They are going to throw it out as a form of reasonable doubt. Since there is no body that is their way to say BW didn't kill her and that she died of natural causes. They can't prove it but they can insert it into their defense and the minds of the jury.

Then they will go on to say that BW panicked and did what he needed to do to get rid of her body. They aren't going to deny he bought the cleaning supplies or did the google searches. But they will argue that he is innocent of killing her.

In essence their theory can co-exist within the facts of the prosecution.

I don't believe the jury will go for it but it's the best defense they have.

I'm sorry if this question has been answered, but didn't their house burn down shortly after she went missing? Did they ever determine what caused that? I know this was a long time ago, I'm just wondering if he did it. I feel like that could be explored, but might be unviable due to lack of evidence.

The fire was at a house Ana had previously owned. The fire happened after Ana had sold it. It was deemed accidental.

    • Bag 2: Two white towels with reddish-brown stains
    • Bag 3: White bathrobe with red-brown stains, towel and tissues with red-brown stains
    • Bag 4: Slippers with reddish-brown stains and hair, socks, watch, tissues with red-brown stains, loose hair samples collected

BW did not report Ana missing on Jan 1st, because he made up the work emergency, and/or that she had to return to DC on January 1st. There was no air travel booked to DC or airport rideshare to/from Boston/DC on Jan 1.

Thomas Menino reported Ana missing on Jan 4, because this was the day after Ana was expected to return to work, and the date of her flight reservation from Boston. Corporate Security (Menino) also requested a wellness check on Ana by Cohasset PD on this date.

Convenient or bad luck for BW that Ana died two days early? Liar, liar, pants on fire....

You can't get much lower than making your child lie to cover up murdering the mother of your child. MOO
