In question, a screen shot from a video to show a rug in the home, Defense finds it inflammatory because it shows Ana and a child. Judge asks the State to look for a different screen shot, wants to reduce the inflammatory effect, by showing the child.

Judge says she has not given the jury an instruction of consciousness of guilt. She's inquiring, reference the defendant doing searches vs user doing searches. Really solid argument she raises. Iiyc says the Defense opened the door, by conceding he lied to police (in their opening). Consciousness of guilt is a huge factor here IMO.

If the Defense can find a doctor to explain sudden death in adults, it's still a leap that this is what happened to Ana, especially without a body to confirm it.

So, question, will they have to put Brian on the stand to testify to this imaginary sudden death? Seems like a bad idea all around. They know he's lying. I think Brian only goes on the stand if HE chooses to, against legal advice. I think he thinks he's credible and can gaslight his whole audience. So will he?

Defense really wants the jury to know that "no one" used the child's iPad mini for "no one's" nasty searches.

Win one for the Defense. Daddy didn't use the child's iPad.

Lose 1000 for the Defense because Brian still fid those searches, he just used his own phone. Really hard to establish a moral history -- he didn't sink so low as to use his child's device. He didn't need to sink that low. He's already in the basement of the basement of low.

Another sidebar. Defense is asking questions of the witness but not providing any materials, for reference. It's obvious to me he's just trying to confuse the jury with words. Word circle, no points.

It's their way to create reasonable doubt. Without her body there is no way to know how she died. The blood and everything else, they are going to say, happened after her sudden death because he panicked. I don't like it but that is the direction they are going. They really don't have anything else to work with.

I think the rug will be a key piece of evidence. There were no rugs in the basement. Where ever that rug was located in the house may be the crime scene.

Ok I get it. They are going to say that since BW was searching for a Porsche and a 4 karat diamond ring he didn't premeditate murdering Anna. Tying in checking what was in the Chase account against making a large purchase.
Diminishing the divorce searches including one search about Katie Holme's divorce.
