Combine that with what we all saw her do in the courtroom with sitting on the pad and appeared to be trying to steal either the pen or pad itself.

I'd like to add that JSS has allowed Jodi to "sneak" papers in and out of folders at the defense table. I suspect that Jodi has been passing notes via the guards who are assigned to her. :moo:

And that is why I think that either he didn't know she was coming or he didn't welcome her in.
In the filing of this motion, it's said that this info did come out during the questioning of the jurors on Thursday. If the judge thought it rose to the level of a mistrial or even to the level of removing the juror, wouldn't she have done something about it then, rather than wait 3 days for the defense to file this? I mean if it were that big of a deal, it seems to me that alarm bells would've been going off in her head and Tri-color would have been gone before the defense team had time to do this.
When did it come out that Jodi kicked her mother? Was it after it came out she called her sister dumb and stupid?
I really hope that after the taxpayers have shelled out almost $1.5 million for this trial that this judge doesn't declare a mistrial. I do think juror 5 will be removed, unless this is all nothing and Nurmi has blown it out of proportion. I can't imagine him doing that, though. Can you? :juggle:
I hope Judge Stephens shuts him down with a quickness and tells him it's time to cut the shenanigans and get on with this trial.... though, I don't have a lot of faith in that happening. The DT will probably keep this up until the bitter end. I really think they think if there's a mistrial, Juan would offer a plea to spare the family from going through this again.

I'll take the heat today by saying I think this Judge is doing ok. She has a full docket, starting on time, in the morning at least, maybe beyond her control since she is involved in other cases.
I think she allows the DT/expert witnesses (eye rolling, paraphrasing etc.) to do what they want because the State hasn't made a big deal about it, if JM has an objection he makes it known.
She's overruled the DT's objections just as much if not more than the State's, it seems.
