RB had legal custody of the baby. The father was unnamed. In a family (when the parents are married to each other), either parent can claim the body because both parents are the next of kin. When there is a divorce one parent is usually granted primary physical custody of the child.. sometimes joint custody is ordered so that decisions are made by both parents. But one parent usually does have primary physical custody. Anyway, in this case, RB has been convicted of nothing and she would have to give consent to have the baby released to JA, i would think.
I find it hard to believe that the body will be buried anytime soon.. and IF JA is found thru DNA to be the dad, the state of Massachusetts will be after his behind for all kinds of back support..I will be willing to wager he wont be giving his DNA anytime soon. MOO

Exactly! We have to remember, RB, is considered innocent until convicted of something in a court of law. IF we all think back a few years, there was this situation in Fla. where a certain female signed over authority/responsibility of her daughter's body to her mother, who did what SHE wanted, not what the "next of kin" wanted!:tantrum:
I also am thinking that JA would be reluctant to provide DNA....for the financial reasons! The other challenge to take over responsibility/authority of the body could come from RB's MOTHER.....IF she wants to get into the fray~:thinking:
