I'm a little shocked this hasn't been brought up yet and it might have been buried in the CW motion to get access to Read's and Yannetti's phone's. Yannetti in open court named the 3 people who he believes are responsible for the murder of JOK!!!! He named Brian Albert, Colin Albert, and Brian Higgins!!!! They then went to sidebar. That a major bombshell and I don't think Yannetti would be bringing it out in court if he didn't have some VERY SOLID evidence to back that up!!

Right, came to mind right away as well. He would never, as especially himself, YANNETTI, come out with this in court, never mind a regular old lawyer.

Isn’t this the same people they’ve been accusing all along? I was not suprised to see him say it. Of course he will need enough evidence to be able to run with them as specific alts?

How did the Judge handle this last time?

Defense attorney David Yannetti said in the final hearing before jury selection that both his team’s expert witness as well as experts retained into the federal probe of the Read investigation have “corroborated that O’Keefe’s injuries are not consistent” with being struck by a car.

“So, your honor, if Mr. O’Keefe was not hit by a car, then the defendant did not kill him,” Yannetti said. He added later that, “If you want to point the finger in a third-party culpability defense, you have a constitutional right to do so.”

He named three specific people he says had the motive and opportunity to kill O’Keefe.

Those are Brian Albert, the then-owner of the home; Colin Albert, Brian Albert’s then-16-year-old nephew; and Brian Higgins, a federal special agent with the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) who maintains an office at the Canton Police Department.

I heard Yanetti say that, too. BUT it is the same 3 suspects it has been since the first trial, not exactly a bombshell

I believe it was the 1st time these 3 have specifically mentioned as the people responsible for JOK's death. Before that it was inferred.

I was fairly surprised at that comment...he has never listed the names before that I recall but we know it has been implied.

Thanks Harmony. My understanding was the judge game some latitude to explore alts as the evidence unfolded at trial?

I wonder how it will be approached this time.

I found it, timestamp 5:25:40 in the below video.
It's important to understand context here, which is to do with alternate / third party possible culprits that were not followed up in the original investigation.
Yannetti is not suggesting that he believes those three men are responsible, he's providing possibilities that are not Karen Read.

I think the risk of a full press on an alt suspect is that inevitably it can become a beauty contest between the alternate suspect and the defendant in the minds of the jury. So you need something clear that creates a reasonable possibility an alt did it. They don't really have that.

I feel like Yanetti makes the better play here. As Judge summarises in video helpfully posted by @Spectrix - they are going the route 2 Bowden route, not a pure 3rd party route . A critique on the police investigation with possible suspects not ruled out.

No, they were each mentioned specifically in the last trial or in the hearings leading up to the trial, not sure which but I have def heard those 3 mentioned last year. My recollection is that the judge would not allow them to name names without any evidence to back it up

I guess one reason I've decided to watch the trial is I simply cannot make head nor tail of the state of it. On the one hand I find the defence theories of the case hard to swallow. Especially I struggle with the planted tail light plastic theory.

On the other, I cannot wrap my head around the Proctor's evidence at trial 1, plus the absurd accident reconstruction theory. Especially stuff like the bizarre evidence collection, the texts, the missing ring videos, together with the sally port videos (absurd!). And then the ARCA experts are hard to go past knowing the FBI instructed them.

I guess I feel on a policy basis, this should never have come to trial.

Perhaps the truth is unknowable - we shall see.
