Lawyers for a Kansas man accused of killing four people have been granted more time to prepare their response to prosecutors’ attempts to use their defendant’s comments to police after the shootings...

Franklin County Judge Eric Godderz on Friday set Aug. 29 to take up a motion concerning whether Flack’s statements to authorities should be admitted during his trial, which has been tentatively scheduled for September 2015.

A Franklin County Sheriff’s Office detective testified earlier that Flack told him he had killed White. Flack’s lawyers have said Flack’s statement shouldn’t be considered during trial because Flack made it after he asked the detective if he needed a lawyer.

Statements made to police by the man accused in a quadruple homicide here last year are admissible in court, even though he mentioned hiring an attorney during the interrogation, Franklin County District Court Judge Eric Godderz ruled Friday.

In a March hearing, Franklin County Sheriff's Office Detective Jeremi Thompson testified that during an interview on May 8, 2013, Flack described shooting White. According to Thompson, Flack said in an interview that Stout first shot White with a shotgun during an altercation inside an outbuilding on Stout’s property, but that Flack delivered the fatal blast after Stout handed him the gun.

“‘I shot him. He dies.’” Thompson said were Flack’s words.

You will probably have to answer a question to read the article. I did!

Man accused of quadruple murders blamed ‘Omar and Chewy’ for the killings, according to court testimony; records end up sealed

After Kyle Flack was arrested in the 2013 brutal killings of three adults and a toddler near Ottawa, he blamed “Omar and Chewy,” two men he said he met in prison, prosecutors told a Franklin County judge during a hearing Wednesday.

But authorities determined that “Omar and Chewy” did not exist after investigators checked prison records and conducted background checks, said Victor Braden, a Kansas deputy attorney general who is working with the Franklin County county attorney to prosecute the case.

In Flack capital murder case, court documents sealed outstrip documents open to public

(snip)
Maxwell Kautsch, a Lawrence attorney representing the Ottawa Herald newspaper, is challenging the sealing of the court records.

Kyle Trevor Flack, 29, was bound over March 12, 2014, on charges of capital murder in the slayings of Kaylie Smith Bailey, 21, and her daughter, Lana-Leigh Bailey, 18 months; the premeditated first-degree murders of Andrew Adam Stout, 30, and Steven White, 31; and criminal possession of a firearm by a felon.

(snip)
Flack’s trial is scheduled to start on Sept. 21, 2015.

I'm in Ottawa this morning at a motions hearing for Kyle Flack, who is charged in the death of four people, including a two-year-old child.

Caitlin Doornbos ‏@CaitlinDoornbos 59m59 minutes ago Olathe, KS
At issue this morning was the Ottawa Herald's motion to intervene in the case to have many records unsealed in the case.

Caitlin Doornbos ‏@CaitlinDoornbos 57m57 minutes ago Olathe, KS
Attorney Max Kautsch argued that the burden is the state/defense to prove to the court w/facts that unsealing would impact trial fairness.

Caitlin Doornbos ‏@CaitlinDoornbos 57m57 minutes ago Olathe, KS
Judge Eric Godderz: "My problem is when you indicate the state has the burden and has to present some kind of evidence."

Caitlin Doornbos ‏@CaitlinDoornbos 56m56 minutes ago Olathe, KS
Kautsch: Burden of proof lies in the movant to seal. They have to show how it'll impact the fairness of the trial & there's no alternatives

Caitlin Doornbos ‏@CaitlinDoornbos 56m56 minutes ago Olathe, KS
The state agreed to unseal certain records, but Godderz still wouldn't unseal them today. The issue will be taken up again on June 30.

Caitlin Doornbos is with The Lawrence Journal World Newspaper.

"I doubt the court will unseal jury questionnaire & survey. I'm not going to have those published on the front page of the @oheraldnews."

Caitlin Doornbos ‏@CaitlinDoornbos 55m55 minutes ago Olathe, KS
Godderz: "the prejudicial effect, that's the whole problem."

Caitlin Doornbos ‏@CaitlinDoornbos 55m55 minutes ago Olathe, KS
Godderz: "The paper has made sure to put (all evidence unveiled at hearings) in the paper."

Caitlin Doornbos ‏@CaitlinDoornbos 54m54 minutes ago Olathe, KS
Godderz: "I have no doubt that any record that I unseal will be on the front page of the Ottawa Herald tomorrow."

Godderz also took up the admissibility of crime scene/autopsy photos of the 4 homicide victims – whether they were too gruesome.

Caitlin Doornbos ‏@CaitlinDoornbos 14m14 minutes ago Missouri, USA
Victim Steven White's photos showed "the extent of injuries" & gunshot wounds to chest & head. Defense objected due to "prejucial effect."

Caitlin Doornbos ‏@CaitlinDoornbos 14m14 minutes ago Missouri, USA
Defense says witnesses should just recite what they saw at the scene, rather than show jurors pictures.

Caitlin Doornbos ‏@CaitlinDoornbos 13m13 minutes ago Missouri, USA
Defense Tim Frieden: "By showing the photography, you're basically taking the jury to the scene. They are truly gruesome pictures."

Caitlin Doornbos ‏@CaitlinDoornbos 13m13 minutes ago Missouri, USA
Frieden said there are "further ramifications" of showing the photos to jurors because the state is seeking the death penalty for Flack.

Caitlin Doornbos ‏@CaitlinDoornbos 12m12 minutes ago Missouri, USA
White is scene in the barn where he was found, wrapped in a tard w/cinder block on his face, state said. Judge rules all but 1 admissible.

Caitlin Doornbos ‏@CaitlinDoornbos 10m10 minutes ago Missouri, USA
Stout's photos are of his "5 to 6" gunshot wounds & skull "bludgeoned w/ the barrel of a shot gun," state said. Two women in courtroom sob.

Caitlin Doornbos ‏@CaitlinDoornbos 10m10 minutes ago Missouri, USA
Frieden: "These are very disturbing photographs. I just can't see how any jury could be unmoved enough to keep them open-minded."

Caitlin Doornbos ‏@CaitlinDoornbos 10m10 minutes ago Missouri, USA
Still judge rules all but three of the photos admissible. "Court finds photos necessary for the state to prove its case."

Caitlin Doornbos ‏@CaitlinDoornbos 8m8 minutes ago Missouri, USA
Notably, also the photos of Kaylie, 21, and Lana Bailey, 18-months, admissible. Lana is seen in photos stuffed inside a suitcase.

Caitlin Doornbos ‏@CaitlinDoornbos 7m7 minutes ago Missouri, USA
Frieden said he just filed a motion to change venues this morning. This case has been handled in Franklin Co. for more than 2 years.

Judge declines to unseal documents just yet in Kyle Flack quadruple capital murder case

OTTAWA — Prosecutors in the 2013 capital murder case of Kyle Trevor Flack agreed Tuesday to the unsealing of some documents that were closed by two judges, but the Franklin County District Court judge declined to unseal those documents just yet.

District Court Judge Eric Godderz, at the request of Maxwell Kautsch, a Lawrence attorney representing the Ottawa Herald newspaper in the effort to unseal the documents, rescheduled the hearing on the sealed documents until June 30.

In Ottawa this morning for a quadruple homicide hearing. Will the case be moved to a new jurisdiction? Find out soon.

Caitlin Doornbos ‏@CaitlinDoornbos 1h1 hour ago Ottawa, KS
State: Case should stay in Franklin County. "There's been no lynch mob. There's been no threats to blow up the jail."

Caitlin Doornbos ‏@CaitlinDoornbos 7m7 minutes ago Kansas, USA
One long morning of media bashing. First, defense wanted to change venues because of press coverage, pointing to 6 journalists in courtroom.

Caitlin Doornbos ‏@CaitlinDoornbos 6m6 minutes ago
Then judge ruled that unsealing sealed court records like subpoenas and jury questionnaires would prejudice potential jurors.

Caitlin Doornbos ‏@CaitlinDoornbos 6m6 minutes ago
Judge said releasing those documents would further aid the defense in their pursuit of a change of venue on basis of press coverage.

Caitlin Doornbos ‏@CaitlinDoornbos 3m3 minutes ago
Defense just now argued for a change of venue after 18 months following arraignment. Judge said he was being generous w/ 18; he'd wanted 10.

Caitlin Doornbos ‏@CaitlinDoornbos 2m2 minutes ago
Judge is now in chambers until 11:55 reading over exhibits, including @LJWorld articles, to decide if case should be moved to a new county.

State said it "strongly opposes" continuance of trial. "It's crunch time. The court set this up so we'd be ready in September of this year."

Caitlin Doornbos ‏@CaitlinDoornbos 6m6 minutes ago Ottawa, KS
Defense wants until April to review more discovery & conduct follow-up investigations. Lead defense attorney Ron Evans recently quit.

Quadruple homicide case will remain in Franklin County, judge rules. No decision until next month on whether to grant a continuance.

From last week:

http://www.ottawaherald.com/news/lo...cle_68c8db20-ae51-598b-8852-4ae8ebcd510a.html

Surveillance cameras at general stores and a bank captured footage of three people days before they were reportedly found dead in spring 2013 in Franklin County.

The video clips — believed to help establish a rough timeline for the killings — are part of seven discs preliminarily approved for trial by the court Tuesday as evidence to show jurors at next year’s capital murder trial of Kyle Flack...

Earlier in the hearing, Alexander, lead investigator, verified a redacted transcript of a May 8, 2013, interview with Kyle Flack that the court granted permission to admit as evidence, to which the defense has objected to for months.

I've tried to keep tabs on the case from local "sources". Unfortunately, I had to be away from the forum for awhile, but they're finally doing the jury selection. I'm just sick that it has taken THIS long to get to this point in the process! Yet, I'd much rather they take their time than rush through and blow it.

A friend was one of the 600 that was sent a jury duty questionnaire. The initial questionnaire was fairly long (27 pages). Last I knew (a week or so ago?) my friend was still in the pool and had to do an even longer, more in-depth questionnaire of 30-32 pages. This friend mentioned the pool had only been reduced (at that time) down to 500. It seems this poor jury is gonna have carpal tunnel before this even starts! lol

I won't go into any more detail than that, because I do not want to chance violating TOS or jeopardize the defendant's right to a fair trial. I don't feel my friend would have shared anything that would've done something like that anyway.

In saying that, do any locals or even seasoned WS members know how to go about sitting in on a trial? I am very curious about some of the actions by local law enforcement, their handling of the case, etc. I also want to hear from family/loved ones about who the victims really were in life. I don't want to rely on biased media coverage/local gossip to form MY personal opinion. Does a one just walk in and sit down or do they have to put in some type of request to attend? TIA!

P.S. I apologize if this is disjointed or doesn't make sense. I had to take Benedryl and it's making me loopy. lol

I would assume you could just show up and set in the court room. Most are open to the public.
