Finally due in court!

Bodine and Miller are both due in court for their preliminary hearings on January 11. Both are charged with first degree murder and child abuse.

Evan's father has since hired an attorney and claims the system failed his son. It is not clear yet if he plans to file civil action.

I'm not a litigation fan but in this particular situation I'd be the first one there when the courts opened. Somebody sure as ****failed this poor kid.

I am rarely so affected by simply reading something but what this little guy went through, what his mother allowed and participated in, made me cry. Be forewarned, the affidavit it VERY graphic and VERY horrible. :cry:

Something I never thought I would say -- I have just said, "I'm glad that child is dead." What an awful thing to say, but after reading through the affidavit -- I could not read it word for word, it was just too awful -- I said what I said. But that sweet child will never hurt again. Never. He is not here any longer. The angels have him now and he is laughing and safe and loved, and he has no memory of pain or fear.

I hope that man gets 100 times what he dished out to Evan and his own daughters -- when he gets to prison. And he needs to live through as much pain & fear as he gave out X ten X ten.

SMH. Dammit.

OMG after reading that I am going to have the most awful nightmares! And I'm not a little tiny boy! People like this just need to be ....

Many things seemed to fail where little Evan was concerned -- as we've seen too, too many times. Of course a big, big part of blame should go on his mother's shoulders. SMH. She certainly had somewhere else she could have gone -- if not, she could have gone to a shelter. I guess when she weighed her beautiful son against drugs, little Evan lost every time.

And I'll just skip saying anything about the monster Bodine. His punishment will come.

Then CPS. We may never know if there was negligence on their part or if it was already too late. Would better funding and staffing of CPS have helped? We'll never know...

Neighbors -- did they ever hear or see anything -- it doesn't appear so, but I may have missed any details on that.

From what I've read about Bodine, it may be that if Evan's dad had applied more pressure when he went to the house where Evan was kept, Bodine may have killed Evan's dad right there on the spot.

Why does this type thing happen again & again & again & again & again????

I am so thankful Evan is no longer in pain and is being held in Jesus' arms, nice and safe. I pray his father finds some peace in how hard he fought to protect his little boy and keeps fighting to make changes that can protect the next abused baby.

I am very happy Evan's story is national however, I am appalled at People magazines video of concrete being pored. This is not a dramatic story, this is a little boy who was horribly tortured and killed. Shame on that magazine!!!!!

sorry, it is sad and all she was beat but she is remiss in allowing this to happen to her kid. kids shouldn't be watching some new dick beating mommy. kids shouldn't be beat by mommy's new bed warmer. and visa versa w daddy. disgusting....

Not only (and worst of all) did she somehow tolerate her son being horribly abused, but she also thought so little of herself that she allowed it to happen to her. I guess the next high was just the most important thing in her world. She probably didn't have a lot of choices, but seems to me she could have called somebody and had that person pick up both her and her son and just GTH outta dodge. She could have called Evan's family. She could have called LE. SMH.

I could be underestimating the fear he may have instilled in her -- maybe she was so beaten down, she didn't see any alternative -- but to my mind, that could also be aiding & abetting murder. Obviously, IANAL.

NOT feeling very sorry for the "mother"...... If Bo Dumb __ (fill in the blank) beat her as well... then why didn't she kick him out or take her child and just LEAVE ?

Of course there may be many mitigating factors at work here; but once a person hits you , or does something to your baby-- your first instinct should be to get out !

Exactly -- even if you don't have one dime, you can walk to the nearest women's center, fire station, police station, hospital, church, Salvation Army, and you can get help. Any of those places, plus other ones, will at least know where to tell you to go for help or take you there, etc.

Maybe there is no bond because they have decided not to allow a bond for the crime. (Here in NC, a 1st Degree Murder charge does not have a bond. It is jail, period, unless the charge is lessened.)

It looks like his bond for the 1st degree murder charge is now $500,000, which he will not be able to make.

A Wichita police affidavit released Wednesday reveals recorded and timestamped abuse of 3-year-old Evan Brewer on March 12 – almost six months before his body was found wrapped in a Ninja Turtle sheet and encased in concrete. The family now believes the recording occurred about two months before the boy died.

The affidavit shows that Evan suffered as his father’s family tried repeatedly to get the Kansas Department for Children and Families, Wichita police and judges to intervene for the boy, says Brewer family spokeswoman Shayla Johnston.

Although some police and one judge did everything they could to help Evan, the rest of the child protection system failed the boy, Johnston said Thursday. She is an attorney and a cousin of Evan’s father, Carlo Brewer.

This is why I hate getting involved in children's cases they are horrific and each one seems worse than the next. Too much sadness for this old women, it breaks my heart I can hardly read about them.

The affadavit says several times that she didn't just ignore the abuse - she did some of it herself. Even before she met the boyfriend.
