Krupp. 7/25/25 Update: Walshe, the convicted fraudster who was facing massive fines & federal prison time for selling bogus Warhol paintings to a West Hollywood art gallery owner, allegedly dismembered his wife at their Massachusetts mansion so he could become the sole parent for the couple's three sons, and to inherit "millions" from a life insurance policy, prosecutors revealed at a court hearing Thursday. Thursday's hearing was rooted in Walshe's defense attorneys arguing that investigators for the Norfolk County District Attorney's office did not properly obtain search warrants before extracting incriminating online searches Walshe made after his wife vanished on New Year's Day 2023. The searches included: "how to dispose of a 115-pound woman's body" & "how long for someone to be missing to inheritance (sic)?" according to the documents. His murder trial is slated to begin in late October. A Massachusetts judge will rule on the defense motion to dismiss evidence collected by state police without following proper procedure in the coming weeks.

7/25/25 Update: During a hearing Thursday, defense attorney Larry Tipton argued that prosecutors have incorrectly inferred that Brian killed his wife, Ana Walshe, after discovering she was having an affair, claiming there’s no evidence that Brian knew Ana was having an affair. Judge Christine Freniere pushed back on this claim, citing evidence presented to the grand jury that Brian had searched the name of a man his wife was allegedly involved with six times on December 25, 2022. The prosecution also highlighted testimony that Ana had told a friend about a “huge fight” over Christmas & had given her husband an ultimatum regarding his pending federal case. Prosecutors alleged Brian murdered Ana on January 1, 2023 & spent the following days concealing the crime. Her body has not been found. Judge Freniere took the matter under advisement & will issue a ruling at a later date. Walshe’s case returns to court for motions hearing on 8/1/25 @ 2pm via Zoom.
7/30/25 Update: Norfolk Superior Court Judge Michael Doolin ordered several out-of-state witnesses to appear at Walshe’s October trial at the request of prosecutors. Judge Michael Doolin issued five certificates of materiality on Wednesday, essentially a procedural step certifying to a court in another state that the witnesses were necessary to the proceeding, in this case, Walshe’s trial. Prosecutors must get a judge to sign off before ordering a witness from out of state to appear in any case. The certificates will allow prosecutors to call Jeremy Dozier, a private investigator hired by Walshe’s mother, to investigate whether she was having an affair; two employees from the Washington, D.C. real estate firm where Ana Walshe worked; a keeper of records for the airline JetBlue; and a friend of Ana Walshe’s. Prosecutors intend to call two witnesses from the real estate firm Tishman Speyer: the director of security and the director of human resources. Hugh Dunleavy, the security director & Theresa Marchese, the HR director, can testify no work emergency would have prompted Ana Walshe to leave her home on Jan. 1, 2023, prosecutors wrote. Another witness, Alyssa Kirby, went out with Ana Walshe in Washington, D.C., in the days before her death. Ana Walshe was “uncharacteristically emotional & extremely upset” that night, prosecutors wrote. She told Kirby about her husband’s pending sentencing in his federal art fraud case & her desire to relocate the couple’s three children to Washington, D.C. Brian Walshe appeared remotely for a brief hearing Friday afternoon in Plymouth Superior Court as his trial quickly approaches.

The hearing came after a number of recent developments in the shaping of the upcoming murder trial. Presiding judge Diane Freniere sided with prosecutors almost entirely in two recent decisions, mostly striking down the defense's efforts to suppress key digital evidence, including Google searches allegedly made by Walshe about getting rid of a dead body. In the second decision, Freniere allowed a small part of the defense's motion suppress evidence gathered via search warrants — evidence obtained from a tracking device on Walshe's mother's car cannot be used, and evidence on Walshe's phone obtained from Verizon for Dec. 30 and Dec. 31, 2022 cannot be used.

The issue of the potential conflict has been put on "pause" to give Walshe and his attorney Tipton to discuss how they feel about the relationship between the judge and the attorney working with the state.

Judge Freniere is giving Tipton the chance to consult with Walshe via Zoom and they will touch base next week on the issue.

The Norfolk District Attorney's Office made filings this week to prepare to call out-of-state witnesses, seeking certificates from the court to order them to attend the trial, scheduled for Oct. 20.

The Commonwealth intends to call Jeremy Dozier, a private investigator at Axios Investigations Firm in Washington D.C. Prosecutors wrote in their filing that Brian Walshe's mother hired Dozier "to conduct surveillance of the victim for the purpose of proving infidelity."

In order to call out-of-state witnesses to trial, prosecutors must secure an out-of-state material witness order and have it signed by a judge in the venue of out-of-state jurisdiction.

In another recent development in the Walshe case, Judge Diane Freniere issued a decision on each of the two motions to suppress filed by the Walshe defense team.

In the first decision, which dealt with whether investigators went beyond the scope of Walshe's consent in their search of his devices, Freniere denied the defense's motion entirely. That means that evidence like the alleged Google searches made by Walshe will be allowed to be presented by prosecutors at trial.

In the second decision, Freniere allowed a small part of the defense's motion suppress evidence gathered via search warrants — evidence obtained from a tracking device on Walshe's mother's car cannot be used, and evidence on Walshe's phone obtained from Verizon for Dec. 30 and Dec. 31, 2022 cannot be used.

I disagree with this interpretation, but I'll pull the docket.

During Friday's zoom hearing, Judge Freniere notified the parties that there could be a conflict (for her to continue on this case if the defense protests) due to an attorney for the Commonwealth being a friend of hers.

The name of the lawyer is Michael Sullivan, and he's helping the CW with federal materials relating to the case. She requested defense attorney Larry Tipton discuss the potential conflict with the defendant, and advise the court next week if they believe they are going to ask Freniere to recuse herself. In other words, filing a Motion would not require a hearing.

"It's almost a complete victory for the government, straight across the board when you talk about the evidence uncovered as a result of the searches made," Coyne said. "It's an awful lot of very, very powerful evidence that supports the government's case."

DEDHAM, Mass. (Court TV) — With a federal deadline looming for the destruction of documents tied to former Massachusetts State Police Trooper Michael Proctor, tensions flared in Norfolk Superior Court Tuesday over whether defense attorneys can get a look at the so-called “Proctor files” before they vanish.

In a significant development, federal prosecutors agreed to release some of Proctor’s communications related to the Karen Read investigation to Walshe and four other Norfolk County defendants whose cases somehow involved Proctor. [..]

Prosecutors maintain that they have the documents but cannot review or release them without a federal court order. U.S. District Judge Denise Casper has ordered that the records be destroyed by Monday. In court, Norfolk County prosecutors argued that the order bars them from reviewing the remaining materials disclosed by the federal government in the Read case for information that could benefit the defendants.

However, Larry Tipton, a lawyer for Walshe, countered that prosecutors must fulfill their constitutional obligations and go through the materials at their disposal. He stated that the federal court order did not prevent them from reviewing these documents. Tipton emphasized that a prosecutor handling both the Read and Walshe cases found exculpatory information in an unrelated case during her review of the materials, yet was prohibited from sharing it.

Judge Peter Krupp questioned the prosecution’s assertion that federal constraints barred them from reviewing the materials, reminding them that State discovery rules require evidence favorable to the defense be disclosed. When prosecutors stuck to their stance, King’s attorney Rosemary Scapicchio accused them of evading their constitutional responsibilities, while Walshe’s attorney described their reasoning as “creative thinking.”

Lawyers for Brian Walshe filed a motion to dismiss his murder case on Tuesday, arguing that prosecutors’ inability or unwillingness to go through materials turned over by the federal government for information beneficial to Walshe was a violation of his rights.


It’s the second motion to dismiss that Walshe’s lawyers have filed in recent weeks. The first was the subject of a hearing last month and has not been ruled on. The motion filed Tuesday has yet to be heard before a judge.

The Walshe motion claims that failure to dismiss the indictments or to order the district attorney’s office to review the materials would rob him of his rights to a fair trial, due process, and to have effective assistance of counsel.



“The commonwealth has failed to inform this court or any court what the exact basis is that they’re relying on that says they can’t review the documents in their possession and custody,” Larry Tipton, a lawyer representing Walshe, said at a hearing Tuesday afternoon.



Walshe’s case is unlike many others confronting the same issue because one of the prosecutors from the Read case, Laura McLaughlin, is assigned to his case.



In her review of the federal materials, McLaughlin identified information she deemed could be beneficial to a defendant in an unrelated case, according to court filings. But she has said she was not allowed to turn over the evidence.



Norfolk Superior Court Judge Peter Krupp has not taken any action on the federal materials issue, repeatedly saying he did not want to enter an order that contradicted the federal court. But he warned prosecutors that they could face sanctions if they didn’t comply with their obligations.

Walshe’s case, and four others, will be back before Krupp at 2 p.m. on Thursday.

*Discovery Motions Hearing (@ 2pm ET) - MA - Ana Walshe (39) was last seen at her home in Cohasset shortly after midnight on New Year’s Day, Jan. 1, 2023, according to her husband. She was reported missing Wednesday, Jan. 4, 2023 from her employer in Washington D.C. - *Brian Reza Walshe (47/now 50) arrested (1/8/23), charged & arraigned (1/9/23) with intimidation/misleading police during the investigation into his wife's disappearance. Bond $5M Surety/$500K Cash. Plead not guilty. Quincy DC in Mass Court / moved to Norfolk Superior Court
*Re-Charged (1/17/23) & arraigned (1/18/23) with murder, assault to beat Ana with intent to murder & improper transport of body. Plead not guilty. Held without bond pending indictment. Held in Norfolk County Correctional Center.
*Indicted (3/30/23), re-charged & arraigned (4/27/23) with 1st degree murder, for misleading a police investigation/ obstruction of justice & for the improper con3veyance of a human body. Plead not guilty. Held without Bond. Norfolk Superior Court
