Wonder how long we will wait? Honestly, it would not take me long to sift through what is before me to verify there is no evidence whatsoever to negate reasonable doubt.

It would likely take me longer to slog through the jury instructions as a group.

How long was the Dippolito jury out? Like an hour?

I know the judge does this all the time but the jury doesn't. I didn't like the way she rushed through the instructions at such a rapid pace.

What is she doing now?

  • #285
She will be the appellate judge as well.

Huh?? No trial court judge reviews their own case on appeal. That would never happen.

Judge Sanders did take the plea from RB but that doesn't necessarily mean she will be the sentencing judge.

OH. I thought it was the first step in hearing an automatic appeal. Mah Bahd.

ETA got confused by the Murder of Odin Lloyd by Aaron Hernandez.: Judge Garsh presided in his murder trial:

"On January 29, 2015, the trial began in Fall River, Massachusetts with opening statements by prosecuting attorney Patrick Bomberg and defense attorney Michael Fee.[35] Judge E. Susan Garsh presided. The trial was expected to take about ten weeks. The trial was delayed on a few occasions as a result of the unprecedented snowfall in Greater Boston.

In opening statements, prosecutors said Hernandez's DNA was found at the murder scene.[36] On April 9, 2015, a photographer for NBC affiliate WHDH (TV) was banned from reporting and taking pictures at the trial as one of their news trucks had followed the jury van the previous day.

"Aug. 26, 2014 — Bristol County Superior Court Judge E. Susan Garsh throws out evidence from two cell phones and three tablets taken from Hernandez's home during the investigation of Lloyd's death. She says there were problems with the warrant.

Then she presided over the decision to vacate after his suicide:

"The longstanding rule is … abating the entire prosecution as if it never happened," Superior Court Judge E. Susan Garsh said late Tuesday morning (via WBZ TV). "This court is compelled to follow binding precedent."

Judge Susan Garsh: "This court cannot know why Hernandez chose to end his life."

IMO, it won't matter to the jury if she went through the instruction at a rapid pace if they do not believe the case against MM was proven beyond a reasonable doubt.

Now if the jury has to come back with questions about the verdict form, I am going to get worried.

I am afraid of the Manslaughter charge though.

Hi back....

yes, :tyou: Harmony for the tweets! WS is not kicking me out because I don't have "Remember Me" marked - I do... it just freezes up and the tweets would not come out correctly. :dunno:

LaLaw said:
ADA is, of course, is trying to tell the judge what she should do.
Short recess while the judge goes into her chambers and screams into a pillow.

:laughcry: good one! I think we all needed that!!

I'm a half-hour behind from the last post - want me to do some tweets?

That's okay. You might be thinking of certain post-verdict motions that she would hear if there is a conviction but those are not considered appeals and her decisions would always be reviewable by either the Appeals Court or the Supreme Judicial Court.
