The jury got the case at 6:30pm. There was a verdict at 11:10pm and at 11:21pm, the jury foreman handed over the papers. We don't close our courthouse's in Kentucky at 5:00pm like they apparently do in Arizona :smile:

Circuit Judge Fred A. Stine, who has handled the case from the start, flipped briskly through them: "The verdict appears to be regular."

It took just seconds for Stine to announce the jury had found Hubers guilty of murder.

Here are the possibilities for her sentence:

Kentucky
Offense Mandatory sentencing

First Degree Murder Death Penalty, Life Without Parole, Life with parole eligibility in 25 years, Life with parole eligibility in 20 years, or 20 to 50 years

Kentucky and Ohio confusion

Newport is in the far northern tip of Kentucky and only 7 minutes away from the bridge that connects Ky. to Cincinnati Ohio. Ryan lived in Highland Heights Ky. (same area as Newport) but his law office was in Cincinnati. Shayna lived with her parents in Lexington Kentucky, 85 miles away.

This is an older article below, but I didn't realize that it was Ryan's step cousin that introduced Shayna to Ryan.

The Poston and Carter families released a joint statement to The Enquirer early Friday morning via spokesman Pat Crowley.

Complete statement from the Poston and Carter families:

"On October 12, 2012, Ryan Carter Poston, our loving son, brother, grandson and friend was brutally murdered and snatched from our lives. The senselessness of this action is a tragedy for all families – both Ryan's and his assailant's. And while we wish that this trial could bring Ryan back to us, we understand that it can only provide justice. The same kind of justice that Ryan sought for his clients everyday. Ryan believed in the legal system. And today it worked. Twelve hardworking Americans have listened to the legal arguments, reviewed the facts, deliberated, and discerned the truth. Ryan's good name is now fully vindicated and the person responsible for this brutal act is now held accountable. We thank them for their service, insight, and leadership.

"We are also eternally grateful for the unwavering and resolute efforts of the Commonwealth Attorney's office and Highland Heights Police Department. They passionately and objectively sought the truth and proved themselves as true guardians of our safety and security once again.

When court started again Friday morning for the penalty phase, Hubers showed little emotion on her face as she was brought into the Campbell County Courtroom.

She could receive up to life-in-prison. Her conviction does not qualify her for a potential death penalty sentencing. She faces 20 years to life in prison.

The judge is expected to order a pre-sentence investigation and determine the actual sentence in four to six weeks.

Hubers Trial: Inside the verdict

2:17 a.m. EDT April 24, 2015


The sentencing phase begins at 10 a.m. Friday. The jury will hear more testimony, deliberate some more, and then recommend a sentence to Stine. It isn't known what penalty prosecutors are seeking.

Hubers returned to the Campbell County Detention Center in Newport, just a few blocks from the courthouse, where she has been held since the night of the murder.

Eventually, she will be sent to the Kentucky Correctional Institution for Women in Peewee Valley, Ky. after the judge formally sentences her in a few weeks.

The jury will determine the sentence that they recommend to the judge. The judge usually follows the recommendations of the jury, but they don’t have to.

WLWT News 5’s Brian Hamrick explained what is happening in the courtroom Friday. Hamrick said the prosecution and the defense have already completed their openings and now witnesses are being heard. The jury has heard from the parole board to explain the sentencing.

Officials said if the jury comes back with a sentence Friday, the judge will likely take that under advisement then schedule the formal sentencing in the next few weeks.
