Welp, cannone is allowing the weatherman in to testify on the frozen ground. Alessi will destroy him. That cut on the back of JOK's head was not caused by the ground unless they can prove their was a sharp edge on the frozen lawn.
Terrible gouge, deep that a medical authority deemed he would be unable to move or really be conscience after receiving that.

If this had scientific validity, I think the defence would have done this kind of testing and KR would not be on trial again.
We're all too familiar with "expert witnesses' on both sides.

1. I tend to agree with Peter that most Judges do not dismiss here. I also agree with him that there were better opportunities to deep six this mess. But now we got this far, it was always going to trial again. His logic of comparing to an appeal is good IMO. On appeal, the remedy would be a new trial.

2. Of course there is prejudice to the defendant here - but again I agree with an earlier LYK opinion that the remedy would be a direction to the jury about the video issues. For example, the defence has lost the opportunity to see the original source video and see if that was inverted. The judge should instruct the jury on that point IMO.

3. Lack of evidentiary hearing REALLY bugs me. What got me back into this case was the inverted video which really annoyed me in trial 1. I wondered if that should have been a dismissal just for that. However Peter explained that a jury direction is a more proportional remedy. Fine i agree. But I also agree with Peter that it is simply bizarre here that the Judge allows for the possibility that Proctor intentionally withheld this evidence but won't allow him to be examined on that. I watched back his trial 1 testimony and it seems at least possible he also deleted Ring video. But at trial 1, no one knew he was withholding potentially critical sallyport video. WUT?! My guess is that critical video only ever surfaced because LE started cleaning up as regards Proctor and someone somewhere realised that they better discover it. Like Peter, it's hard to be confident LE didn't, at the very least, hide this stuff, or worse, doctor/destroy evidence.

Is the judge going to let the defence inquire about this at trial instead???

I really can't get my head around this part of it.

Karen Read's First Circuit Court of Appeals (federal court) appeal is denied. Court affirms the lower federal court's decision. The only potential remaining step in this appeal is the US Supreme Court, should Read choose to petition SCOTUS.

I cannot stand KR, I don't like her at all as much as I don't like the Albert/McCabe/Higgins gang.
BUT...

To me it comes all down to how a verdict ins formed.
The defence does not need to prove an alternative scenario beyond reasonable doubt, they only need to create reasonable doubt in the state's case.
So I personally don't care how strong the evidence is against the Albert/McCabe/Higgins gang's conspiracy theory, all I need to know is that it was possible for them to have done something and that they were not investigated enough to make sure this question did not come up.
I think there are enough issues in the prosecution's case (thanks to a botched investigation) for the defence to be able to poke huge holes in it.
To me it shows that a complacent "investigator" thought he had it all figured out within the first 5 minutes and failed to do his job properly.

She may have done it, but they did not prove it beyond reasonable doubt for me.

Now lets see how this new trial goes.

No, proctor, fired state trooper, friend and lead investigator did not go in and investigate a thing, but, hence he is no longer. No CPD officers went in nor questioned anyone about JOK as professionals doing their job no matter what their friend said to them, that someone else said, JOK's gf who was clearly hysterical. Again, the audit and investigation from outside starts very soon of the CPD due to this. That will be telling, plus, the trial continues.

I am anxious to see what new evidence the CW might have as well as listen to their new experts.

As all of us know from past trials, she could be found guilty and not have done it or be found not guilty and actually have hit and killed JOK.

Relative to Trial #2, the CW has named TB/AK as a prosecution witness for the first time and since he has witness intimidation charges pending, he's likely being sequestered from the courtroom as a named witness and not being waived, See the latest extensive witness list published today linked below.

Nate Eaton is the News Director for East Idaho News and covers major cases including the Idaho College Murders, Lori Vallow Daybell, and more.

After Daybell named Eaton as a witness, he filed an Emergency Motion for Protection Order stating his understanding that by Daybell simply naming him as a potential witness, he can be barred from the courtroom during her trial. Eaton is alleging Daybell is using the Rules of Criminal Procedure as a pretext simply to keep him out of the courtroom and interfere with his ability to report-- an effort clearly interfering with his First Amendment rights as a reporter and the First Amendment rights of his employer to view and report the events of the trial as any other member of the media.

I dunno- seeing TB/AK compare himself to Nate Eaton and state how this is 'exactly' what the CW is doing to him isn't exactly comparing apples to apples! I've long followed Nate -- especially when Dylan Rounds was missing and Nate's a Journalist in every sense of the word. JMO

Imo the reason KR is on trial again for murder is because the CW had to save face and is feeling the pressure of the victim's family members to get KR convicted. That's why they're trying their luck with this reprehensible, sneaky Brennan character. Jmo
A cop was killed. Everybody hates it when a cop is killed. I think they want to spare no expense in trying this case (again).

But because Proctor himself had her convicted within hours of getting involved, and because of such a farce of an investigation, starting with zero search of the Albert residence, Karen Read is all they have to pin it on.

Even Proctor's friend believed the Alberts had some liability to a dead man on their property when he wrote, "I'm sure the owner of the house will receive some s---."

Proctor responded, "Nope, homeowner is a Boston cop, too. "
"...There'll be some serious charges brought on the girl."

And he was right about that. Homeowner never got any serious s---, thanks to Proctor, and the girl got some serious charges brought on her, thanks to Proctor.

Canton Police audit ready Tuesday, same day Karen Read trial empanelment starts​

The audit request came about due to intense scrutiny as the setting of two high-profile cases.
The first was the Feb. 1, 2021, death of Sandra Birchmore in her Canton apartment, which local authorities first chalked up to suicide but the feds thought otherwise and brought charges against Stoughton cop Matthew Farwell, who they accuse of grooming Birchmore since she was a girl and then killing to cover up their relationship and her pregnancy.

The next is the death of Boston Police Officer John O’Keefe, a resident of Canton, whose body was found Jan. 29, 2022, frozen on the Canton front yard of a BPD colleague. Read, his girlfriend at the time, is charged with his murder.

And this is exactly why we rely on our LE who we pay big tax $ to investigate crimes honestly, thoroughly and impartially. And why we rely on our court system to be unbiased and fair. So we can know beyond a reasonable doubt one way or the other.

Canton hires national firm to audit police department following Karen Read, Sandra Birchmore cases​

The audit​

The project aims to establish for the community both “what the department is doing well, and more importantly, what the department could improve upon.”

The scope, including to town documents, includes a deep review of “policies, procedures, and regulations” regarding the department’s day-to-day work, including whether its crime scene protocols, professional standards and procedures, hierarchical structure and organization, hiring and training practices, and evidence processing and handling are in compliance with industry standards and procedures.

The audit will also review the department’s finances, its management and culture, as well as its interactions with the public and its governing bodies including its protection of citizen privacy and personal information, adherence to conflict of interest laws and regulations, the effectiveness and organization of the department’s oversight by the town select board, and how it handles civil rights complaints.

The audit is to also include recommendations for “necessary improvements to all aspects of the Police Department.”

I suspect the CW will do a much better job on the vehicle impact investigation and the data at trial. However there are two glaring issues with their case IMO.

1. How to deal with Proctor?
2. No pathologist to confirm injury caused by vehicle?

Especially on point 2, could they simply not find anyone who would confirm this?

Not even the ME would rule JOF's manner of death a homicide so good luck finding a pathologist to confirm his injuries caused by a vehicle-- including KR's Lexus! Just sayin..

I kind of get it on one level, because they have the tail light evidence - and if they just had a few evidential photos documenting that tail light at the time they seized the Lexus, then they've got vehicle involved. But alas ...

If they have the taillight evidence then how do they explain the extra pieces of taillight left over after assembling the taillight in the lab?

I am going to wait for trial and see if that comes up, but i think if there was a photo of the tail light from the moment of seizure, then it would really resolve all of this can or worms one way or or the other.

JMOO but I don't see how the cw can explain all the extra pieces of taillight they sent to the lab.

Have you considered that there is a good reason they did NOT photograph the tail light beforehand? I have watched so many cases on TV and the police almost always photo evidence when they first receive it. That, IMHO, is police investigation 101.
