Jury excused so judge can handle a legal issue

May extend into lunch recess.
Prosecution is trying to get ahead of the sudden death angle maybe?

Regarding lunch. Does the jail/prison have to pack the defendant a sack lunch? Is that how this works when you are already in custody but at trial? I hope so because BW gets to look all nice in court but I hope he has prison food for lunch.

I think the Defense can bring him lunch.

I think I recall that from the Murdough trial.

But of course that could lead to contraband so...

I hope he gets PB&J.

Oooo, good thinking.

But in sure the Defense's expert, if they have one, won't touch Ana and her health at all. Will talk in sweeping generalities about other adults' unexplained deaths.

If they present anything at all.

BBM. Exactly.

Since the judge isn't allowing that health rating in, at least at this point, I how the State is prepared to bring her medical records foward to refute the Defense's assertion of sudden death.

There must be some nuanced part of this that I'm not getting. The jury was brought in and the insurance guy testified as to AW's health rating...?

At least I got to see BW put back in handcuffs and shuffle off to what I hope is a stale sack lunch.

My guess is that none of this health info is allowed yet bc there is no foundation for it yet.

The opening statement by the D's Tipton, mentioning sudden adult death syndrome ;) is not considered evidence or testimony.
I think they have to wait until the D puts somebody on the stand to talk about it ? That then lays the foundation, as the D has opened up the door to allow health info in
IANAL

Tipton also noted that Walshe spent about 21 minutes searching for divorce on the device over the 15 days of data searched by police.

But during a brief redirect examination, Assistant Norfolk District Attorney Anne Yas has Guarino read out a webpage the laptop visited on Jan. 1, 2023.

At 10:30 a.m. on New Year’s Day, Walshe visited a webpage titled, “Your spouse is missing and you want a divorce” on the website Hello Divorce.

Neither prosecutors nor the defense have yet said definitively it was Walshe making the searches on the laptop — only that the device was registered to him and the user of the device searched for those terms. Walshe’s lawyers are not contesting the fact that he made the searches, though, as Tipton mentioned them during his opening statement.

Judge Diane Freniere told the lawyers on Wednesday morning that she intended to give the jury a consciousness of guilt instruction once “it becomes apparent to the jury that the defendant lied to police or the defendant was doing those searches.”
