Its a Federal case and can't be changed into a State case with Federal charges being dropped. However, the State can bring their own charges. Double whammy.

Yes. I think that the legal team is trying to get state jurisdiction. Federal charges dropped, in exchange for state charges.

Did his legal team say or suggest that? Aren't they trying to get all charges dismissed period? Internet crime falls under federal jurisdiction, not state. In some cases, both the feds and the state could press charges. Say a defendant makes CSAM and distributes it on the dark web. The feds would cover the internet angle while the state where the assault happened would press assault charges.

I recently saw a case in Montana, same thing, CSAM. State charges only. 5 years probation!

So, I wonder if the legal team for Josh Duggar is trying to get federal charges dropped, for state charges.

The Helena man's charges were not transferred to the state from the feds -er, dropped from fed and picked up by the state.

I don't know. But that is primarily why the federal charges are involved, because they have been tracking who downloads this particular video.

I'm going to self-report this post, but I'm wondering if we could change the title of the thread to "Charged with....Child Sexual Abuse Material" rather than "Child 🤬🤬🤬🤬🤬🤬🤬🤬🤬🤬🤬".

The Sun can exclusively reveal prosecutors are requesting the court to order Josh to provide “any intended alibi defense and that such notice include each specific place where the Defendant claims to have been at the time of the alleged offense.”

The government is asking in the court documents for his alibi “on or about May 14, 2019 through May 16, 2019, between approximately 11:00 a.m. to 7:00 p.m. each day at Wholesale Motors in Tontitown, Arkansas.”

They are also asking for “the name, address and telephone number of each alibi witness on whom the Defendant intends to rely.”

Would you lie under oath to protect a sibling? A spouse? A son? A coworker? Would you be willing to testify to give someone an alibi, if you knew what you were saying was not true?

IMO, Anna would. She’s been taught that her husband is the ultimate authority, just under God. She will do anything she can to save him.

Nothing unusual about the request, but I can’t help but wonder if one alibi is someone Josh would prefer not to disclose - like a sex worker, girlfriend, or attorney.

The article is about Josh providing an alibi with witnesses and I do not think any witness will commit perjury for Josh.

Yes. But would anyone provide Josh an alibi? Would an alibi possibly create enough reasonable doubt for Josh Duggar to avoid a conviction and sentence?

Where is the line that people draw on providing an alibi?

I believe people will be honest.

"Yes Josh was at my house on such and such date."

Not so much about deliberately helping with an alibi as just simply being honest about knowing Josh's whereabouts.

I don’t think there’s any reason for anyone (save for one) to lie. What can Josh possibly offer? His political career was done back in the Ashley Madison days (affair, civil suit by the Philadelphia dancer, admitted molestation). His car business seems done, and I don’t think his real estate business is handing out jobs or anything. There’s just no incentive - financial or political - to stick with him. JMO.

Oh, and don’t forget that he suggested the CSAM could have been downloaded by an employee - those employees (at least some of whom are siblings) can’t be pleased.

Josh could offer the moon and I doubt anyone would lie for him. I'm waiting for the 11th hour plea deal to be announced.

This case couldn’t be more sordid.

Has anyone spotted the scar on Josh’s hands? I couldn’t find it. The evidence photo shows the top of the hands, not the palm, so I’m guessing it’s on the top.

I realize there was a plea deal on the table this spring, but Josh turned it down. Why would the Feds proceed with another one? They just now won all the evidentiary battles.

Anyone know what the terms were in the spring deal?
