ADA now resumes Kastor questions about DNA testing

Jill Harmacinski ‏@EagleTribJill 1m1 minute ago
Four different population databases are used during DNA testing Kastor says

allison manningVerified account ‏@allymanning 1m1 minute ago
Kastor: 99.8 percent of the African American population (99.4% Caucasian pop) "excluded" from having this DNA profile.

Jill Harmacinski ‏@EagleTribJill 2m2 minutes ago
Kastor says she received 8 items in this case for DNA testing

allison manningVerified account ‏@allymanning 2m2 minutes ago
She also tested the red brown stain on #PhilipChism's left palm. There was more than one contributor, she says.

Jill Harmacinski ‏@EagleTribJill 1m1 minute ago
Kastor says "major profile" found on left palm of #PhilipChism

Bob Ward Fox25Verified account ‏@Bward3 2m2 minutes ago
Kastor: Red brown stain on #PhilipChism left hand, contained 2 DNA profiles. Same on bathroom wall at DHS

Bob Ward Fox25Verified account ‏@Bward3 2m2 minutes ago
Kastor: Major DNA profile matched Colleen Ritzer on #PhilipChism hand and on bathroom wall.

Jill Harmacinski ‏@EagleTribJill 40s40 seconds ago
Kastor also tested for DNA on underpants, box cutter, branch, jeans and toilet paper roll

Jill Harmacinski ‏@EagleTribJill 1m1 minute ago
Ritzer DNA was on all those items Kastor testifies

Julie Manganis ‏@SNJulieManganis 46s47 seconds ago
While it may seem pointless given #PhilipChism lawyer's admission he did it, the DA still legally obligated to prove the murder charge.

DNA analyst Kastor is done. Now, defense attorney Denise Regan on cross.

allison manningVerified account ‏@allymanning 58s59 seconds ago
Regan questioning statistic of commonness of DNA profile found on sperm cell from swab. 1 in 521 Af-Am men.

allison manningVerified account ‏@allymanning 1m1 minute ago
Regan: "This statistic is nowhere near as precise as the statistic you gave us of the DNA testing you did on the other items?"

Is the defense trying to say that someone else raped Ritzer? If I was on the jury I wouldn't be believing that argument.

Bob Ward Fox25Verified account ‏@Bward3 1m1 minute ago
Regan, trying to say if 60,000 people in Gillette Stadium, several African American men could share DNA profile.

Julie Manganis ‏@SNJulieManganis 2m2 minutes ago
The defense seems to be calling into question the rape count from the bathroom.

Bob Ward Fox25Verified account ‏@Bward3 49s50 seconds ago
Kastor: 99.8% of African American, 99.91% Asian, 99.4 Caucasian, 99.78 % Hispanic excluded from same DNA profile as #PhilipChism

Next up: Sarah Giaquenta, Danvers High teacher. She was the focus of some of the motion discussion last week between attorneys.

Bob Ward Fox25Verified account ‏@Bward3 1m1 minute ago
Giaquienta is Danvers High School math teacher. Married to Andrew who also testified.

Jill Harmacinski ‏@EagleTribJill 51s51 seconds ago
Says she saw Ritzer quite a few times during school day. Gianquinta hubby testified last week about search for Ritzer

Bob Ward Fox25Verified account ‏@Bward3 1m1 minute ago
Giaquienta's classroom was Rm 222 on day of murder. Was down the hall from Colleen Ritzer's.

Bob Ward Fox25Verified account ‏@Bward3 51s52 seconds ago
Giaquienta: Dressed the same as Colleen Ritzer on day of murder. It was high school spirit week

Bob Ward Fox25Verified account ‏@Bward3 51s52 seconds ago
Giaquienta: After meeting, went to Colleen's class to talk to her. Two students were there. one female, one male.

Bob Ward Fox25Verified account ‏@Bward3 49s50 seconds ago
Giaquienta: Spoke to Colleen for 10 minutes in another classroom. Then headed to her classroom.

Bob Ward Fox25Verified account ‏@Bward3 1m1 minute ago
Giaquienta: I asked if Colleen needed to get back to her room. Colleen mentioned the female student

Jill Harmacinski ‏@EagleTribJill 1m1 minute ago
Regan is objecting to Gianquinta testimony. ADA asked what Ritzer said about #PhilipChism being in classroom

  • #105
allison manningVerified account ‏@allymanning 1m1 minute ago
Ritzer said of the girl student (who we already heard from) that no, the girl was just drawing on her whiteboard.

Victoria WarrenVerified account ‏@vwarrenon7 53s53 seconds ago
Giaquinta: on day of murder Colleen told her she didn't know why #PhilipChism was in her classroom after school.

Bob Ward Fox25Verified account ‏@Bward3 1m1 minute ago
Giaquienta: We talked about ordinary, every day things

Bob Ward Fox25Verified account ‏@Bward3 2m2 minutes ago
Giaquienta:My car broke down, I didn't have car. Sometimes Colleen give me a ride home.

allison manningVerified account ‏@allymanning 1m1 minute ago
Colleen had been giving Giaquinta rides home. She offered to give her a ride that day, but GIaquinta didn't need it.

Victoria WarrenVerified account ‏@vwarrenon7 2m2 minutes ago
Giaquinta's testimony contradicts student who took stand saying Colleen asked #PhilipChism to stay. Prosecutor trying to show premeditation.

Bob Ward Fox25Verified account ‏@Bward3 2m2 minutes ago
We are now seeing video of Colleen Ritzer and Giaquienta in hallway of DHS shortly before murder.

Bob Ward Fox25Verified account ‏@Bward3 1m1 minute ago
Prosecutor: as you spoke you notice an abrasions to Colleen's face or chin?Giaquienta no.

allison manningVerified account ‏@allymanning 1m1 minute ago
Giaquinta is dabbing her eyes as she watches the last conversation she had with one of her closest school friends.

Laurel J. SweetVerified account ‏@Laurel_Sweet 1m1 minute ago
We see video, sans sound, if Ritzer and Giaquinta in their final conversation, laughing, so full of life. Look like twins.

Bob Ward Fox25Verified account ‏@Bward3 2m2 minutes ago
The rape and murder of Colleen Ritzer took place minutes after this DHS hallway conversation.

Jill Harmacinski ‏@EagleTribJill 55s55 seconds ago
Gianquinta says she never heard from Ritzer later that day. But she got a call from her mom

Bob Ward Fox25Verified account ‏@Bward3 1m1 minute ago
Later, Colleen's mother contacted Giaquienta b/c Colleen didn't come home. Went to DHS to see if her car was there.

Bob Ward Fox25Verified account ‏@Bward3 1m1 minute ago
Giaquienta: Saw video of man entering bathroom. It was #PhilipChism, same person I saw in classroom that day.

Bob Ward Fox25Verified account ‏@Bward3 1m1 minute ago
Colleen's mother just left the courtroom.

allison manningVerified account ‏@allymanning 1m1 minute ago
Gianquinta is done. No cross from defense.

Next witness: Dr. Anna McDonald. She is a forensic pathologist.

Bob Ward Fox25Verified account ‏@Bward3 56s56 seconds ago
Dr. McDonald was working in Boston Office of State Medical Examiners office at time of Ritzer murder

Jill Harmacinski ‏@EagleTribJill 1m1 minute ago
Warning: McDonald may be providing graphic testimony regarding autopsy

Victoria WarrenVerified account ‏@vwarrenon7 58s58 seconds ago
Dr McDonald worked for the medical examiner and did the autopsy on Colleen Ritzer.

Bob Ward Fox25Verified account ‏@Bward3 40s40 seconds ago
Colleen Ritzer's mother has returned to listen to evidence of autopsy now.

Jill Harmacinski ‏@EagleTribJill 1m1 minute ago
She started with external exam, Ritzer was partially clothed when she arrived

allison manningVerified account ‏@allymanning 40s40 seconds ago
The long-sleeved purple shirt we just saw Ritzer wearing in the video is now entered into evidence.

allison manningVerified account ‏@allymanning 1m1 minute ago
Now, the white tank top she was wearing. It's covered in dried blood

allison manningVerified account ‏@allymanning 1m1 minute ago
Her shirts were pulled above her chest, while the cups of her bra were pulled down, exposing her breasts.

Bob Ward Fox25Verified account ‏@Bward3 2m2 minutes ago
Dr. McDonald: Colleen's body was intact, covered with organic debris: leaves, dirt. Her body was cleaned for exam

Bob Ward Fox25Verified account ‏@Bward3 1m1 minute ago
Dr. McDonald: Ritzer had abrasion on jaw. contusion above left breast, and upper abdomen.

Jill Harmacinski ‏@EagleTribJill 59s59 seconds ago
Her head and face had small pinpoint hemorrhages, on her face and eyes

M-E says bruising (red dots) on face are indicative of asphyxia.

Bob Ward Fox25Verified account ‏@Bward3 2m2 minutes ago
Dr. McDonald: its caused when veins collapse in neck.

Bob Ward Fox25Verified account ‏@Bward3 49s50 seconds ago
Dr. McDonald; Colleen's neck was obscured by sharp force injury, difficult to look for hemorrhaging/asphyxia evidence.

Bob Ward Fox25Verified account ‏@Bward3 1m1 minute ago
Dr. McDonald: Colleen's neck had 12 stab wounds. 4 incise wounds, longer on surface than deep.

Laurel J. SweetVerified account ‏@Laurel_Sweet 1m1 minute ago
Ritzer's neck had been stabbed and slashed 16 times

Jill Harmacinski ‏@EagleTribJill 2m2 minutes ago
Going up on projection screen, a diagram the ME made of Ritzer neck wounds

Bob Ward Fox25Verified account ‏@Bward3 1m1 minute ago
Most stab wound are on left side of Ritzer neck.

Jurors still have a tour to take Wednesday of Danvers High and pertinent crime scenes.

allison manningVerified account ‏@allymanning 47s47 seconds ago
Dr. McDonald is expected to be the last prosecution witness. That'll be 36 witnesses for them over seven days.

Bob Ward Fox25Verified account ‏@Bward3 51s52 seconds ago
Dr. McDonald is state's last witness before resting. Defense will not begin calling witnesses today

Bob Ward Fox25Verified account ‏@Bward3 58s58 seconds ago
DHS will be releasing students 11:15AM Wednesday for jury view in #PhilipChism trial.

Jill Harmacinski ‏@EagleTribJill 1m1 minute ago
Dr McDonald coming back on stand

allison manningVerified account ‏@allymanning 49s49 seconds ago
Back with diagram. 13 wounds wouldn't have killed Ritzer, prosecutor says, but would they have caused pain? Yes, doctor says.

Bob Ward Fox25Verified account ‏@Bward3 1m1 minute ago
Dr. McDonald: Colleen was stabbed on right side of neck 3 times. Two stabs struck her jugular vein.

Jill Harmacinski ‏@EagleTribJill 2m2 minutes ago
ADA asking McDonald about various wounds Ritzer sufferer and blood flow in those areas

Bob Ward Fox25Verified account ‏@Bward3 1m1 minute ago
Dr. McDonald: Now discussing blood loss and spray from stab wounds to jugular vein.

allison manningVerified account ‏@allymanning 1m1 minute ago
Two stab wounds punctured her internal jugular vein. A lethal injury.

Bob Ward Fox25Verified account ‏@Bward3 2m2 minutes ago
Dr. McDonald Now being directed to larger neck wound from Colleen's throat to left side of neck in V shape.

Bob Ward Fox25Verified account ‏@Bward3 37s37 seconds ago
Dr. McDonald: it cut across Adam's apple, trachea, esophagus, and stopped after hitting backbone of vertebrate

Bob Ward Fox25Verified account ‏@Bward3 2m2 minutes ago
Dr. McDonald: No way of determining which injury came first, the asphyxiation or the stab wounds.

Bob Ward Fox25Verified account ‏@Bward3 2m2 minutes ago
Dr. McDonald identies picture of left side of Colleen Ritzer's face and neck.

Julie Manganis ‏@SNJulieManganis 1m1 minute ago
The da submits photos but they haven't been shown to jurors.

Bob Ward Fox25Verified account ‏@Bward3 54s54 seconds ago
Now Dr. McDonald is being directed to genital injuries to Colleen Ritzer

Laurel J. SweetVerified account ‏@Laurel_Sweet 2m2 minutes ago
Ritzer suffered a large tear of her internal vagina "during the dying process" that McDonald said was visible externally.

Doctor said the genital injury could be immediately before, just after, or during the dying process. Based on the hemorrhage in the tissues it was at the point of death.

Laurel J. SweetVerified account ‏@Laurel_Sweet 55s56 seconds ago
McDonald testifies, "It is impossible to know" whether Ritzer, 24, was still alive when she was raped and buried in woods by #PhilipChism.

Maria CramerVerified account ‏@GlobeMCramer 48s48 seconds ago
"Her cause of death was short force injuries of the neck and asphyxia by strangulation," McDonald testifies.

Jill Harmacinski ‏@EagleTribJill 2m2 minutes ago
"Only on TV would they essentially do that for you." -McDonald when asked how long injuries took to inflict

Bob Ward Fox25Verified account ‏@Bward3 2m2 minutes ago
Dr. McDonald. Other than those injuries Colleen Ritzer was a healthy 24 year old woman.

Julie Manganis ‏@SNJulieManganis 1m1 minute ago
The defense will likely argue that if Ritzer was already dead when she was violated with the stick it's not rape.

  • #111
I cannot even imagine how her family feels in the courtroom today. My thoughts are with them.

Jill Harmacinski ‏@EagleTribJill 2m2 minutes ago
#PhilipChism defense John Osler on cross of McDonald who says she doesn't know if Ritzer was cut or strangled first

Julie Manganis ‏@SNJulieManganis 2m2 minutes ago
Osler is questioning dr. now. He's asking her about the possibility that she died from asphyxiation before knife attack.

Jill Harmacinski ‏@EagleTribJill 1m1 minute ago
Osler is using animated body language to ask questions about asphyxia and blood

Jill Harmacinski ‏@EagleTribJill 2m2 minutes ago
Osler puts MEs diagram back up on courtroom projection screen

Bob Ward Fox25Verified account ‏@Bward3 3m3 minutes ago
Defense trying to make point that small red dots on Colleen's face suggest she was strangled first, stabbed in death

Christina Hager ‏@HagerWBZ 1m1 minute ago
Pathologist in #PhilipChism trial can't give 1 clear cause of death. It's a "hybrid" of "sharp force injury in neck" and "asphyxiation".

Bob Ward Fox25Verified account ‏@Bward3 1m1 minute ago
Def: how long would it take for person to bleed out w/injury to jugular?Dr. McDonald: greater than minutes.

Jill Harmacinski ‏@EagleTribJill 2m2 minutes ago
He asked 40 minutes ? She says its a possibility.

Rupa Shenoy ‏@RupaShenoy 1m1 minute ago Salem, MA
Defense questions to McDonald seem focused on establishing in what sequence injuries occurred.

allison manningVerified account ‏@allymanning 2m2 minutes ago
Osler questioning how long it would take to bleed out for each of the different neck injuries. Minutes, the doctor says.

Bob Ward Fox25Verified account ‏@Bward3 1m1 minute ago
Def: if all three major vessels in neck are cut, cause quicker death? Dr. McDonald that is true.

Ethan Hartley ‏@Ehartley_DH_BC 1m1 minute ago Salem, MA
Osler crossing. Arguing that three main blood vessels being severed would cause an accelerated death with lots of bleeding

Now I understand Osler's earlier questions about blood in the woods. He is trying to prove that Ritzer was already dead when raped by the stick. That is not regarded as rape legally if the person is dead.

  • #113
Julie Manganis ‏@SNJulieManganis 4m4 minutes ago
Defense is trying to show that Ritzer was dead quickly, did not consciously suffer and was not alive when violated in woods.

Julie Manganis ‏@SNJulieManganis 3m3 minutes ago
Osler suggests that blood in the body would still move within body after death.

Maria CramerVerified account ‏@GlobeMCramer 6m6 minutes ago
Defense is trying to establish that Colleen Ritzer died quickly and undermine theory that Chism showed "extreme atrocity/cruelty."

allison manningVerified account ‏@allymanning 3m3 minutes ago
Osler: Could there be more blood from moving the body after death? Putting pressure on body? Laying on body? Yes, dr. says.

Jill Harmacinski ‏@EagleTribJill 4m4 minutes ago
McDonald says she found no ligature marks on Ritzer

Jill Harmacinski ‏@EagleTribJill 3m3 minutes ago
Contusions on her body could indicate someone knelt on her body. "that is a possibility," McDonald

Julie Manganis ‏@SNJulieManganis 3m3 minutes ago
Defense suggests the red dots or petechia on Ritzer could be caused by someone sitting on her.

Maria CramerVerified account ‏@GlobeMCramer 1m1 minute ago
Photos of Colleen Ritz'ers bloody shirt and bra are shown overhead. Her mother keeps her head down. #PhilipChism looks at the screen.

Rupa Shenoy ‏@RupaShenoy 1m1 minute ago Salem, MA
Defense showing pictures of Ritzer's clothes - points out most blood staining is on the back of her undershirt and shirt.

Rupa Shenoy ‏@RupaShenoy 57s57 seconds ago Salem, MA
Defense asks if Ritzer could have been lying on her back when attacked with knife, McDonald says that's one interpretation.

Jill Harmacinski ‏@EagleTribJill 1m1 minute ago
Ritzer position when stabbed is not something she is able to tell by autopsy McDonald says

Bob Ward Fox25Verified account ‏@Bward3 1m1 minute ago
Dr. McDonald: Cant tell victim's position during attack based on blood on her clothes.

Jill Harmacinski ‏@EagleTribJill 3m3 minutes ago
Osler asking if she thought she was lying on her back or standing when stabbed

  • #114
Bob Ward Fox25Verified account ‏@Bward3 55s55 seconds ago
Most of stab wounds are on left side of Ritzer neck, close together. Defense trying to say she was not moving at time.

Julie Manganis ‏@SNJulieManganis 1m1 minute ago
Osler points to cluster of wounds in same area and suggests the victim was not moving, not struggling.

Bob Ward Fox25Verified account ‏@Bward3 1m1 minute ago
Dr. McDonald: it's not inconsistent with idea victim was not moving when stabbed on left of her neck.

Julie Manganis ‏@SNJulieManganis 43s44 seconds ago
If Ritzer not dead she was unconscious, defense suggests.

Rupa Shenoy ‏@RupaShenoy 1m1 minute ago Salem, MA
Defense asks whether it's possible Ritzer was immobile when neck wounds inflicted. McDonald says that is "not inconsistent."

Jill Harmacinski ‏@EagleTribJill 2m2 minutes ago
Osler asking about fingernail clippings she took at autopsy

Jill Harmacinski ‏@EagleTribJill 1m1 minute ago
ADA objects to where the clippings would show resistance. Lowy sustains the objection

Julie Manganis ‏@SNJulieManganis 47s47 seconds ago
The DA objects to questions because it's not the medical examiner who typically tests those.

allison manningVerified account ‏@allymanning 1m1 minute ago
It took Dr. McDonald about 5 hours to complete the autopsy.

Jill Harmacinski ‏@EagleTribJill 1m1 minute ago
Troopers there for autopsy, a technician, a pathologist also. She had been to crime scenes also, bathroom and woods

Jill Harmacinski ‏@EagleTribJill 52s52 seconds ago
McDonald says she did not see surveillance video: she had a word document that showed various times from various cameras

I only just started following this case. I'm confused at what the defense is trying to do. Obviously he's guilty. Are they angling for a shorter sentence or something? I don't get it. My knowledge of court cases and the law is basically nonexistent.

Osler asking about tree branch found with Ritzer body

allison manningVerified account ‏@allymanning 1m1 minute ago
Osler: Would victim be alive 30 minutes after stabbings, when the tree branch was inserted? Doctor: Unlikely. But not sure.

Laurel J. SweetVerified account ‏@Laurel_Sweet 55s55 seconds ago
Defense presses McDonald to say Ritzer was dead when attacked in the woods with tree branch. She won't do it.

Julie Manganis ‏@SNJulieManganis 49s49 seconds ago
The medical examiner says death could have taken up to 40 minutes

Laurel J. SweetVerified account ‏@Laurel_Sweet 1m1 minute ago
McDonald says Ritzer was most surely "incapacitated and certainly not conscious."

Jill Harmacinski ‏@EagleTribJill 3m3 minutes ago
Holding her stomach #PhilipChism mom leaves courtroom

Jill Harmacinski ‏@EagleTribJill 59s60 seconds ago
She says it's reasonable to assume Ritzer was dead when attacked with tree branch in woods

Based on a hypothetical that all neck injuries occurred 37 minutes before put in woods ME says it is reasonable to assume Ritzer was dead when stick used.

Julie Manganis ‏@SNJulieManganis 3m3 minutes ago
She concedes Ritzer "may have already been dead" when taken to woods.

Julie Manganis ‏@SNJulieManganis 2m2 minutes ago
In Massachusetts it is not rape if the penetration occurs after death.

Bob Ward Fox25Verified account ‏@Bward3 2m2 minutes ago
def: if death occured before laceration, there could still be red blood cells in genitalsDr. McDonald absolutely.

Maria CramerVerified account ‏@GlobeMCramer 1m1 minute ago
Colleen Ritzer's family has stayed throughout this testimony. Mother of #PhilipChism left.

Bob Ward Fox25Verified account ‏@Bward3 2m2 minutes ago
Cross examination of Dr. McDonald is finished. Redirect now. Chism mother returns to courtoom.

I only just started following this case. I'm confused at what the defense is trying to do. Obviously he's guilty. Are they angling for a shorter sentence or something? I don't get it. My knowledge of court cases and the law is basically nonexistent.

To be found guilty, the State must prove each element of each charge that Chism has been charged with, so that a person on the jury could find beyond a reasonable doubt that Chism is guilty. So, for example, Chism cannot be found guilty of rape if the State does not provide sufficient evidence for the jury to find that the rape occurred. They have to go through this process with each and every charge, and the defense is going to cast doubt on certain elements in an effort to argue that the State did not meet its burden of proof.

I've followed this tragic case since the story broke and IMO the evidence has been significant. I'm hoping AnaTeresa will consider chiming in here. I can't imagine what purpose it serves the defense to put the victim's family though all of this

It is beyond difficult just reading the recount over social media as an unrelated party. What this is doing to those that knew and love her must be just beyond the pale. My heart breaks for them.
