A Massachusetts man who is accused of murdering his wife nearly a year ago and dismembering her body is getting a new lawyer.

On Tuesday, attorney Larry Tipton told 5 Investigates that he was asked to defend Brian Walshe, of Cohasset, because he needs a public defender.

PLYMOUTH, Mass. —
Brian Walshe, the Cohasset man accused of murdering his wife, Ana Walshe, has also been involved in a probate dispute, around accusations that he stole a half-million dollars from his late father's estate. That case was dismissed yesterday, after Walshe's relatives said they didn't want to spend more money pursuing what they may never be able to recover.

Walshe’s father, Dr. Thomas M. Walshe, died in 2018. Brian is accused of going into his father's home in Hull and destroying his will, then selling his father's art, rugs, jewelry, and a car. His relatives said he was also attempting to sell the home.

The matter was scheduled to go to trial this Friday, but yesterday the case was dismissed, with relatives stating they didn't want to spend more money litigating against Walshe because he wouldn't be able to pay what they say he owes.

Accused Cohasset murderer Brian Walshe found indigent, gets court-appointed attorney​

Walshe was the subject of a brief hearing conducted by Norfolk Superior Court Judge Beverly J. Cannone over Zoom Thursday afternoon. It was the first hearing in the once very active case held in several months.

In the hearing, Cannone found Walshe indigent and approved his attorney Tracy Miner’s motion to withdraw. Attorney Larry Tipton will now take on the role on the taxpayer dime.

It was a quick fall to indigency status. In March of 2022, he and his wife pocketed nearly $1.4 million from the sale of their oceanside home on Cohasset’s Jerusalem Road. That home mysteriously caught fire just days after Ana Walshe went missing on New Year’s Day 2023 — though authorities have said that it’s merely a coincidence and the fire has nothing to do with her disappearance.

Attorney of accused wife-killer Brian Walshe withdraws from case; judge approves new one​

In Dedham Superior Court, Both Walshe and Miner appeared remotely as a judge accepted Walshe’s lawyer’s request to leave the case.

Walshe’s new attorney is public defender Larry Tipton.

Tipton was also in Dedham Superior Court for another high-profile client, Emmanuel Lopes.

Lopes is charged with the murders of Weymouth Police Sgt. Michael Chesna and bystander Vera Adams in 2018.

Murder suspect Brian Walshe, now indigent, gets court-appointed lawyer​

The case has been on hold as prosecution and defense have been waiting on DNA evidence testing. Miner said at a November hearing that they expected to have "everything" by the end of the year.

Asked by the judge for an update on evidence analysis, prosecutor Greg Connor said, "we're kind of at a stand-still as far as DNA."

1 year since Ana Walshe was last seen: Here's where the case stands​

The latest change in the progress of the case was the withdrawal of Walshe's former defense attorney in January. Public defender Larry Tipton was assigned the case.

At the time, attorneys said the case came with nearly 1,000 pages of discovery for Tipton to review and additional DNA testing is expected.

"This is going to be a DNA complex, DNA heavy case," WCVB legal analyst Greg Henning says. "They need to prove that Brian Walshe killed his wife and also prove that she is deceased. So, the fact that there’s DNA in different locations, different quantities, bone fragments, blood residue, all of those things are going to be vetted and fleshed out."

What’s next in the Walshe case?​

The last public search in the Walshe case was in August, when state police were searching again in Peabody from a tip from two residents, but officers found “nothing,” the district attorney’s office said.

When asked for a recent update on the investigation, State Police spokesperson David Procopio gave the statement, “Massachusetts State Police investigative units are working closely with the Norfolk District Attorney’s Office as the criminal proceedings against Brian Walshe move forward.”

“Troopers and prosecutors continue their meticulous preparation with one goal in mind — to secure justice for Ana Walshe,” Procopio said. He added the Forensic Services Division was analyzing various evidentiary items at the crime lab and arranging for testing at an outside lab.

Brian Walshe to be sentenced next month on federal art fraud charges​

Brian Walshe, the alleged killer of his wife Ana Walshe, will be sentenced next month in a federal art fraud case, Channel 5 reported.

The scheduled date comes after an agreement between his defense lawyer and prosecutor, which is “intended to settle the issue of how accusations that Walshe stole from his father’s estate should affect the federal sentence,” News Channel 5 reported.

Walshe, of Cohasset, was charged with selling two counterfeit Andy Warhol paintings in 2016. Investigators believe he took the authentic paintings from a friend and used photographs to attempt to sell replicas on eBay.

Though he pleaded guilty in 2021, sentencing was delayed because of allegations that he stole from his father’s estate. Walshe allegedly pulled over $100,000 from his father’s bank accounts three months after his father’s death in 2018, Boston.com previously reported.

In nearly 175 pages of filings in the art fraud case, prosecutors said Walshe “orchestrated a scheme” that encompassed “repeated falsehoods.”

“It remains even more fitting now that it has become clear that the defendant engaged in obstruction of justice after pleading guilty,” prosecutors said in court filings. “Accordingly, the government requests that the Court sentence the defendant principally to 37 months in prison, at the low end of the Guidelines with the obstruction enhancement.”

“The defendant orchestrated a scheme of many years, encompassing repeated falsehoods and financial complexity,” prosecutors said. “The defendant did not commit these crimes by mistake or one-time error: he obtained paintings from a person who thought he was the defendant’s friend; he manipulated the services of artists; he lied to potential buyers, obtaining their money by fraud; and he laundered the money afterwards. In his wake, he left a disappointed friend (Victim 2); a frustrated and harmed collector (Victim 1); and another buyer whose relationship with his own father was destroyed (Victim 3).”

Walshe was sentenced to 37 months in prison followed by three years of supervised release. He was also ordered to pay $475,000 in restitution.

Prosecutors said Walshe sold two replica Andy Warhol paintings back in November 2016 for $80,000. The buyer said the paintings appeared to be authentic in the online listing, but learned that was not the case after they were picked up by an assistant.

Walshe ignored the buyer’s calls at first, according to prosecutors, then made excuses for not refunding the money.

Brian Walshe was active Monday in both the major criminal cases he's involved in — he had his first hearing in months in the murder case over the alleged killing of his wife, Ana, while his lawyer in federal court appealed a sentence recently handed down over art fraud.

At the status conference at Norfolk Superior Court in Dedham, Massachusetts, lawyers for the two sides established that Walshe's new, court-appointed lawyer still needs to catch up on the evidence in the murder case.

The next date in the case was set for May 1. Walshe's appearance was waived for Monday's hearing, and while he had been due to appear virtually, he wasn't on the Zoom call.

The court session was brief because the case was continued until May 1 to allow Walshe’s new lawyer, public defender Larry Tipton, more time to get up to speed on evidence in the case based on a DNA sample that had to undergo “destructive testing” — meaning there was not enough of that sample for the prosecution and defense to conduct independent analyses.

The continuation will allow both sides an opportunity to come to an agreement on the destructive testing once Walshe’s attorney has had time to review the evidence.

“This is not in any way an unusual delay, particularly after a change of defense counsel,” Norfolk County District Attorney’s Office Spokesman David Traub told the Cohasset Anchor in response to an inquiry after the conference. “It’s just part of the relatively normal progress toward trial.”

Larry Tipton was appointed by Dedham Superior Court in December to defend Walshe in after Walshe's previous attorney, Tracy Miner, withdrew due to his inability to pay.

Until recently, Tipton had been occupied in the defense of Emanuel Lopes, the Brockton man convicted on Feb. 16 of shooting and killing Weymouth police Sgt. Michael Chesna and Weymouth resident Vera Adams. Lopes is scheduled to be sentenced on March 16.

During Monday's brief status hearing in Dedham, Norfolk County Assistant District Attorney Greg Connor, who also prosecuted the Lopes case, updated Judge Beverly Cannone on the status of DNA testing at the Bode crime labs in Virginia.
