate/Starbucks: Wasn't it considerate of the snickering skateboarding punks and handy for her that they replaced the screws in the plate holder for her after removing the plate and throwing it on the ground?? That was really sweet of them to do because it kept her from having to search in the dark parking lot for them or having to try and replace them somewhere later. Most snickering skateboarding punks who would have vandalized the car would have just thrown the screws on the ground instead of rescrewing them into place. :waitasec:

I agree with the above. The shower was her intended butchery site and the camera merely a ruse to ensure he got there. As for shooting with both a camera and a gun, yes that would be more Hollywood than reality.
