Manslaughter is a tremendous reach in this case
I dont see any criminal intent that would justify manslaughter in that affidavit - there is a reason for that - because there was no criminal intent.


In other words manslaughter is a reach… there was no criminal intent on the part of client.
Yes, she hit him? But, there was no criminal intent at that time...

Brennan alluded to a new expert who would be joining the prosecution’s case in the second trial, saying that he expects to call a witness who will testify that O’Keefe’s injuries were survivable had he received treatment within one to two hours.

the court is well aware that the Commonwealth has a full copy of those Communications um and what's important
is that those call logs confirm that Ms. Read did not make any calls to her
father on January 29th until after she discovered Mr O'Keefe lying
incapacitated on Brian Albert's front lawn and I've attached a copy of those records to our motion it's quite clear
there was one call to her father on the morning of January 29th that was at 6:32 a.m. the Commonwealth has a copy of those records




Read also called her parents around 1:10 a.m. on Jan. 29, then again at 4:40 a.m. and 4:42 a.m., Guarino said. They answered the third call.

Later that early morning…

Visibility was low because of the storm. It's dark and snow is coming down heavily in Canton. JM, KerR and KR get into one vehicle to search for John.

KR kept screaming that they need to go to Fairview.

As they approached Fairview, they passed part of the front yard with a flagpole.
All of the sudden KR is screaming, There he is, There he is, and began banging on the door to get out…

JM or KerR saw nothing. KR jumped out of the vehicle and ran straight to Officer John O’Keefe found in [his body covered in snow] snow. KerR wipes snow from John’s face.

What an incredible discovery on the part of KR to have recognized John under snow.

Two experts who testified for the Commonwealth in the first trial agreed that the search happened in the 6 a.m. hour, not at 2:27 a.m.

Prosecutors, in a filing to the court on Thursday, allege that the 2:27 a.m. search opinion by Green lacks "any evidentiary support" and would mislead a jury, calling Green's testimony "an attempt to infect the jury with an inadmissible opinion."

Brennan is now asking about the marks near the elbow (I've added the circle.) Russell says they are "more likely" teeth marks. She says she believes this is one bite made by the upper teeth. Now she says this might be two bites.

January 9, 2025 is National Law Enforcement Appreciation Day, and today we honor the brave men and women across the country who protect and serve us all.

I want to remember Officer John O'Keefe (2490) for his remarkable 16 years of service w/the Boston Police Dept. I acknowledge his dedication and professionalism (and so much more) was invaluable and will never be forgotten.

He was one of the best of the blue and sadly gone too soon.

He also alleges that letters between the DA’s office and federal officials paint Morrissey as the investigation’s target — a claim the U.S. Attorney’s Office denies.

“In connection with this matter, at no time has the U.S. Attorney’s Office named any person or entity as a target of an investigation, to anyone,” the office says in response.
