It's good this came up now. Have him evaluated to determine competency and have expert testimony about the manipulation. The judge can then pre-determine what to do if Chism pulls this again during the trial. If Chism truly incompetent then the judge can hold the trial until he is competent.

Funny how he wasn't so anxious when he attacked Colleen in the bathroom and then went to a movie after he killed her. And he was able to stalk and attack a staff at whatever facility he was at when that happened. Now that he's being confronted with his actions, he is too scared to face the music. I'm just glad these games are being played now, rather than after the trial has already started.

He will do whatever it takes to escape justice and minimize his sentence, enabling him to prey on another unsuspecting innocent victim. Hopefully the judge will see through this ruse and make the proper rulings..

It sounds alot like the spider bite Michael Jackson pulled and the migraines Jodi Arias would pull to try to delay their criminal trials...They should drag him into court in chains, and shackles- even if they have to wheel him in like Elizabeth Smart's kidnapper.

I agree with your opinion. As maddening and frustrating this delay is, it's better than giving the defense grounds for appeal later on if the evaluation is not done now.

Nevertheless, who can guarantee that he won't pull a different stunt during trial even if evaluated now? He will never be cooperative and will likely find other ways to interrupt and delay proceedings. moo

Dragging him by his arm causes dangerous injuries including dislocation. I and 3 other people called 911 on a woman who dragged her child through the mall and proceeded to toss him by the arm up into her truck in the parking lot and I will do it again. When my child had a tantrum inside a store and I could not quiet her I scooped her up into both my arms and carried her screaming out to the car, with my bad back and all, leaving the stroller behind.

But I understand that this seems like just a tantrum, however I, on the other hand, feel that it is a badly orchestrated performance by the defense since he had no melt down when he was confronted, arrested and then questioned about "the girl" when he proclaimed that he "became the teacher". His arrogance and self righteousness will be a key part of the prosecution's case, IMO.

Personally I think the defense was slow on the draw. They should have thought of this charade long before he presented himself as highly competent with no melt downs or head banging. OH and so soon after they announced that they would use a mental health defense?

Trial in limbo as Chism is evaluated

After initially hoping to avoid it, a Salem Superior Court judge decided Thursday to send Philip Chism to a hospital for a competency evaluation that a Department of Mental Health doctor told him could take as long as 40 days.



Judge David Lowy acknowledged that proceeding with a trial while there are unanswered questions about the teenager’s mental competency would lead to a reversal of any conviction in the case “in about two sentences.”

“It would have been an error of the court of Constitutional dimensions,” said Lowy. “The integrity of the trial would have been in question.”
