We had friends from out of town come by last night, spent the night here, just left. We all had a great time but I am just now catching up....

Couldn't re-watch the Opening Statements last night, couldn't watch closing this morning...snuck a few looks here at the tweets, thanks, niner...


When I began watching today, they were having discussions about the jury instructions. The DT seems to have a lot of objections...

And no surprise to me, they went after they race card, calling out the judge for naming a 'white woman' as the foreperson. I assume he chose her because she paid attention and too a lot of notes, not because she is caucasian,.....

So Defense asked for mistrial... :denied: :denied: :denied:

I didn't see the actual selection on the stream---Just the MOTION FOR MISTRIAL by Sullivan, where he complained about the foreperson selection.

I don't believe the alternates have been selected yet. Just the foreperson was chosen already, as is routine in Mass trials.

Yes, it was right after the jurors went to lunch - and the attorneys/judge went over what the Judge is reading now.

And the alternates will be picked after the Judge finishes his instructions. Sounds like he's coming to the end....

Here is where Sullivan wanted the mistrial on these:

Sullivan: again objecting to tat evidence says no case in MA ever allowed tat to come in as admission

Sullivan: Haggan use of "red herring " is improper constitutes reversible error

Sullivan: choice has racial overtones prejudicial to #AaronHernandez

Sullivan: object to choosing that particular juror this court "chose 1 of 2 white women" to be foreperson but jury diverse

Sullivan: that is constitutional error of the first order [move for mistrial based on tat prejudice red herring comment white 4-person ...

Well, Travis (the twitterer) said it would be an hour and 1/2, but the Judge said an hour. I think it's coming up on an hour now....

Going to sleep real soon! :offtobed: It's already 11pm here!

Oh I did not know Hernandez was charged in this trial for shooting AB! No wonder they brought that up in this trial!

Last charge! Still not enough time for the jurors to deliberate today - it's already 4:10pm - right?

Well, it's only 1 pm here and I feel like going back to bed already too. This judge is putting me to sleep.

Does he really need to read all of this to the jury? Don't they go through it lune by line during deliberations. I am sure they are snoozing through this themselves.

I would be really upset if the judge said my full name on the live feed. Lots of people will be reaching out to her for interviews, etc...? Or will she be trolled or bullied or even threatened?

EXACTLY! Now all of her friends, neighbors, and everyone else know that not only is she a juror but the foreperson. Huge mistake by the the judge. I bet we haven't heard the end of this.

ETA---I wonder if he isn't going to have to dismiss that juror and pick someone else. Should be easy to do since deliberations haven't begun.

I have never heard of it either but apparently that's how they do it or can do it in Mass. The defense objected to it. Their position was that the judge told the jury at the beginning of the trial that 3 jurors would be randomly selected at the end of the trial to be alternates. By picking a foreperson, that insured that there would be no chance that that particular juror would be an alternate.
