So - since I can't access other articles over here - what is going on today, 6/3 at 1pm?

I shall wait to post my stuff until I hear from someone here that watched the jury selection.

Jury Seated in Pembroke Triple Murder Trial

June 2, 2021

12 jurors and two alternates have been selected in Elizabethtown in the trial of Christian “Kit” Martin, who is accused of a triple murder in Pembroke in 2015 with proceedings expected to begin Thursday afternoon.

The case was moved to Hardin County because of perceived pretrial publicity in the case. During questioning Wednesday morning, a large pool of jurors indicated they had no prior knowledge of Martin or the case.

Circuit Judge John Atkins told the jurors the trial could last for most of this month and gave a strict warning about talking about the case with others.

On Tuesday, Judge Atkins denied a defense motion request to admit a failed polygraph test of Diana Phillips, the sister of murder victim Calvin Phillips.

Judge Atkins disagreed and said the polygraph will not be admitted as evidence. He also ruled the shell casing found will be allowed as evidence.

Also Tuesday, Assistant Attorney General Barbara Whaley asked the court to admit some cautionary hearsay statements reportedly made by Calvin Phillips and his wife Pamela that they should send the police to Martin if something happened to them.

Judge Atkins said he will review case law and make a ruling before the trial begins Thursday.

Phillips (58) & Calvin Lee Phillips (53) (Nov. 19, 2015, Pembroke) - *Christian “Kit” Richard Martin (51/now 53) arrested & charged (5/11/19), indicted (5/10/19) & arraigned (5/22/19) with 3 counts of 1st degree murder, 1 count of arson, 1 count of attempted arson, 2 counts of 2nd degree burglary & 3 counts of tampering with evidence. Plead not guilty. Held without bond, changed (10/16/19) to $3M bond.
May, 2016 was convicted of 2 counts of mishandling classified materials & 2 count of assault on a child; sentenced to 6 months in jail & discharged from the military.
Trial began on 6/2/21 with jury selection & concluded. Trial starts on 6/3/21 & will be in Hardin County moved from Christian County due to pretrial publicity. 12 jurors & 2 alternates.

Judge rules it’s more likely than not (not beyond a reasonable doubt) that Christian Martin is the reason the murder victims aren’t alive. The foreshadowing type statements by the victims before their deaths are ADMITTED.

The prosecution is actually submitting the statements under the “forfeiture by wrongdoing” hearsay exception, arguing the defendant caused these witnesses to be unavailable. (Kentucky Rules of Evid 804(b)(5))

'Sure is!

The “forfeiture by wrongdoing” hearsay exception... is interesting.
This is the first time I have ever heard of someone saying if something happens to me look to this person.....This is going to be interesting for sure. I wonder how the state will bring this into the opening.

Very sad still "protecting" master under the floor.

I got busy with other things soon after prosecution statement today and missed a great deal. But I'm headed back to listen/watch more now, though.

I had the opportunity to watch some of the prosecution's opening statement. To me the prosecutor seemed unprepared. She just sort of meandered along.

Did anyone else notice this?

I am not sure what to think , but she made sure the jury heard that the victims were scared and did tell people.

I caught some of it too and thought the same.

It was very lackluster imo.

I wasn't sure if she was unprepared of if she just didn't have any "oompf" in her words... as @BUF stated, lackluster.

Actually, I feel as if I've seen her in court before (no idea what case nor when) and she seemed much the same at that time.
