I think this deliberation will be very very quick. No lunch for the jury.. they pass on the food.

Who in God's name could eat after this closing. I would be walking into the deliberation saying I cannot eat, let's get this done.

It all depends on how long the defense’s closing is.

The judge might want to wait until after lunch to read the instructions, especially if he doesn’t want to break them up.

My guess is the defense will point to no body, no murder weapon, no eyewitness, no confession of course,KK is a liar and did the murder (maybe it was in the condo after all), but I can't see how they will refute the cell phone data, and all his comments unless they say everyone is a liar??

I really liked how they put his own words out there for the jury... no body no crime.. she's never coming back... masterful IMO
I was a little surprised DA May didn't handle the closing - but it sounds like she did a great job and since the jury is 7/5 (women/men) it could be a shrewd move IMO

When you are in a sport, and the team is up 60 to 0, you send in your backup quarterback as it's a done deal. Good for him to allow her to do the closing.

They probably won’t refute the cell phone data, witness statements, or surveillance footage.

I fully expect them to ignore that stuff. If you can’t win on the facts, you have to try and win on emotion.

Use the hate of KK to manipulate the jury into ignoring the things that actually matter.

“He would pass me notes if his information was too sensitive,” the man said, according to ABC News.

Colorado Bureau of Investigation Agent Gregg Slater read several of the alleged notes that had been recovered in court.

“I’d really like to see Krystal with a bullet in her head,” read one. "No video, no weapon, no body, no forensics."

Frazee allegedly wanted the inmate to eliminate at least 10 people, including Kenney’s parents, her ex-husband, his friend Joe Moore who testified last week about damaging conversations that pair had after Berreth’s 2018 disappearance and Slater himself, NBC News reports.

"They all need to disappear or be unseen until at least Nov. 22 until after the trial," Slater testified that one of the alleged notes, which were written on paper towels and napkins, read.

The prosecution has rested following closing statements in the trial of Patrick Frazee.

The day began with Judge Scott Sells instructing seven female and five male jurors how to proceed their deliberation, only considering the facts of this case, and having no communication or research about the trial to influence a decision. Frazee wore a blue-stripped-dress shirt, staring at the jurors during instruction.

Assistant District Attorney Elizabeth Reed stood up slowly in the courtroom. “We all wish Kelsey Berreth could walk through that door right now,” she said. “That’s never going to happen.”

Reed laid out Berreth’s final known actions. Conversations with co-workers about a Christmas party, and whether Frazee would attend, going to Walmart to buy medication for Frazee in the middle of the night, because he had fallen ill.

“While Kelsey Berreth is planning the future, this man was plotting her murder for months. Months!” As she points directly at Frazee. “This is not consistent with someone who’s going to walk off and leave her child. Not consistent with someone who is suicidal. It’s consistent with someone who is planning the future with the man she plans to marry.”

Reed went slide after slide, poking holes in Frazee’s timeline of events. He was seen with video surveillance at the Federal Credit Union and Walmart in town. According to Frazee, at 2:45 p.m. he went back to Florrisant to check on his cattle.

“He’s not home for Thanksgiving Dinner, he’s in Woodland Park because he just killed Kelsey Berreth,” Reed said, pointing towards cellphone records that show Frazee’s phone pinged off a cellphone tower in Woodland Park at that time.

“Kelsey Berreth is in that box. Her beaten and battered body is in that box,” Reed said. “He’s taking it back to his house because he’s going to eat Thanksgiving Dinner with Berreth in his truck.”

“Second degree murder does not apply in this case,” Reed said. “There is nothing about this case that screams degree murder. Everything is premeditated. Everything is deliberated. Do not check that box on your verdict.”

“She didn’t have to come forward at all, but when she did come forward she told us everything,” Reed said. “Including the things that subject her to criminal prosecution.” Reed continued by saying everything Lee said can be backed up by evidence. “Everything the defendant said is contradicted by the evidence.”

There are six forms of verdict in this case.

  • Verdict count 1– murder in first degree after deliberation. They answer questions: did he use or threaten use of deadly weapon, did defendant cause death. Both should be signed if guilty. Only one if not guilty. Prosecutors must prove beyond a reasonable doubt.
  • Verdict count 2 — solicitation to commit first degree murder (allegations he told Kenney to poison a coffee for Berreth on Sept 23).
  • Verdict count 3 — murder in first degree felony murder. They answer questions: did defendant use or threaten use of deadly weapon, did defendant cause death. One signed if not guilty. Both if found guilty. Prosecutors must prove beyond reasonable doubt.
  • Verdict count 4 — solicitation to commit first degree murder (allegations he told Kenney to kill Berreth with a bat on Oct 21).
  • Verdict count 5 — solicitation to commit first degree murder (allegations he told Kenney to kill Berreth with a pipe on Oct 15).
  • Verdict count 6 — tampering with deceased human body.

I cringe to think of the conversation/interaction that KK's husband had with her when he found out his children were on the hit list with him.

I don't know, but I myself would be pretty emotionally outta control upon learning such how to deal with such information. I cannot fathom.
I don't know what to make of pf's hit men. I had a goofy neighbor who talked about having hit men, but he really didn't.
But in this case, pf actually tried to get one. The people watching kk were probably non-existent though.
Eta: it's a shame the incognito witness's name was made public.

Although I haven't posted much during this trial since work is so busy I am always too far behind, I'm here in spirit always and wishing for the knockout punch of closing arguments to be fierce for Kelsey!

A few other things:
- PF is an arrogant, stupid killer - thank goodness
- Ma Frazee is, as I suspected, a malevolent force behind the narcissistic psychopathy that is PF - she won't be the first or last evil crow whispering in her dear son's ear that they'd all be better off if they had the little baby all to themselves (Nicole Montalvano case comes to mind)

Other than (potentially) the verdict, what the defense says during closing will be the most interesting part of today.

We knew what the prosecution was going to do, but the defense’s strategy is still up in the air. We’ve only heard their opening statement, in which they made a bunch of promises that they completely failed to deliver on.

Other than that and cross, we haven’t heard a thing from them. It’s all damage control of course, but I just want to see how bad things are for them.
