The job of the prosecutor is not to win the case but to ensure that truthful evidence comes forward.

Regarding cross examination....It's not about twisting the evidence, it's about putting it to the test. If it is true it can't be discredited.

He shares a case he tried that included a shooting. He said there was lots of blood....that LE didn't take dna swabs and test for gun shot residue. He shared that the jury was frustrated (or was it frushtrated???) that LE didn't take adequate samples.

People forget that KC is human. That she could easily be anyone's daughter or friend.

There are experts that live and breathe a case....then there are experts that do the bare minimum and charge for every minute on the case. You have to find a middle ground. If the expert seems too emotionally invested in the case.....they will not be perceived as an independent opinion.

He knows that his every move will be more heavily scrutinized than normal. It requires he do double work. He states that he makes no move without consulting all the other attorneys working on the case before acting. ( IMO I doubt that)

He states that you are always scrutinized and analyzed by those that know less than you do. ( ummmmmmmmmm :rolling: )

Commenting on why he is was not well known...
because most of his trials were in the hispanic community. The English community didn't know a lot about him because of the language issue.

Many lawyers have been VERY gratuitous in their advice. (is that because he can't pay for consulting???)

The problems he has encountered in this case are such rare issues that even lawyers with much more experience were unable to advise.

One should not feel that they are not cooperating if they do not speak to LE.
You should always have an attorney present.
If you speak without an attorney present your words can be misinterpreted and used to wrongfully convict you.
BBM So was Ted Bundy and we all know what happened to him.

I think the 'gratuitous advice' he mentions is from Bill Sheaffer and Richard Hornsby, among others- attorneys who have actually successfully defended clients and have a thorough understanding of the law.

what is weird is that I recall lots of the other atty's have suggested that they forego the trial and plead in this case....

can this harm him? or this case? legally?????:waitasec:

I grew up (a long time ago) hearing about juicy tidbits.Where I come from they were many bits of gossip, or a "do you know who shes going with?" doesnt quite fit in with a murder case.I cant figure how he thinks!!

I dunno, though. Seems like, "sexy" is more commonplace now than it was just a few years ago to titillate in general. IOW...sexy = alluring or appealing. "Juicy", as in "juicy tidbit" wouldn't raise any eyebrows would it? Throw'em together and I guess its just tempting to extrapolate :saythat:

In fact, I'd say there's more innuendo in this thread than JB would get ;) Somebody 'splain it to him... it'll make you an expert :doh:

eeewwwww - why do I always feel the need to shower after reading anything about the defense in this case????? I have heard the use of the word "sexy" in many ways I would never have expected working within the legal field; however, never - never in conjunction with the word "juicy"!!!!

Example: My boss: "Draft me a motion to compel and sexy it up"
Translation: Draft him up a motion to compel and include the right information to really grab the judge's attention.

It's almost as if he's looking for credibility by associating himself with others: "See, I know what I'm doing...a whole lot of smart people have my back."
I'm sure many lawyers have told him...lots of luck!

I think that was after he posted on the Defendernet Listserv on July 31 2008 in regards to this case and stated:

"I resent any implications the press are making, this case has been swamped with misinformation being leaked. Michael Walsh and I are both members of FACDL and NACDL and would appreciate any input or assistance offered."


Problem is.....I don't think he listens to anyone!
