Brian Walshe’s trial for the murder of Ana Walshe was set to begin on October 20, but his attorneys requested the evaluation to determine if he was competent to stand trial, WBTS reported. Prosecutors opposed the delay.

Part of the request stemmed from a stabbing in jail last month, they said, but prosecutors noted that Walshe was back in his cell shortly after and there were no medical records to back up an competency concerns.

Nevertheless, the judge ordered a three-week evaluation at Bridgewater State Hospital with a competency hearing scheduled for October 27.

So this, IMO, is simply more delay tactics on the part of the defense. They don't legitimately believe he has competency issues, it is more spaghetti to throw at the wall conveniently fueled by the attempt on his life in jail. Wish the judge would have seen through it for what it is, but I guess judge doesn't want to further any future appeal.

A "Competency Evaluation," not to be confused with an insanity (defense) evaluation, is fairly standard across the land. It simply requires a Motion/Notice from the defendant's attorney that said defendant is believed unable to participate in their own defense, and the date this first became evident to the attorney.

This actually falls upon an attorney's ethical duty to report, over any defense strategy. For example, better for the Court to have trained professionals report that under observation, the minor flesh wound sustained by Walshe has not impaired his appetite, sleep, or thought process...

In other words, all parties need to hear whether or not Walshe is faking from an independent, trained professional, versus an uneducated opinion! Since I personally think Walshe was behind his random stabbing, I believe the trial will resume shortly after the evaluation.

Let's not forget Walshe is a convicted conman! Long before he allegedly murdered Ana, I followed his federal case -- he's had a lifetime of practice. I trust the evaluators are wise to him. JMO

ETA: Should the Court rule Walshe "not competent," he'll be ordered to receive treatment to regain competency, and he'll return to Court when he's deemed "competent," and trial will then be scheduled to continue.

I'm going to guess he's impossible to work with, won't work with his own defense team.

To my knowledge, no such complaints thus far. Walshe is dangerously manipulative and can be very likable.

IMO, he began presenting with symptoms to his attorneys and did not improve, and as required, they provided notice to the court. Now we wait to hear if Walshe was faking his symptoms, so the trial date can be rescheduled.

"The defendant has made progress, but both mental and physical effects of the violent assault have continued to prevent him from being able to adequately participate in preparing his defense," Tipton wrote. "He has made great effort to do so but at this time it is evident that the trauma resulting from the unexplained and sudden attack continues to significantly impact on his ability to work with his attorneys in a manner required as his complex trial approaches."
