Still Missing MA - Ana Walshe, 39, allegedly left home, may have been dismembered, Cohasset, Jan 2023 *husband indicted* #4

His defence sounds a lot like that of Greg Lynn, the Australian pilot charged with killing campers Carol Clay and Russell Hill. "Killing them was accidental, I only hid them miles away, burnt their bodies, and then pulverised their bones because I was afraid I'd look guilty". Yes mate, you do.

This really bothers me, her broken teeth. 😞

When I first read this, I presumed he wondered if he should remove her teeth. He'd already made the decision to dismember her. IMO, there was little evidence at the residence to indicate a violent altercation.

One thing to remember is that Brian is a professional liar -- a talented con man. He's very skilled at telling stories.

He went to boarding school and went on to attend elite colleges in the northeast like Carnegie Mellon and the JFK School of Government at Harvard University. “He took advantage of these very traits to ensnare his victims,” federal prosecutors wrote in their filings about Walshe's federal case involving wire fraud, interstate transportation for a scheme to defraud, and unlawful monetary transaction (selling forged Andy Warhol paintings).

A likeable guy...

At the end of court yesterday, jury not present, the judge was addressing the two prior guilty pea's. I suspect there may be some discussion of that this morning and how it will or won't be presented to the jury.

The judge is not playing around with the defense today.

She's reading into the record her official ruling on some of Ana Walshe's text messages. An exception to the hearsay rule allows a victim's communications to come in as evidence as to "state of mind." It's admissible when there's evidence the defendant is aware of the state of mind at the time of the crime and would be likely to respond to it. The jury only needs to be able to reasonably infer that the defendant was aware. In this case, Brian Walshe told detectives that Ana's imessages come up on his phone and he had seen messages her friends were sending. He told police that Ana sent a photo to William Fastow on New Year's Eve. And he told detectives they could pinpoint the exact time his son went to bed based on the time she texted Fastow. From such evidence it's reasonable to infer he had seen Ana's text exchange and these texts contain evidence of her state of mind such as confusion about married life, her intimate relations with Fastow, and her desire for a future with Fastow.

The judge continues to believe certain of these text messages are not relevant to state of mind and will allow the defense to object during the proceedings and she'll rule in real time.

Fastow, AW's lover, is on the stand this morning. Can't wait for this testimony!

Fastow met Ana through mutual friend Gem when they were trying to purchase a property in DC. He had never met Brian Walshe in person.

He says he and Ana quickly became close friends, then confidantes, then started an intimate relationship. He was separated at the time that this occurred. The prosecutor establishes that a key part of their relationship was fitness as Ana tried to be as active as possible.

He testifies that Ana had done quite a bit to furnish the children's bedrooms and prepare the townhouse in DC for them. She told him that the children were with their father and were there because his home confinement was predicated on Brian being the sole caregiver. She told Fastow that initially she saw this situation as necessary but over time she came to be deeply upset and despondent, troubled about being separated from her children.

They had discussed telling Brian about their relationship. She expressed great concern that he would find out in any way other than directly from her.

Their relationship became more serious around July 2022. She had traveled to Massachusetts for Brian's sentencing and she thought they would all be moving to DC after a favorable sentencing. Prior to this point Ana and Fastow were both seeing other people. But after the sentencing was postponed they became exclusive and began to spend holidays together. They planned a trip to Dublin together for Thanksgiving. After their trip to Dublin, Ana flew on to Serbia to see her mother and he returned to Washington. They also had plans for Christmas Eve. They drove to Annapolis to have dinner with friends. On Christmas morning, it had snowed and her flight was delayed or cancelled. She left because Fastow was going to be taking custody of his own children and beginning his holidays with them. So she ended up driving back to Massachusetts. She later told Fastow that she and Brian had had an argument about this.

She mentioned other stressors in the marriage, the biggest one of which was his inability to resolve his criminal case. "She felt like it was holding up her life."

She was the primary breadwinner and one evening she found in her credit card statement numerous charges Brian had made for sports memorabilia. Ana and Brian had argued about this.

IMO but this guy seems more like AW's speed. Into fitness, his kids (he kept the appropriate boundaries with them), trips, yacht club dinner's. More evolved as a man than her mommy's boy husband. I'd imagine they might have had a future if she had gotten free.

Judge Diane Freniere said she decided that she will be putting off sentencing on the two charges Walshe pleaded guilty to until after the jury reaches a verdict on the first degree murder charge.

I think that was the right decision. Her reasoning made sense to me.

Unknown. The two sides are looking at the redactions of the text messages between AW and WF. I don't think the judge is pleased on behalf of the jury.

How longs this break for?

The judge said something about "using the facilities" before the jury went out but actually I think this break is so the prosecution can show the defense some redactions they have willingly made to the Fastow text messages and the judge can rule on what will be admitted.

Yesterday at the end of court the defense said they wanted ALL the Fastow messages admitted as part of their own strategy to show "context" but this morning before testimony began they reversed course and said they were planning to object to some of them. The judge said she would be allowing some as "state of mind" but would rule on others on the spot. Then the prosecution offered to redact some of them. So the break is for the defense to review those redactions and see if they can agree to proceed in this way.
