According to what Shapiro said, still no COD. They both want different experts at second autopsy. Why is RB balking at a second autopsy?

https://www.bostonherald.com/news_o...e_lawyers_request_for_second_autopsy_on_bella

Shapiro noted that the medical examiner’s office hasn’t determined a cause and manner of death for the little girl found discarded in a trash bag on the Boston Harbor June 25 by a dog walker.
....

Bond’s lawyer, Janice Bassil, said her client didn’t want a second autopsy because it’s really hard for her but it was necessary to assess her statements to investigators and whether her statements are corroborated by medical evidence.
....
Both Bassil and Shapiro said they will have different experts conduct the autopsy, but Shapiro said he hopes they reach same conclusion.
....
McCarthy’s father and brother left court without commenting.

BBM: IMO she balks because she knows they will not find evidence of "punching" and the defense atty wants to know that so she knows what road to take, i.e.: crazy, abused, etc. in case a murder charge is on the table.

MOO

I agree!

Defense knows that MM defense will be sticking with their already defined narrative. "MM did not know that Bella was baby Doe - he thought she was in CPS custody"

So RB defense will want anything to try to substantiate that things happened as told by RB.

MOO :cow:

RB was acting as if she did not want second autopsy because a mother is not supposed to want her baby subjected to such a thing if it can be avoided. AGAIN, just IMO, she balked not worried they would or would not find something that would hurt her defense, just keeping up appearances.

Here's the duo and Rachelle "keeping up appearances" http://www.necn.com/news/new-englan...in-Court-in-Baby-Bella-Killing-334506591.html

Yes. An autposy is such an indignity for a baby put into a plastic bag and thrown into the water.

And stuffed in a fridge for how long? But I guess she gave her her blanket...

According to RB's lawyer she's been sobbing the whole time so not just about the autopsy. Certainly can't be about any indignity to her child since she admitted to being an accessory after the fact. So that act is transparent and will be to a jury too, IMO. She wasn't sobbing when she was arrested or the night she made one final attempt at manipulating JA spending Family time. She was not sobbing when neighbors saw her smoking on the porch or when she asked for the wi fi.

She likely was not sobbing whenever she received a check from the state for Bella's care. She prolly waved the check at the fridge and yelled Thank you monkeyyyyy! HAHAHA.

jmo sadly though.

I find it strange that they get to wear street clothes to court? What's that about? Whatever happened to prison attire? A blue button down and a gray hoodie? looks like they just came from old navy, not jail.

  • #1,011
I think no city jail attire so as not to prejudice the public into thinking Rachelle and MM are already guilty. Just something I was told when watching CA's trial.

Her lawyer probably told her "hey lady, you need to at least start pretending you are heart broken over the death of your daughter!" Such a good little actress she has become. JMO

So true! She looked very evil in her first court appearance! I was even scared of her through the screen looking at her venomous eyes! :snake:

Lest we forget:

"We don't know how or why she died," Shapiro said after his client's brief appearance today. Without that, Shapiro said, "the prosecution will have a hard time proving its case."

Meanwhile, Bond, who appeared to be wiping at tears today behind the plastic glass that surrounds the prisoner's docket, is "doing the right thing" and staying off drugs behind bars, her attorney Janice Bassil told ABC News.

"It's hard," Bassil said. "Very hard."

Um, staying off drugs behind bars?

I am going to be doing a lot of sitting on my hands once the attorneys start talking in the press if this is any idea of Ms. Bassil's future approach to humanizing her client.

I have an idea! Ms. Bassil should sit down with Rachelle and explain to her that the first autopsy of little Bella's body did not match with her description of how Bella died. She should encourage Rachelle to tell the TRUTH about what happened to Bella and how she was really killed. I think she should tell Rachelle she is no longer considered an accessory after the fact and is more than likely looking at being charged as killing her daughter along with McCarthy. Ms. Bassil should encourage Rachelle to confess as truthfully as her little heroin-fogged brain can remember for Bella's sake. I don't know why this lawyer is pussyfooting around with Rachelle. She certainly didn't give poor little Bella any such consideration locking her in the closet for hours at a time and screaming at her all the time. Bella was a human being too. I hate that it's not even about Bella anymore, but more about the scum who claimed to be her mother!

Oh, and so good to hear that she's staying off drugs while she's in jail. Maybe Ms. Bassil could give her like a little award statue or something. :gaah:

Hmm, I didn't know there was the option of LEGALLY being 'on (illegal) drugs' in jail.

MOO- I do believe it's hard for her now- hard to act like a victim, hard to go without a smoke outside, hard to not shoot up, hard to push those fake tears out for display. but that's ALL that is hard for her. The thought of another autopsy on Bella, if it would prove that MM really did murder her as RB says, one would think as a mother who cares would want absolute proof so that her child's murderer would be locked up for good and justice be served.
This whole thing makes me so sick. I'm so afraid without a solid COD it's gonna bring up reasonable doubt. Ugh

Lawyers for the mother and her ex-boyfriend charged in the death of Bella Bond — the
cherubic 2-year-old dubbed “Baby Doe” whose body was found in June stuffed in a trash bag on Deer Island — have hired two former New England medical examiners with experience testifying at murder trials to conduct
independent autopsies.

Former Bay State medical examiner Jennifer Lipman has been retained by attorney Jonathan Shapiro, whose client, Michael McCarthy, 35, is charged with Bella’s murder.

Janice Bassil, the attorney for Bella’s mother Rachelle Bond, 40, who is facing an accessory charge, has secured Elizabeth LaPosata, a former Rhode Island medical examiner. LaPosata was a defense witness in 2011 when she testified in the manslaughter case of Mark Kerrigan, brother of Olympic skater Nancy Kerrigan.

The independent autopsies are expected to be performed before Nov. 19.

“Our pathologist is confident that she’ll be able to review the remains at the present time and hopefully reach a conclusion,” Shapiro said.

...

Authorities believe McCarthy killed Bella in late May by either hitting her or applying pressure to her abdomen. Bella Bond’s death has been ruled a
homicide by the state medical examiner, said Suffolk District Attorney spokesman Jake Wark. When asked if the state medical examiner will be able to determine how Bella was killed, Wark said, “Yes.”

So the medical examiner could not find cause of death but these two new medical examiners can??
I understand second opinions but why would their findings be any different?
