Am I remembering correctly that the phone messages were prior to the incident - basically stating that she was intending to smoke the bowls. Or did she then state via messages that she had indeed smoked/driven?

If it's the former, I'm interested in how they were able to bring the charges at all, considering the only thing the messages prove is that she was planning to.

Am I asking that in a way that makes sense? Not questioning you, just trying to figure it out in my mind.

Maybe when she handed the phone over, they asked had she smoked and she said yes. You know, admitting to a lesser crime.

I'll let you do the tweets from Tim Porter Jewels - have a trial at 9:30am that I'm doing tweets for - so headed over there in a bit! Knock yourself out! :D

If her lawyer is referring to JH as her 'husband' are they claiming common law?

Yes, publicly declaring each other husband/wife puts them in common law status. I had a friend who didn't know this and had to get a divorce from a relationship she was in and that had ended 8 years previously because her ex was selling the house she lived in with him. It was nuts, she had no idea she was technically married to him.

I guess she really did clean house before reporting him missing. Or perhaps she stored the rest of her stuff elsewhere.

Right? Can't smoke a few bowls without a bowl!

Not until we see such information that is verified versus your opinion that that happened. Do you have a link. Or you just putting that out there as an off-the-wall unsubstantiated scenario?

Yet you state that as a fact? Where is that coming from?

It has been documented that the police had been called to the home numerous times for different things, mainly domestic disputes. So it is actually a FACT.

Not necessarily

Really? Is it just to smell bad? Lol! I can't stand the smell of weed.
My dh used to smoke pot, often. I could tell instantly that he had smoked it. His eyes changed, responses and even his voice. Not nearly as sharp. There's no way in heck I would have ever allowed him to drive our children under that influence.

Is this the part that they're wanting to have suppressed? Or has that ship already sailed?

I've wondered the same, However, she also told LE that she did smoke and drove with her daughter to OG, so I think it all lines up.

They didn't get anything suppressed. The judge denied their request.

I agree that is what a jury is suppose to do, but I don't believe it happens all the time. I hope she is found guilty but if I am being honest it is because of Lucas that I hope that.

If you just read an article in the paper about a woman accused of smoking a couple of bowls and then driving her one year old to a restuarant, charged with a misdemeanor 4 days after the event, 50,000 dollar bond (and there wasn't the situation with Lucas) I think alot would be saying how screwed up the system is when we have someone who physically layed a hand on a child and gets a 5,000 OR bond yet someone who smoked a couple bowls gets 50,000 bond.

Oh, I agree 100%. If it were anyone else and the only circumstance was the marijuana smoking, I'd be protesting for their release.

And I think this may very well be a problem for the prosecution.

Just jumping off your post.

Emily Glass told a police detective that the day before her stepson, Lucas Hernandez, disappeared, “she smoked a few bowls” of marijuana, then drove her 1-year-old daughter to Olive Garden for dinner.

snipped

After police Detective Ryan Schomaker read Glass her Miranda rights, the affidavit says, Glass said that around 3:30 p.m. the day before the 5-year-old disappeared, “she was cleaning then went to the garage to smoke marijuana … she said she smoked a few bowls.”

People use marijuana to treat pain, nausea, headaches, to relieve anxiety, etc. There are different types of marijuana with varying potencies. Some strains do not even have enough THC to actually get you high, but has a high CBD content which helps with some of the ailments I mentioned.

Reading the tweets has me nervous that she will not be convicted and will be released, but then I think MAYBE that will be the best thing. Clearly her being in there hasn't helped find Lucas in any way, maybe her being out will easy not to talk when there isn't really anyone to talk to right?

The judge addressed that very clearly and succinctly in the bond reduction hearing, saying no she hasn’t been charged but they can’t ignore the investigation and that she is a flight risk

Depends on how much you smoke, some smoke just enough to help with pain, anxiety etc Just like some people have a drink to relax. I think it all depends on how it is used.

You are correct. It does have some qualities. But, do you think that is why EG smoked it? She did say that she suffered from endometriosis. But she also has history of much more serious drug abuse, such as heroin. Personally, I think she was getting high. And I think that because of who she is and her history. Also, in Kansas, do they have medical marijuana licenses? If so, she may have been buying and smoking it legally but I haven't seen anything to indicate this.

Oh, EG was definitely doing it to get high lol I'm not disputing that. I thought you were just asking in general, I'm sorry that I misunderstood.

And no, there is no medical marijuana in Kansas at this time.
