What jacct is posting tweets about is a Rule 29 motion. I have posted about it upthread in more detail, but the basic idea is that if the State has not proven each element of the each offense charged, the judge may acquit the defendant of that charge (this would of course lessen a potential sentence). Rule 29 motions are rarely granted, but are a matter of procedure. Tactically, what the defense is trying to do is argue that the State did not adequately prove Colleen's time of death, which would impact some of the charges against Chism. Rule 29 motions are a routine matter of course and will be made after the State's case, and again at the end of trial before closing arguments.

From what I've seen on the tweets (I'm unable to watch live), I think the judge will likely pass the charges on for the jury to decide. A Rule 29 motion has a low bar. The judge does not have to decide whether the evidence presented is beyond a reasonable doubt, but merely whether reasonable doubt may exist with regard to the evidence. To me, it sounds like the State has proved its case, and since Rule 29 motions are rarely granted, I would guess the judge will deny on the rape count tomorrow as well. :twocents:

This is why the defense is arguing for the unnatural rape (stick in woods) and robbery be thrown out. The Murder with extreme atrocity or cruelty includes the unnatural rape. The Murder during a felony includes the robbery.

If the defense can convince the judge to throw out the unnatural rape because it occurred after death (not a rape per MA law), or because it wasn't part of the murder (done 27 minutes after the initial attack) than the extreme atrocity or cruelty charge will have to be dropped.

The defense tried to argue that the felony robbery wasn't against a person because Chism didn't take the credit cards and other items directly from Ritzer, but from her room after he attacked her. The judge didn't accept that and already ruled that the robbery charge will stand so there are at least 2 murder charges for the jury to consider.

To be found guilty, the State must prove each element of each charge that Chism has been charged with, so that a person on the jury could find beyond a reasonable doubt that Chism is guilty. So, for example, Chism cannot be found guilty of rape if the State does not provide sufficient evidence for the jury to find that the rape occurred. They have to go through this process with each and every charge, and the defense is going to cast doubt on certain elements in an effort to argue that the State did not meet its burden of proof.

So if by chance the jury finds him not guilty of rape...that doesn't mean anything to the murder charge, correct? (I'm actually not 100% sure on all of his charges. I need to find those.)

I'd have to see the exact wording of the charges. Likely not, because it sounds like he has been charged in the alternative, so even if they fail at proving the rape (extreme atrocity or cruelty), the State still has the option of premeditation under the statute.

Lowy will announce his decision today, when Chism’s lawyers will begin his insanity defense.

“This was a sexually motivated homicide and he didn’t get to finish what he started in the bathroom, so he finished it in the woods,” Essex Assistant District 
Attorney Kate MacDougall argued to Salem Superior Court Judge David A. Lowy.
Prosecutors believe Chism 
was in the process of 
assaulting Colleen Ritzer in a bathroom at Danvers
 High on Oct. 22, 2013, 
when he was “interrupted” by another student who 
briefly opened the door 
before leaving.

In addition to first-
degree murder, Chism faces two counts of aggravated rape, both of which carry the possibility of life sentences if he’s convicted. That’s important to prosecutors because under the state’s new juvenile sentencing law, Chism, if convicted of murder, would be eligible for parole in as soon as 15 years. Lowy, however, could choose to punish him with consecutive rather than concurrent sentences, if jurors convict him of rape as well.

Lowy will announce his decision today, when Chism’s lawyers will begin his insanity defense.
