#ShaynHubers - On the stand today is now police chief, then detective, Bill Birkenhauer. He testified Hubers logged on victim's Facebook page & blocked women. He also said for every 1 text Ryan Poston sent, she would send 100, specifically during times the couple would break up

#ShaynaHubers - 12/2 (10 days before the killing) Hubers sent a message to her friend, "Yaz": I want to shoot him. I don' t know why he keeps taking me on dates. I won't turn down learning how to shoot a gun." (referencing going to the gun range)

Shayna Hubers hacked Ryan Poston's Facebook account to unfriend people and send messages to others, Highland Heights Police Chief Bill Birkenhauer said.

Birkenhauer testified Monday in the fifth day of Hubers' retrial in Poston's death. He said Hubers sent Poston tens-of-thousands of social media messages, but Poston would rarely respond to them.

Even with the hacking, Birkenhauer said it was the volume of messages that surprised him.

"All in all, I would put the number of individual messages at — pretty much, you can't count them — I would say between 50,000 and 100,000 messages,"
Birkenhauer said.

The messages, sometimes sent by Hubers, sometimes sent from other accounts but believed by police to have been from Hubers, are among a cache of electronic data uncoverd by police in the Cincinnati-area murder case. Hubers is currently being tried again for her role in Poston’s death. Her first case resulted in a conviction, but Hubers is receiving a new trial due to issues with a juror revealed to have had a felony record in the first case.

One of the messages said, “lose the beer gut and get better at your job.”

The message apparently didn’t come from Hubers, but police said they found a screen shot of the message in Hubers’ phone.

“I texted Ryan this from friend’s phone,” said an attached text in Hubers’ phone. “Check it out.”

Betcha Shayna was very jealous of Miss Ohio (she's beauty, IMO) if Ryan told Shayna he was going to meet her. Did he tell her?

He may have told her but I would bet she found out on her own--she had access, apparently, to his Facebook and his phone messages. Ryan and Miss Ohio had been messaging each other and I am thinking Hubers found out and was not happy about it. I have no real evidence that's how she found out but just taking her personality and other actions into account leads me there.

I wonder if he told Hubers that fateful night that he had a date, and that's why she decided it was time to do something about him and his ongoing attempts to break up with her. Even if she already knew, his saying it might have pushed her over the edge.

Highland Heights police Chief Bill Birkenhauer, who was an investigator with the same department at the time of the murder, was on the stand all day.

Birkenhauer indicated that Hubers was desperate to get Poston's attention. At times, he said Hubers would text Poston 100 times for every response he texted back.

Birkenhauer said Hubers texted Poston, telling him she had an aunt who was, “on her deathbed and was going to will everything she had to Shayna Hubers, somewhere in the neighborhood of $2,000,000, is what she had relayed to Mr. Poston,” Birkenhauer said.

Her former cellmate, Donna Dooley, testified Tuesday in the sixth day of Hubers' murder retrial.

Dooley also described what Hubers said said about the night of the shooting.

"She was at the mall with her mom and she got a call from Ryan telling her to come and get her things," Dooley said. "And she got there, they started arguing and she was throwing stuff around, being loud, making it look like he was abusing her so people would hear that."

Shayna Hubers cries, embraces lawyer after decision of new testimony to be seen by jurors

Update, 2:30 p.m.: During a recess in the Shayna Hubers retrial, Hubers broke down crying while in an embrace with one of her attorneys.

The break came as the prosecution planned on introducing new testimony from a witness. The defense was given extra time to prepare for the testimony, as it was unaware of it.

It's unclear why Hubers was crying. Proceedings are expected to resume by 2:30 p.m.

A judge denied a motion by the defense for Shayna Hubers to declare a mistrial Wednesday.

The motion came after a witness made a reference to Hubers previous trial. The defense said the reference made her look guilty.

The defense started presenting its case Wednesday afternoon. Hubers told police she shot Poston in self defense.

The defense's case hinges on Hubers' claims that Poston was abusive toward her during their 18-month relationship. Hubers claimed that Poston threw her against the wall in his apartment before she shot him.

The defense will present testimony from psychologists that Hubers has a history of sexual abuse and post-traumatic stress disorder.

Testimony could continue through Friday followed by closing arguments. Jury deliberation could run next week.
