Lawyers for a Kansas man accused of killing four people have been granted more time to prepare their response to prosecutors’ attempts to use their defendant’s comments to police after the shootings...

Franklin County Judge Eric Godderz on Friday set Aug. 29 to take up a motion concerning whether Flack’s statements to authorities should be admitted during his trial, which has been tentatively scheduled for September 2015.

A Franklin County Sheriff’s Office detective testified earlier that Flack told him he had killed White. Flack’s lawyers have said Flack’s statement shouldn’t be considered during trial because Flack made it after he asked the detective if he needed a lawyer.

Statements made to police by the man accused in a quadruple homicide here last year are admissible in court, even though he mentioned hiring an attorney during the interrogation, Franklin County District Court Judge Eric Godderz ruled Friday.

In a March hearing, Franklin County Sheriff's Office Detective Jeremi Thompson testified that during an interview on May 8, 2013, Flack described shooting White. According to Thompson, Flack said in an interview that Stout first shot White with a shotgun during an altercation inside an outbuilding on Stout’s property, but that Flack delivered the fatal blast after Stout handed him the gun.

“‘I shot him. He dies.’” Thompson said were Flack’s words.

Franklin County District Judge Eric Godderz ruled Friday that prosecutors may seek the death penalty against Kyle Flack, the defendant in a quadruple homicide case...

At the Friday hearing, Godderz also set a hearing date of April 8 to review "gruesome photographs" of the crime to determine whether they should be admissible in trial.

Man accused of quadruple murders blamed ‘Omar and Chewy’ for the killings, according to court testimony; records end up sealed


After Kyle Flack was arrested in the 2013 brutal killings of three adults and a toddler near Ottawa, he blamed “Omar and Chewy,” two men he said he met in prison, prosecutors told a Franklin County judge during a hearing Wednesday.

But authorities determined that “Omar and Chewy” did not exist after investigators checked prison records and conducted background checks, said Victor Braden, a Kansas deputy attorney general who is working with the Franklin County county attorney to prosecute the case.

Kyle Trevor Flack, 29, was bound over March 12, 2014, on charges of capital murder in the slayings of Kaylie Smith Bailey, 21, and her daughter, Lana-Leigh Bailey, 18 months; the premeditated first-degree murders of Andrew Adam Stout, 30, and Steven White, 31; and criminal possession of a firearm by a felon.

The state agreed to unseal certain records, but Godderz still wouldn't unseal them today. The issue will be taken up again on June 30.

Judge declines to unseal documents just yet in Kyle Flack quadruple capital murder case

OTTAWA — Prosecutors in the 2013 capital murder case of Kyle Trevor Flack agreed Tuesday to the unsealing of some documents that were closed by two judges, but the Franklin County District Court judge declined to unseal those documents just yet.

District Court Judge Eric Godderz, at the request of Maxwell Kautsch, a Lawrence attorney representing the Ottawa Herald newspaper in the effort to unseal the documents, rescheduled the hearing on the sealed documents until June 30.

Surveillance cameras at general stores and a bank captured footage of three people days before they were reportedly found dead in spring 2013 in Franklin County.

The video clips — believed to help establish a rough timeline for the killings — are part of seven discs preliminarily approved for trial by the court Tuesday as evidence to show jurors at next year’s capital murder trial of Kyle Flack...

Earlier in the hearing, Alexander, lead investigator, verified a redacted transcript of a May 8, 2013, interview with Kyle Flack that the court granted permission to admit as evidence, to which the defense has objected to for months.

As the last motion of the hearing, Timothy Frieden, Flack’s leading defense attorney, renewed his motion for continuance of the jury trial, now set to begin Feb. 17...

Godderz denied the request Monday, but said he would take up the motion again at a 9:30 a.m. Jan. 26 hearing.

I've tried to keep tabs on the case from local "sources". Unfortunately, I had to be away from the forum for awhile, but they're finally doing the jury selection. I'm just sick that it has taken THIS long to get to this point in the process! Yet, I'd much rather they take their time than rush through and blow it.

A friend was one of the 600 that was sent a jury duty questionnaire. The initial questionnaire was fairly long (27 pages). Last I knew (a week or so ago?) my friend was still in the pool and had to do an even longer, more in-depth questionnaire of 30-32 pages. This friend mentioned the pool had only been reduced (at that time) down to 500. It seems this poor jury is gonna have carpal tunnel before this even starts! lol

I won't go into any more detail than that, because I do not want to chance violating TOS or jeopardize the defendant's right to a fair trial. I don't feel my friend would have shared anything that would've done something like that anyway.

In saying that, do any locals or even seasoned WS members know how to go about sitting in on a trial? I am very curious about some of the actions by local law enforcement, their handling of the case, etc. I also want to hear from family/loved ones about who the victims really were in life. I don't want to rely on biased media coverage/local gossip to form MY personal opinion. Does a one just walk in and sit down or do they have to put in some type of request to attend? TIA!

I would assume you could just show up and set in the court room. Most are open to the public.
