GUILTY MA - Ana Walshe, 39, allegedly left home, may have been dismembered, Cohasset, Jan 2023 *husband indicted* #4

What is the CW's case for premeditation?

  • #2,262
So... he likely stabbed her. With a kitchen knife? Which he thoroughly cleaned? Multiple stabs? Is that where dismemberment even occurred to him?

Starting to form a cohesive picture.

Even though the judge is going to consider it she seems to be favoring the CW's breadcrumbs.

Like any circumstantial case. Connecting the dots.

There are a lot of dots here.

Tipton has seemed to lowered his tone today. He was almost sheepish to the judge this morning when he told her Brian wouldn’t be testifying and no witnesses….after he had sent 5 motions about his testimony last night and the judge had researched.

Do you think Brian changed his mind this morning, or they changed his mind?

So the jury will find out about lying to the police and disposal of the body of AW. along with lying to his federal probation officer and his art fraud.
They are only to consider murder

Yay

Their ONLY hope is that the jury gets lost in the legalese weeds and can't reach an agreement on what he did do, because there is no witness to it.

BW testifying would not be believable. Guessing they convinced him to gamble on the juror disagreement, and the less they (the defense) say, the better.

I can't wait to hear the Defense's argument. 100% legalese, I'm betting.

It's their only chance.

Yay

I like this instruction.

Jury can be aware of those things, they can weigh them, but they CAN'T find him guilty simply because he's guilty of THOSE things.

As an aside, I really like it when we get to watching judges and counsel work through jury instructions. It's very instructive.

I'm jealous of her hair, boy did she win the hair lottery. Thick and lots of it.

She's fantastic as a judge also.

The judge: there is no evidence of sudden death...

  • #2,273
Defense: there's no direct evidence of a homicide....

I love this judge.
I would love to hear her unfiltered thoughts on Judge Canone and the Karen Read trial. Canone won a person of the year award from the Norfolk Bar Association. To me this implies that she has some level of respect and support in the legal community there. But also, I can’t believe that is actually 100% true - it would be interesting to get the low down from someone competent within their judicial system. Jmo.

Judge upholds that the CW can say there in no evidence of sudden death and that the circumstantial evidence suggests homicide.

  • #2,276
Judge gave the parties 3 CW cases she wants reviewed.

She says the CW can't say BW didn't testify but could say there was no evidence provided that AW died of natural causes.

Defense can argue there is no evidence of homicide

Defense the CW case is built on a house of cards

Him whining about this is rich.
Where were the experts

IMO the Defense is leaking their closing argument. It is going to be a joke.

They are going to argue that the CW's expert who did say that SUDs is real as their basis for the closing argument.

The judge is rocking this.

The bloody slipper, the hair -- that all came before the clean up purchase. Therefore, violence already occurred.
