It's going to be difficult for the Defense to navigate this, in my opinion. They want it both ways, but they have to be very careful not to open the door by bringing up certain evidence that's currently inadmissible. Under the rules of evidence, if the Defense introduces some types of evidence that reflect poorly on the defendant, that opens the door for the State to have a free for all with it. Basically, there are no take-backs. If part comes in, all comes in. ETA: Plus, there's the inadmissible evidence which could potentially cause a mistrial. It's a real minefield.

I'm going only off of tweets, but I really don't understand the Defense tactics right now. :twocents:

What is the point of this doctor? Why does it matter if this guy had a psychotic episode or whatever THIS year? If I were on the jury, I don't really think I'd find that relevant to his state of mind in 2013.

This is the same Dr. Gur that testified in the Holmes trial. In Holmes she did not speak with him, just reviewed reports from other Dr.s and gave her opinion of his mental state at the time of the murder. She came across to me as a "hired gun" for the defense. Very combative and arrogant with the prosecution, willfully ignoring evidence that did not support her opinion.

It would have worked if only the pesky prosecution hadn't pointed out that this episode happened at the beginning of trial and was brought on by trial stress. I think the defense felt they had to bring the Dr. in since they mentioned psychosis in their opening stmt. I don't know if it helped them at all, prosecution was also able to bring in that the same Dr. did not diagnosis Chism with psychosis in 2014. They also brought in testimony about Anti Social Personality Disorder which makes me think that was a diagnosis of one of the Drs close to the time of the murder.

I'm new to this trial. Was PC ever diagnosed with anything as a child? From what I have read it sounds like everything was "normal" until right before the murder when he appeared to be quiet and not caring about things he usually cared about.

We haven't heard of any mental illness prior to the murder yet. Defense just started their case but said during their opening statement that Chism had mental illness starting at 10 years old.

I find that odd since every one of their witnesses so far testified that Chism was a normal kid, well behaved from the age of 3 up to the murder at age 14. We'll have to wait to hear if there was anything in his childhood.

Why is the defendant asking 'not to come to court'? I feel the defendant and his attorneys are trying to play with jurors into thinking he is 'unwell'. IMO this will backfire on them. The defendant has sat in court all this time and now asks not to come to trial, it appears he does not care. jmo

This is just for a procedural hearing that is not held in front of the jury.

The Holmes jury agrees with you, they found him not insane at the time of the shooting and guilty on all charges (IIRC there were around 170 charges including attempted murder and murder).

I read through this briefly so forgive me if I missed this discussed here or on another thread. But how on EARTH was he able to stab her in the bathroom (no sounds of struggle?), walk around the school building covered in blood (and barefoot at one point), leave her body there for a time, wheel a recycling back bin into the WOMEN'S RESTROOM, and then wheel her out with a mask covering his face???? This was around 4:00, right? Not in the middle of the night?

My understanding is that he is being tried as an adult but there are new sentencing laws for juveniles, even if tried as an adult. IANAL though, we need AnaTeresa to weight in.
Juveniles cannot be sentenced to life without the possibility of parole and cannot be sentenced to death.

It was during the day, started around 3:30pm for about 45 minutes. You have to go back to the trial videos, there is video surveillance of Chism in and around the school during this time. At some points he had a little blood on him but didn't run into anyone in the halls. He was also changing clothes as this went on so the blood wasn't always obvious. There are 2 points where he did run into kids that know him but at those points he had fresh clothes on and they didn't notice anything (other than Chism ran from them). The really odd point is when he wheels the recyle bin past a man walking his dog and he has the ski mask on. But the guy was turned away from Chism and didn't really see him. Chism was very bold indeed.

He was prescribed Respirdol after his meltdown during jury selection and took it while in the hospital. He didn't take it the last day he was in the hospital and it hasn't been mentioned if he is taking it now. Chism has been colloquied a few times when he wants to waive his presence at hearing and the judge asks if he is taking his medication, Chism says yes. So I assume he is taking something but I don't know what.
