I'm just interested in whether JM is going to ask her about Snow White being an abuse victim or not.

Given that she's made the claim (probably to be humorous - I don't know I haven't seen a clip), he might not. But I SO want him to...

Given JM's style, I don't think he'd care if she said it 'in jest' or not (not really a topic to jest about, but someone posted yesterday that she was somewhat funny/entertaining after viewing a clip).

JM: YES or NO, Ma'am - DID you not say that this DISNEY cartoon character could be an ABUSE VICTIM?

ALV: "Well, obviously, that wasn't meant..."

JM: Judge - objection, non-responsive.

HHJSS: Sustained. Answer the question, Ms. LaViolette: yes or no.

ALV: Yes, but the context -

JM: Ma'am, did I ASK you about the CONTEXT of this comment, YES or NO?

ALV: Well I... no.

JM: And is it your PRACTICE, Ma'am, to study cartoon or fairytale characters for signs of abuse?"

ALV: Of course not (slight giggle).

JM: So you find all this FUNNY, Ma'am?! There is nothing FUNNY about this, Ma'am! Do you or -

This defense "expert" makes me laugh.

I work in clinical research and audit hundreds of these psych tests and assessments weekly. If the instructions for the respondents and assessors are not strictly adhered to, the data can not be used within the clinical trial. We call these Protocol Violations. In these cases, a note-to-file would need to be completed by the assessor or rater explaining why the instructions were not adhered to and the corrective action for prevention of future violations or deviations in the future. This document would be signed and dated by the assessor and filed in the participant's file. A copy of the document would also be sent to the companies (pharmaceutical), central file which keeps copies of every document within the trial regarding violations and deviations.

Here's a couple of many possible Protocol Violations that renders data useless:

- Using pencil.
This is document use 101. ALL clinical notes, tests, assessments, corrections, everything must be completed in ink. In medical records, using pencil, white out, or scribbles to obscure a revised word or number would render the data useless.
Lets say the participant inadvertently circled reaponse 1 instead of 2, the response would need to be lined through as to not obscure the original response, then the revised response completed agar to the initial response, initialed and dated by the person who completed the response keeping in mind the the assessor can not revise the participants response, must be done at the time of the assessment and corrected as detailed above by the participant. Corrections can't be completed after the day of the assessment or test. Lol

-Using a "handmade" response form for a standardized test and transferring raw data by the assessor.
I laughed out loud when I saw legal pad pages with JAs responses...in pencil!!!! Did she even sign and date these pages, Lol...and to top it off...the transfer of raw data by RS from the handmade form...in pencil...to the answer/response....in pencil...lol. In addition, to not have the entirety of the original test/scale/assessment, which includes the responses, signed and dated by both the assessor and participant.....in INK....stapled and all pages accounted for...1 of 1, 2 of 2, etc...filed in the participants file makes my brain scramble.

I could go on and on...

Lets just say, for clinical trials, if the FDA stopped by and audited files like this, which they can do at any time as federal officers, RS would be visibly shaking. If one person is consistently found in violation, the FDA could revoke their professional license for a lifetime. The worst part, the integrity of the data could place the validity of all data within the clinical trial in jeopardy.

There must be protocols for medical expert assessments, in record keeping, hired by the state for their data to be admissible in a trial. I can't wrap my head around the fact that anything he touched is admissible in this murder trial.

But why did the prosecution allow this into trial? One of my hypothesis:HHJP: is that it gives JM a lot to play with. Also, it doesn't look very good that the state hired RS, even though he is a defense expert.

By the way, has anyone put together a picture of JW with an outline of her mono color skirt suit that you can click to change the color and also change the rotation of her "bold" necklaces and sling backs...like the metallic gold she wore today! It think it would be a lot of fun to play with during her questioning to pass the time.

I really hope that Juan's rebuttal expert goes into some of these points. My jaw hit the floor when I first saw that crumpled yellow paper with the pencil marks, that he said he filled out for his patient, and then went back and filled into the proper form. :what: :what: :what:

I used to work for my father in his law office, and if any of his paid experts had tried to pass off something like that as evidence to be submitted in court, he would have had a fit.

I still cannot believe the defense team went forward with this guy.

LOL if I were a juror I would ask a question about her being a sociopath, since it says it in the text messages.

I wondered about that, too. Do they think people will only focus on Travis being a big meanie to her? Do they not see the words where he not only calls her evil and a sociopath and a game-player, but he tells her to come clean about something she did and how everyone will know about it if she doesn't come clean. He may have said mean things to her, but clearly he had very valid reasons for doing so. She lies continually, not just to law enforcement or juries when she gets caught. He gave her an ultimatum to fess up or else he will reveal what she has done to others. That's a MOTIVE.

Why on earth would they show words from the man that she brutally SLAUGHTERED that reinforce what a psycho B**** she was and IS?

Trying to think of something else. Tiger?? Nothing in my mind fits except Pit Bull. I am sure JM is also a loving person. Just look at how he is fighting for justice for Travis. Thats love and not $$$$ signs like some other attorneys and witnesses

Can we compare Martinez to something other than a pit bull, they get enough bad raps. I realize pit bulls are known to be vicious and aggressive, and that's what people want here, but they are also loving pets. Can we choose something like a wolverine or killer shark?

I agree!! I am the proud owner of a rescued pit bull and she is a big baby. My non-shaking chihuahua bosses her around. I rehabilitate abused pitbulls and always cringe when I hear that expression.

why didnt they call the guy that was in the bar/restaurant where there was music, she frequented and she borrowed money from him to make the trip?

He said on an interview she was emphatic, she needed money to get to Travis before he went on this trip.

she then had the money to pay him back, she had 200 in a check he didn't cash, she even called back after the crime to see if they could find that.

Is it because whatever Jodi told him is hearsay ?

On another thread, IIRC, another poster supposedly found something unsavory about this man when looking up "records".

I am really late to this, cannot keep up.

But watching the talking heads tonight, they had juries from the past, and one thing they all said was they couldn't watch the defendants family crying.

Martinez will do a 360 with the symptoms this expert spews. He will show that TRAVIS was the abused, not Jodi.

OK - so JM brings out a page that witness added to his book with 3-hole punch and witness says that the reason one has the holes and the other doesn't, the witness claims he took copies of it BEFORE he 3-hole punched it. This is what we are left with over the weekend. The thing I do not like is the DT will figure out where JM is going with this and will coach witness on how to explain. Any ideas?

Regarding the last line of questioning by Juan today (different scores, one being 17 and the other test scoring 15..yet he only gave her the test once).

1st day of cross exam: Doc could only find the yellow legal paper sheets where her answers were just jotted down (Exhibit 534)

Doc said he could not find the actual scoring sheet but would bring it to court tomorrow

2nd day of cross exam: Doc provided scoring sheet (white papers) which became Exhibit 535. Score of # of symptoms for PTSD = 15

Today: Juan pulls out Exhibit 550 which is also scoring sheets (white papers) which has of score = 17. Juan makes note that this one has the dots filled in. Juan says at no time did the Doc provide this scoring sheet. Doc says he has copies in his "mobile file" so he must have provided it...

Juan then takes the Doc's copy he just produced (of Exhibit 550) and makes it an exhibit (I don't know Exhibit #).

Then it gets real confusing to me. I believe Exhibit 550 had 3 hole punch but Doc's copy didn't (or other way around). Anyway, Doc quickly says he made copies before he punched the holes. Then they go to sidebar and quit for the day.

IMO, Juan thinks Doc has "cheated" and was in the process of trying to prove it.


OMFG I have never in my life seen more different copies and different results of a single test that was only given once.

I want my money back. :great:

It was PTSD that she had to meet 3 criteria of a specific section and she met (according to his intentional misinterpretation) only 2.

Yes, he could have fudged her answers to make Jodi's test say whatever he wanted it to say. He asked Jodi the questions and then he wrote down her answer (allegedly her answer). The patient is supposed to record their own answer. I think he fudged her responses towards anxiety and, of course, PTSD.

Thanks Pensfan. What is the difference between the PDS though, and the test for PTSD? I thought the PDS was to test for PTSD. Or maybe I'm just OTL, or have PMS, need a GPS (lol just being silly). The acronyms are tough sometimes, and I don't quite understand what the PDS is (but at least I didn't screw it up like Wilmott with her PSD lol). Can you explain what the PDS is? TIA.

ETA: Just wondering if these are two different tests, or one in the same. A difference of two points (15 vs 17) might seem like it's not that much, but if it's the same test where he had to "add" points to certain sections to reach the right conclusion it becomes pretty significant.
