To give you all an idea about what I call "born litigators".

I work for a firm with over 250 attorneys. I'm a para professional so I've seen my fair share of litigation. We are consistently ranked every year in the top 10 firms in the COUNTRY for our specialty area (most of which we rank in the top 5 of that list). Out of 250 attorneys we have 3 attorneys (who I consider "born litigators"), but one main standout. The other attorneys in our firm attend Court to just WATCH that one standout attorney. He commands attention in a Courtroom. And that's how I see Juan. He COMMANDS attention. And it's RARE to see attorneys go without anything at all to jog memories or keep on track. Many times attorneys need witness outlines to do their questioning. Juan doesn't. He has an amazing command of this case.

I'm in total awe of his ability.

This psych doc is really a conundrum. While I don't really believe he is infatuated with JA I think he was very interested in this case and did lean towards the defense since they are footing the bill. I just cannot understand why he would base his diagnosis on a whopping lie and also not have precise notes. All I can come up with is he is arrogant and felt he would not have to prove himself in court. It is very careless to say the least.

How about because he's just not very good? If he were he wouldn't get involved in sending a person he was evaluating a book. He doesn't tape record sessions and so makes mistakes in his notes that he can explain away. He decided she either had DID or PTSD and tested to prove one of these. (settled on PTSD)

The end justifies the means...so it doesn't matter that she answered questions on wrong story. We were going to come out with PTSD anyway.

He mad typos and didn't catch them despite numerous reviews until he was called to explain them in court. And now we see he comes up with a form that was missing and it doesn't match the original. Imagine that.

Either he is incompetent or a lying cheating bottom feeder.

I think you're spot on in your assessment. I don't think he based his assessment on Jodi's lie so much as he based it on what he himself wanted it to be.

Don't get me wrong - I believe Jodi gave him the ball and he picked it up and ran with it...but I think he was already hoping it would be PTSD (or something similar) because he wanted a defensive defense iykwim. Without one there's really little he could have testified to, if anything. It's in his best interests too for something to be so broken within Jodi she's not fully culpable of her actions.

For me, and I'm likely very biased myself, this transcends unprofessional conduct, carelessness, or even just a partial evaluation and goes straight into red hot danger zone. When you have a professional disregard testing protocols, then disregard the assessments altogether, accept deceit in turn without qualifying his opinion, and completely disregard symptomology consistent with a whole host of disorders - including cluster B personality disorders - and that opinion, and testimony, could free someone who is quite likely, imo, to kill again...

I guess it becomes a perverse, nightmarish scenario altogether for me. It's doctors like him who should be pledged to protecting people like us from creatures like her - not the other way around.

But that's JMO.

Do you feel we will hear additional diagnoses from DeMarte, ie personality d/o? or is that area off limits?

I'm drained. I'll try to keep up with the trial again during rebuttal. I can't take anymore from JA. You killed a man and now you're smiling and laughing about jurors that were chosen to rule on your fate in his case? And JW participating as well. Dr Samuels lying on stand is driving me nuts too.

Here is what I do not understand...Why did anyone really think that a defense witness, even if he is a psychologist, is not going to be biased. Just the same if the prosecution had her evaluated, I would expect some bias also. It goes with the territory. I don't share the majority opinion that this witness is a complete dufus. SOme of what he said makes sense to me. I think it's possibly she truly does not remember the actual killing. I also don't think it matters. The evidence of premeditation is overwhelming. And I realize I am in the minority opion here, but I can not stand JM. I don't feel this is passion we are seeing..it's just over the top aggression. He has every right to go after wintnesses, challenge them ect. But he is insulting, demeaning and unprofessional. definelty suffers from a Napoleon complex!! If I were on the jury and if the evidence was not so overwelhming, he would have lost me weeks ago. I am surprised the judge has allowed such conduct.

JM came out of the box hard on this guy this afternoon and IMO JM is angry. He does take his job personally and it seems that JM believes that Dick has crossed ethical boundaries.

If this goes where I think it may be going, Dick better start thinking about tapping into his retirement fund.

Does the MS actually get up and present these points during the penalty phase? If so, then I think Jodi should go ahead and pack her bags for Death Row. This woman is absolutely unprofessional in court. Her clothes frequently showcase her cleavage, she bends over Jodi, whispers to her, rolls her eyes and makes faces at Juan, looks like she's asleep most of the time, and always has at least 2 beverages on her table & she just generally reminds me of a vastly immature and ignorant woman who doesn't know how to act properly in a courtroom. :twocents:

I use to read a lot of the Dr. Dyer stuff....till he divorced his long time spouse...and moved to Hawaii and got all self serving :(

Just because those two pictures were put together (the Doc's and JA's) .. it doesn't mean that she was fingering the Doc.

Possibly she was fingering someone else ... Like, maybe, Martinez during his cross or after one of his objections?

What is her role in the courtroom? Is there really a need for her to be at a table behind the DT? If I was on the jury, I'd hate Jodi even more b/c this woman is so inappropriate. Doesn't the DT realize that if the jury likes Juan and is leaning towards the State's position, a woman on her side rolling her eyes and mugging while Juan talks is not helpful in any way.

Thanks for the response. In what way are the heights and weights wrong? Also I realize some think there were no ropes including my wife. The testimony says there was albeit from the lying defendant. If there were ropes, why would she take only them and the gun from the scene?
Yeah, I'm not believing the rope scenario. Aside from that though, and something that doesn't get mentioned a lot, is how well this crime scene was really cleaned for a presumably first time murderer.

Think about it. All they had from 29 stab wounds, a shot to the head, and a near decapitation (God, I'm so sorry, Travis.) was one partial left palm print with comingled blood, hair, a casing, and of course the photos she believed she'd deleted on the camera she washed presumably to destroy evidence.

There was almost no evidence at all of her even being there. Despite a 13 hour stay in his home if we're to believe what time she arrived by her own statement. That truly boggles my mind after seeing many crime scenes, not nearly as brutal, produce a lot more evidence.

But apparently I'm wrong and it was frenzied so it means she never meant to kill him.

My logic dictates though if the clean up were as frenzied and foggy as the defense expert wishes us to believe there would be a lot more evidence. I'm goofy like that.

HLN is saying Doc was "tearing up". It just keeps getting better.....and.....better....and better.....

I bet few "experts", certainly not Samuels, have met a prosecutor like Juan whose questions are impossible to anticipate and prepare for. I hope Samuels and Willmott spend all weekend in the vain attempt though.
