The trial begins with Opening Statements on April 22. Thanks for the article, @Forest_Wood

I thought the judge wanted this thing sped up, why another week before openings?
It may be to do with availability.

People will have blocked out time to be available for trial. Travel bookings, child care, work absences. If a jury is selected quicker than expected, they can't just start earlier, because the times people are available to travel and testify aren't able to be changed easily. It doesn't just affect one or two people, it affects everyone. So waiting and beginning when they said they were going to begin means everyone is able to be present in court when they planned to be.

I tend to agree that the focus should be towards pointing out the misconduct of the lead investigator on the case rather than pointing at a nebulous third party that the jury may or may not accept. I think focusing on reasonable doubt will be the winning approach. MOO.

This too is what I have been saying for a minute now. I think there is enough reasonable doubt to just focus on that and lay low on the 3rd party

Can they change their defense strategy in Trial 2 without involving a 3rd party at this stage?

It would seem to me that they can easily do that. Just shift the focus to the reasonable doubt, spend more time on ARCCA, and spend less time bringing up the 3rd party. But their filings make me believe that they will still focus on the 3rd party.

I tend to agree that the third party defense ( altho I am totally on board with it ) can definitley be confusing and gets murky with only certain details allowed in court. D does not have to actually give up this angle, just let it play a distant second fiddle to reasonable doubt. There is plenty of reasonable doubt to be hammered home.
If D makes reasonable doubt a priority, the P won't get to roll their eyes back into their head and yak yak yak about how the D would have you believe in a vast conspiracry involving 100's etc.
Good strategy !!

Watching the opening of the first trial with David Yanetti beginning his opening with 'KR was framed' immediately put the defense in a position of essentially proving this theory whereas the defense doesn't typically have any burden of proof at trial. I agree with others that this strategy hurt more than it helped.

LYK Peter Traggos provided a good outline on 4/14 for a defense mock opening where the defense can introduce 'framing' through witness testimony and cross, and avoid the mistake of the first trial by putting the defense on task. JMO

It’s Easter weekend which means court was maybe closed Friday? And Monday is the Boston Marathon/Patriot’s Day so court was closed then already.

Seems that it makes more sense to start Tuesday fresh, instead of starting Thursday and then having 4 days off.

This is interesting @Seattle1

I also think Brennan won't make such a hash of it as Lally who ended up playing too much defence on sideshow witnesses. I don't blame Lally - just a regular prosecutor doing his thing, but Brennan will be much more prepared.

Thanks! I thought this hearing was starting at 10am, guess they are late for some reason.

I don't see PO at this hearing.

Oh look the CW deleted metadata AGAIN of something the Defense asked for! This is such a freaking joke of a trial!

Judge being short and rude with Alessi.

She is so dismissive of him. I think she is trying to make him nervous around her.

Like that's going to happen. Alessi is like Prime Mike Tyson. He's not in the least bit worried.
