In the face of unimpeachable evidence, Josh wouldn’t take a plea?

How did this sex offender ex-employee come to be employed by Josh? Did they meet on some CSAM site? Did they ever share materials?

I had a thought today, that maybe this was a complete set up for the prosecution. I kept wondering why the defense had not brought forth any other potential people who also had access to Josh's computer. I was waiting for an entire parade of folks, for "Reasonable Doubt".

But now, we can go for possible mistrial due to prosecutorial misconduct. So, the defense was two steps ahead.

The Duggar defense team is grasping at straws......they are now claiming the material was downloaded and never viewed so he should not be convicted or, at least have a new trial. Also, they are claiming that they couldn't call a witness who was hidden from them, except the witness worked for the pedophile so the pedophile knew he worked there and could have called him as a witness.

I can't wait for him to be sentenced. It is about time he just admitted what he had done and go to prison quietly.

-"Indeed, the evidence at trial established that certain files allegedly found on the HP desktop computer were never viewed by any user of the computer and that all the files at issue had been deleted shortly after being downloaded," according to the motion. "Thus, even in the light most favorable to the government, the jury had no evidence that Duggar personally viewed any specific portion of any of the files allegedly found on the computer. As such, there was no evidence from which the jury could base its guilty verdict as to each count."

-Duggar was precluded from calling a necessary witness, Caleb Williams, who could have helped his case by testifying he had access to Duggar's passwords at the car dealership and did work at the lot, according to the motion. The defense contends the government "hid the ball" on Williams until it was too late to call him to testify.

-Leading up to the trial, Brooks said he would allow the defense to argue others had access to the computer used to download the child 🤬🤬🤬🤬🤬🤬🤬🤬🤬🤬🤬 and to bring up those who might have done it, such as employees of the car lot.

The prosecution went to great lengths to show how the 🤬🤬🤬🤬🤬🤬🤬🤬🤬🤬🤬 was separated from the regular computer files AND he used a password that was used for his banking accounts, correct? So, who is accessing thos data someone else or Josh? Did Josh share his password to his money with a work colleague. Of course not. He didn’t plea due to his arrogance IMO.

Actually, I believe that he used the same password for everything - including financials. JMO because I don’t have a link just yet but I’m sure it is in this thread. It came up in the context of why some mystery person would plant CSAM but not tamper with finances IIRC.

IMO, there is also a patriarchal component to that. Accepting a plea would mean certain people could no longer insist on his innocence, which would taint the family.
Yes, there have already been repercussions. But admitting it and going to prison is different than a conviction by a jury.

So, now, they want an acquittal. Or retrial. And also to dismiss the lesser charge of "Possession of Child 🤬🤬🤬🤬🤬🤬🤬🤬🤬🤬🤬". They just keep throwing stuff against the wall to see what sticks.

My own personal opinion is that there is a lack of ethics to accuse someone of doing an activity that the criminal knows he did. Granted, Josh Duggar has zero ethics. His criminal thinking mentality of "Deny, deny, deny" means to me that he will never be rehabilitated. An essential part of rehabilitation is to accept your criminal actions and the harm you did to others.

Of course, it is his right to appeal a verdict. Who thought he would accept decision, and be accountable for his behavior? He could have done this from the beginning and accept a plea deal. Nope, kicking and screaming the entire way. Zero potential for rehabilitation here.

He’ll appeal it as far as he can and as long as daddy pays for it. You’re absolutely right that there’s no chance for rehab of this creep.

Is the appeal just based on that one potential witness? Did the prior molestation testimony get a mention? Anyone have a link to the motion? I might actually have time to review it later if kids keep up the good behavior!

Nope, zero chance IMO. And a huge reason he will reject any sort of sex offender treatment in prison is because he will just turn right around and make a phone call to his most staunch defender and cry on her shoulder.

Is there are reason he should have such a large modem? Mine is, like, a 6th of the size. Would 🤬🤬🤬🤬 be a reason to have all that? I suppose with gaming you would, but no one is saying they were gaming there...

Without knowing all the rules, it sure seems that way.

Especially when you have a client who is guilty as heck! No one would have even paid attention to the "reasonable doubt" witnesses, because the government had Josh Duggar wrapped up with a bow.

The only real defense was to go for prosecution screw ups. I have no doubt it was set up from the beginning.

It's my understanding that with certain P2P filesharing networks, you have to be able to host a certain amount of content for others to download, at the same time, having the bandwidth to be able to download the content you're after as well.

For instance, you and 130 other people are hosting the film The Matrix for others on the Internet to download. If 10 people are trying to download it, they can do so very quickly, using a combined 130 sources vs. downloading it from a single source. Same goes for if you wanted to download the new Taylor Swift while others are using you as a source for their own downloads. It would be slow as mud if you didn't have the bandwidth to process all these requests simultaneously!

I'd wager a bet that in these further illicit P2P filesharing networks of child predators and the like, you will not be trusted to gain access to certain files/networks unless you, too, have a fair amount of illicit material to share, for others in the network to download. (I suppose this might also show that you're "not a cop"?)

Ideally, you'd want to be able to download these illicit files as quickly as possible, as I do believe JD's computer was caught in the act of downloading CSAM files, which led to his arrest.

That totally makes sense: the hidden partition was part of a network of virtual distributed servers. Yep, that would have required bandwidth…..
My visualization…To evade the law, the illegal materials are stored “out there” and are constantly on the move. This would mean access to even a few files would require substantial bandwidth, as you’d (at least temporarily) be hosting hundreds.
I didn’t hear anything mentioned about innocent items requiring bandwidth on the computer, and there’s no gaming equipment on that desk as far as I can see. I wonder how much bandwidth Josh was paying for every month?
