Dr. Warren Manning, the last witness for the defense, testified in Middlesex Superior Court that Kerrigan’s long history of coronary artery disease — three of the four major arteries to his heart were almost fully blocked — was probably exacerbated when he was awakened by his son’s yelling late on Jan. 23, 2010.

His son, Mark, wanted to use the phone and was miffed because his parents told him he could not, Brenda Kerrigan, his mother, testified this week in his trial on charges of manslaughter and assault and battery against his father.

The police had been called to the house earlier, because Mark had allegedly made harassing calls to a woman. When his son began to yell from their kitchen that night, Daniel Kerrigan decided to go downstairs to confront him.

WOBURN (CBS/AP) – A jury found Mark Kerrigan not guilty of manslaughter Wednesday in the 2010 death of his father, but found him guilty on the lesser charge of assault and battery. Mark Kerrigan was charged with manslaughter in the death of his 70-year-old father, Daniel Kerrigan. He faced up to 20 years in prison.Sentencing will be Thursday at 9 a.m. He remains in custody. A jury in Woburn Superior Court deliberated a little over 12 hours Monday and Tuesday. Deliberations resumed Wednesday morning. A verdict was reached around 11:30 a.m.

At his sentencing Thursday morning in Woburn Superior Court, prosecutors asked for the maximum of 2 1/2 years in a county jail on the misdemeanor charge. Defense attorney Janice Bassil asked for a 6-month suspended sentence followed by a year of probation. Judge S. Jane Haggerty decided to sentence Kerrigan to 2 1/2 years, but ordered him to serve just two. Six months of the sentence will be suspended. Kerrigan must also attend anger management classes and Alcoholics Anonymous meetings.

Mark Kerrigan did not cause his father's death. That was the message from a Massachusetts jury today that found Kerrigan not guilty of killing his father during a violent argument in the family's home on the night of Jan. 25, 2010.

The jury did convict Kerrigan of a separate charge of assault and battery – a crime that carries a possible sentence of 2.5 years.

A Massachusetts judge called Mark Kerrigan a "middle-aged man with serious alcohol issues" in ordering the maximum sentence for his conviction for assault.

Judge S. Jane Haggerty, who sentenced the 46-year-old to 2-1/2 years in the Middlesex House of Correction Thursday, also cited what she termed his uncontrollable anger, history of destructive behavior, violence toward women and family members, and unresolved mental health issues.
