Thank you LotusPawprint. I am freaking out. Did the Pro even touch on all the premeditation at all?
I'm biased in that I do believe it was premeditated but I think the prosecution did a stellar job proving it. (cell records, rental car, hair color, turning on/off cell, Ryan Burns, stolen gun)

The jury doesn't have to agree on premeditation to reach a verdict of guilt. They just have to agree on 1st degree - seven can believe it was premeditated and 5 can believe it was a felony murder.

I'm not worried about the motion to dismiss. Every defense moves to dismiss after the prosc. rests.

I think the prosecution showed premedition really well. The trick will be to effectively remind the jury of it on rebuttal after the defense rests.

I'm still worried - I'm having visions of that Florida trial & other high profile ones. I don't think they can show she wasn't abused until they present testimony she was - but I do think they should have brought in the roommate to testify about Travis' character.

I'll try to hold on to oceanblueeyes who says Martinez know what he is doing.

well, it may be good he rested before the break.. they can think it over and digest it..

he just now pretty much laid out his case and did put it all out there.

Dunno, there is no real proof that she stole the gun!

If you take all the CE and linked it together it can be concluded that no one but Jodi took the gun. That is what CE cases are. The totality of it all.

Why would they schedule a trail that has this much media attention when they would have conflicting schedules or whatever reason that would stop the trial for this length of time?
It's hard enough for jurors to separate themselves from media, from friends or family asking or giving information over their long weekends and short trial days. I am amazed and stunned.

Wouldn't be surprised if felony murder charge is dismissed. I don't remember any evidence of any other felonies other than the murder. Not sure why they included the alternative charge.
My belief is to bypass 12 people having to agree on premeditation. It'll hurt the prosecution if they dismiss the felony charge.

Oh yep. Defense just said as much.

Weak argument for felony murder IMO. Arguing that underlying felony is assault ...but assault merges into the murder (same acts - stabbing, shooting). I think the defense is right on this one.

"premeditation here can be as long as a week or between the stabbing and shooting" - Prosecutor.

Where she screwed up is she used two different weapons which means when she picked up the other weapons she did indeed premeditate to kill him.

January 17, 2013 Morning Testimony

DT has a motion. DT is asking for dismissal of charges, the premeditation charge.
--There are no charges of assault or burglary. March 31. 2010 the state took the position that there would be lesser included offences.
--DT says that a reasonable jury could not convict Jodi on a charge of premeditation.
--DT is reading what a felony murder charge is. Says that the state has not demonstrated this.
--Says that the state has presented nothing as it relates to any felony.
--DT says that Jodi remained in the home unlawfully after she killed Travis. She was an invited and willing guest.
--DT says that this was either premeditated murder or it's not. it's really it. these are the same events. what other crime would she be furthering? but that does not include another underlying felony.
--DT is citing some case law.
--There was no distinct offence for this burglary.

Prosecution:--re: premedition, this case shows that on May 28, 2008 before June 4, the defendant staged a burglary of her own home, then rented a car not in the county she lived, she went to a county 90 miles away. Shows up as a blonde and a male is with her. Tells the car rental staff that she is just going to "drive around town", drives to Mesa and as part of the premeditation. Takes the plate off her car. She didn't want to be recognized when she went to Travis' home. She brought a gun and a knife. Attacked Travis after she had lulled him to sleep and it is the state's position that she stabbed him first. Once she begins stabbing him, she kills him three times over. The premeditation could be as long as a week and it could be between stab wounds. Can be formed in a quick fashion. Rule 20, sufficient evidence towards that aspect of the charge.
re: felony murder. three crimes...assault. once she began stabbing him nobody can ask Travis if he still wanted her in his house. Her status changed then to an unwanted guest. If the assault continued after her being unwanted then it is a felony.
--asking the judge to deny the defendants request for the rule 20 motion.

But that's my point...it maybe the standard pronunciation or spanish pronunciation or the "correct pronunciation" in his mind, but it's not how Jodi pronounces it---so to me it is not being pronounced correctly.

Similarly (but obviously different), I hate how fellow East Coaster pronounce Nevada as Nevahda.
