Jassy... I am embarrassed that people come out with garbage like that.. I cant apologise for that person, but I am appalled at such casual denigration based on nothing but whim and venom.

I certainly don't intend to denigrate a country I've never visited but an important point to concede, I believe, is that the rate of intimate partner homicides in South Africa far exceeds people mistaking family members for intruders.

If one is to reason that Oscar's "version" is more likely because it's occurred in a multitude of others cases then it's a logical presumption this case is more likely an intimate partner homicide as those crimes far outweigh mistaken identity putative self-defence claims.

Just a couple of other points scanning the thread (O/T from quoted post):

- I don't get the comparison from SA to US cases. Every state has different self-defence laws in place. Some states have castle doctrine or SYG while others do not. Some are more permissive than others. I personally find SA's stance that all life is valuable and is therefore more restrictive (on self-defence, mitigating circumstances and affirmative defences) refreshing and preferable.

- Prosecutors not pursuing charges is never indicative of anything. Charges are always considered on a case by case basis - dependant on a wide variety and great many factors - to include, and certainly not limited to, budget concerns, in some jurisdictions - elections, and staff levels. It's only in an ideal world that every criminal is treated equally to another and always prosecuted under the fullest extent of the law.

OP doesn't by legally "have a history of reckless gun use", at least not yet and not until Masipa's judgement is in for those events which are being tried at the same time. And the Masipa will not be able to use them for her judgement on the murder or culpable homicide charges anyway, not even let them influence her and she can't even slip them in either because she has to use logical reasoning for her judgement and write it all in a judgement.

I asked Gryffindor (twice) to provide a link to a similar case to OP's (partner shot dead in toilet when they were the only other person in the house) in which the killer didn't get prosecuted.

She wasn't able to.

While we're waiting, in terms of his athletics career, would OP have been reaching the end of it? I don't follow athletics so am not sure what the optimum age for a runner is. Now if he were a racehorse, I'd have more of an idea.

I believe Mrs Stipp said that the screaming got louder, as though it was someone coming closer along the street. (Or words to that effect.) But nobody was coming along the street, or the Stipps would have seen them.

Professor Saayman corroborated this when he stated that screaming is an involuntary act, and that Reeva would almost certainly have screamed when shot even in the head.

BIB 2: IMBW but IIRC the sounds Mrs Stipp heard getting louder as though it was from outside in the street were screams and the words "help, help, help". On OP's version, he went out onto the balcony screaming "help, help, help" and rushed screaming back and forth from the bedroom to the bathroom... nearer and further. (I keep saying I'll make a quick visual comparison chart of what each person heard and when).

BIB 4: Again, could well be you are right, and I am not saying it isn't correct, but is it beyond Masipa's reasonable doubt?, i.e. a) OP said he couldn't have heard with the shots, b) even with a gap between first and second Burger said the shots were quick, i.e., bang, bang,bang,bang and IIRC her hubby and the Stipps said they were quick too, c) there are a few graphic videos around the web with people just shot and all kinds of other horrible things, and they don't all scream, moan, groan or howl, d) I have unfortunately seen many animals shot or run over and strangely not that many howls, groan or shriek as they go into shock. It depends on where they are injured and the speed as too many go into shock.

Apologies for this OT post, but just while it's quiet and for the very few Aussies here, have you been reading about the trial re the Lin family massacre in North Epping that occurred in 2009. One of the worst multiple homicides in NSW history. It was just a couple of doors down the street where my parents lived. My dad bought his daily newspaper from Mr Lin.

I've been following it, mainly because I am always interested when Mark Tedeschi, QC, is the prosecutor.. a weird and inexplicable event, this terrible crime.

Interesting article by a Prof at Valkenberg. He says if a person's found to be mentally unfit/insane and is committed, only the Attorney-General has the power to release that person eventually. It's not up to the docs.
