Pfftttt....the evidence speaks for itself, confession or no. JMO

Confession of teen, 16, who 'raped his math teacher and slashed her throat before dragging her body into woods' cannot be used at trial because cops ‘coerced’ it from him

I was about to post this but you beat me to it :)
Just..oh, brother ! *rolling eyes*
My personal opinion is that the police know how to ask certain questions to get a truthful answer. It's not like they tied Chism up and beat it out of him ; fgs !!
There's hopefully plenty of evidence to convict , regardless. I shudder to think of this monster being set free someday-- to roam and stalk, and maybe worse.
Most of all there needs to be proper justice for a young lady whose life was brutally torn from her.

It doesnt sound like the judge is buying the defense arguments on most of this. I really would not want to be on the defense team. They don't have a lot to work with, they have to walk a fine line here (hopefully they stay on the right side) and they have a young, but very VERY dangerous client.

This case is horrible, and I don't know if I can actively follow it. I feel like I have PTSD from the stabby arias trial!

I don't know specifically the sequence of events regarding his confession, but my I find it hard to believe he wasn't properly informed of his rights. But maybe not :gaah:

Regardless, the following from the judge blows my mind....

BBM
The judge ruled that it was "readily apparent" that Chism's mother wanted an attorney to be present before he was questioned and allegedly confessed to the killing. The judge also was not convinced that Chism was paying attention when he was read his Miranda rights, NECN reported.

What the heck???

Yes, by all means, let's protect the criminal !!!! :banghead: :tantrum:
If Chism is ever set free, other people's lives may be in danger. They must not let him out of prison.

I was under the impression that it wasnt a stick but a tree limb that was used to assault her sexually post mortem.? Anyone else remember that being the case?

Sent from my SCH-I605 using Tapatalk

A stick or branch is synonymous to a small tree limb, east2west.
_________

The appeals court Judge's ruling is very disheartning....

In fact he is continuing that dangerous behavior - same M.O.- while in custody!:

Philip Chism arraigned for alleged assault on state worker

"He waited until he was sure no one was watching, then followed the young woman to the bathroom, prosecutors said. When she came out, she was face to face with the tall, lanky teenager, who immediately attacked.

Philip Chism grabbed the woman by the throat, stabbed her with a pencil, and punched her repeatedly in the face and head, prosecutors said.

In its planning and execution, the June 2 assault was frighteningly similar to the October 2013 rape and slaying of 24-year-old Colleen Ritzer in a bathroom in Danvers High"

If he gets off, the judge who made that ruling should offer him a room at his/her home.

No doubt in my mind, if able, he will kill his mother. JMO

I am not sure why the cell phone evidence would be excluded. Certainly the police would have gotten that info without the confession. And why would the evidence from Coleen' s phone be excluded? The confession I inderstand why it was excluded now. But I think it's irrelevant anyway.

I suspect it's only a matter of when, not if, this kid kills again.

"During a status conference in the case Thursday morning in Salem Superior Court, lawyer Denise Regan said she will file a motion asking for a change of venue in the high-profile case.
A hearing on that request is now scheduled for July 6. Regan hasn't yet filed that motion, but is expected to argue that the significant publicity the case has received locally will make it impossible to find an impartial jury in Essex County"

"The taxpayer-funded lawyers defending a troubled teen against charges he raped and murdered his math teacher at Danvers High are asking for his case to be tried in western Massachusetts, arguing in a new court filing that Philip Chism’s chances for a fair trial on the North Shore — or even Greater Boston — have “been poisoned by extensive pretrial publicity ...”

'Justice has been poisoned': Stoney faced teen 'who raped and slashed teacher's throat' listens as lawyers demand his trial be moved because of local sympathy for his victim

Philip Chism, 16, is accused of brutally killing Colleen Ritzer, 24, in 2013

She was attacked in bathroom at Danvers High School, Massachusetts

Teenager then dragged her body into the woods in a barrel, police say

Attorneys say the right to a fair trial has been 'poisoned' by news coverage

They are also wary a number of residents know he 'confessed' to the crime

Because I am sure people in western Massachusetts don't have access to news? Seriously most change in venue attempts are either attempts at jury shopping or delay. This is mostly for delay because I don't really see the jury pool being any different.

"Defense lawyers for a teenager accused of raping and murdering his Danvers High School math teacher have dropped their bid to have one of the two sexual assault charges against him thrown out.

The request from Philip D. Chism’s defense team to dismiss one of the aggravated rape charges was withdrawn Wednesday, according to the office of Essex District Attorney Jonathan W. Blodgett."

Jury selection starts Wed. The defense plans to use "mental defect and his youth". The pros will show video of Chism wearing a hoodie and gloves as he followed Colleen into the bathroom.

In the videotaped interview, Chism told police Ritzer provoked the attack with a "trigger" word, which he would not disclose.

"After she insulted me, that's when I became the teacher," Chism said, according to a description Lowy gave in his written ruling.

How sickening, he became the "teacher".

  • #739
Does anyone know if there's going to be live coverage anywhere?

  • #740
News coverage, the pros can't bring up his confession because he was 14 and didn't understand. So the jury will never hear how he became "the teacher".

Prosecutors are expected to present that evidence at trial, along with some statements Chism made to Topsfield police, but not his taped confession at the Danvers police station.

I don't see anything about the trial being broadcast, so I am unsure.
