If they are going to use that as a defense, imo, they should have put AH up there to say what happened. He could have told that bogus story and thrown Ortiz under the moving bus. But now they can only set it forth in their closing. And closing statements are not considered 'evidence' IIRC.

I bet the jurors are wondering that too.
