6/18/25 Update: Wednesday’s hearing was the third for the motion to suppress the results of a search of Walshe’s phone & iPads. State police investigators testified at hearings in May. Sgt. Yuriy Bukhenik testified at one of those hearings, an investigator who testified in the Karen Read trial. Brian Walshe’s attorney Tracey Miner (from Federal case) took the stand Wednesday to explain how state police obtained his electronic devices, which authorities say he used to search the internet about body decomposition while his wife was still missing. The Google searches, along with other evidence, led state police to charge Walshe with the murder of his wife, Ana Walshe, and a single count each of body dismemberment & witness intimidation. Walshe’s lawyers contend the investigators’ search of his devices violated his rights. Walshe’s defense argued that Miner negotiated an agreement with Norfolk County DA Michael Morrissey’s Office for state police to examine his phone & two iPads only for messages between him & his wife, and nothing else. Norfolk County prosecutors argued on Wednesday that Miner only narrowed the dates of when police could examine messages between Ana Walsh & Brian Walshe, and that there were no agreements about excluding internet search history. The judge took the matter under advisement, and his next court appearance is scheduled for 7/14/25 a non-evidentiary hearing to dismiss @ 9am.

Norfolk County prosecutors argued on Wednesday that Miner only narrowed the dates of when police could examine messages between Ana Walsh and Brian Walshe, and that there were no agreements about excluding internet search history.

Miner testified to the presiding Judge Diane Freniere, however, that the agreement she struck with investigators did not extend to location data or internet searches.

“I told [Walshe] a search warrant or broader consent would be needed,” Miner said.

She said she’d reviewed text messages, emails, voicemails and deleted emails from his iPhone before Walshe ultimately decided to turn over his devices to police because he wanted to help them as part of their missing persons investigation.

A few days later, police investigators interviewed Walshe, and when they began asking about the Google searches for body decomposition, Miner said she cut off the questioning.

The discovery of the evidence on the devices was “inevitable,” Yas said.

Yas suggested that Miner misremembered the agreement she reached with investigators, “more than two years since this event.”

This seems to be the filing that Morrissey submitted on Thursday that he intended to destroy Proctor's data the next day. The way the prosecution has been dragging their feet and now tried to destroy evidence with 24 hour notice, I can't help but feel that there's some more bad stuff on Michael Proctor's phone that they really don't want anyone to see.

From the quoted MSM link, there's really no excuse for Morrissey's initial 24-hour warning, which could have proven catastrophic! JMO

In Norfolk County Superior Court on Thursday, discussions revealed that the order itself is confidential. The judge requested a copy of the order and urged the defense attorneys to seek relief from the federal judge who issued it.

Walshe believed that jail "was off the table," a state prosecutor said during Thursday's hearing, if "Ana was deceased or disappeared."

Oh my, this dude suffers from a delusional disorder --in addition to being evil!

Walshe's federal plea agreement with the proposed sweet deal of only 37 months was never implemented! A sentencing date was scheduled but I recall it never happened because while the court was trying to determine how BW was going to satisfy the financial part of the plea agreement (pay $450,000 restitution for the crime against Rivlin and others who he defrauded), the Court became aware of the alleged fraud Walshe was then committing against the estate of his late father, causing his federal sentencing date to essentially be placed on hold-- until the Court was satisfied the plea agreement was valid, and BW was not in violation of his terms of bail release, etc.

“There’s nothing in the grand jury exhibits that has any statement, any conduct that can be attributed to Mr. Walshe that he planned to … harm Ms. Walshe,” his lawyer argued.​

But, Judge Diane Freniere alleged Walshe told police he had access to his wife’s messages, and that evidence also indicated he searched the name of his wife’s affair partner several times in late December 2022. Walshe’s federal art fraud case added further strain to the couple’s relationship, she pointed out.

“It’s clear that there was sufficient evidence before the grand jury that this marriage was in distress over the issues relating to his then-pending federal sentence and the implications on their life and where the children lived,” Freniere said.

She appeared skeptical about the legal basis for Tipton’s request, suggesting his arguments may be more appropriate in pretrial motions in limine, which seek the exclusion of certain evidence or theories during trial.

“To me, you’re seeking to limit the commonwealth regarding the theories it may pursue at trial, based on … your perceived failing of proof in the grand jury,” Freniere told Tipton. “It seems to me that’s not a dismissal of the indictment for first-degree murder; it’s a motion in limine to say … that the commonwealth can’t have that evidence at trial.”

Walshe’s case returns to court for another hearing Aug. 1. His trial is scheduled to begin Oct. 20.

During a hearing Thursday, defense attorney Larry Tipton argued that prosecutors have incorrectly inferred that Brian killed his wife, Ana Walshe, after discovering she was having an affair, claiming there’s no evidence that Brian knew Ana was having an affair.

Judge Christine Freniere pushed back on this claim, citing evidence presented to the grand jury that Brian had searched the name of a man his wife was allegedly involved with six times on December 25, 2022.

The prosecution also highlighted testimony that Ana had told a friend about a “huge fight” over Christmas and had given her husband an ultimatum regarding his pending federal case.

Prosecutors alleged Brian murdered Ana on January 1, 2023, and spent the following days concealing the crime. Her body has not been found.

Judge Freniere took the matter under advisement and will issue a ruling at a later date.

Confirming my earlier recollection that BW was not sentenced for his Federal Art Fraud case until AFTER he murdered and disappeared Ana!

The investigation into BW's fraud against his father's estate-- after fraudulently appointing himself representative of the estate-- was ceased by the rightful personal representative, after BW failed to provide an inventory of the assets, and was then arrested and charged with Ana's murder. :(

On 2/28/24, the following Restitution terms applicable:

Payment of the restitution shall begin immediately and shall be made according to the requirements of the Federal Bureau of Prisons' Inmate Financial Responsibility Program while the defendant is incarcerated and according to a court-ordered repayment schedule during the term of supervised release. A payment in the amount of $95,077.97* has already been paid.

IMO, BW never truly made any restitution here; the payment above represents forfeiture held by the government that Attorney Miner negotiated to be released and applied as restitution-- predating BW's perjury during bail release pending plea agreement & sentencing negotiation in 2021.

ETA: * This question came up during BW's hearing on 7/24 when the Court was questioning the parties whether or not the Grand Jury received confirmation of any restitution paid by BW on his Federal Case. (No answer provided).
