In his latest filing, Special Prosecutor Hank Brennan writes that the relationship between the defense and accident reconstruction firm ARCCA is "cozier than once portrayed."

To support his claim, Brennan adds a footnote stating that he has photographs showing Dr. Andrew Rentschler at a private luncheon where he spoke with Read's father.

The state has tried repeatedly to discredit defense evidence rather than address its substance. This latest move is no different. It’s posturing. Unless they can show that the accident reconstruction was secretly paid for or otherwise employed by the defense (which they haven’t), this is yet another procedural slap fight from Hank. MOO.
I just watched the entire hearing. Unbelievable that this judge is ordering ARCA to be there Friday for a voir dire. Brennan speculates about text messages from a year ago where there was never any order to retain. Emails have already been provided. Intentional discovery violation? How?

DOJ had to release ARCA before defense could retain them. That happened end of Jan I believe. CW provided some sort of final report from Aperture ( their expert) on 24th March. Moo

Defense complied with this judge's order of one week ago and provided everything that existed (as detailed in the order) on Friday last week. They had two days to do it. That's how Brennan knows the number of text messages. Because defense was able to provide a list. Last year Jackson recounted one of these logistical texts to the Court. CW already has emails and there was never an order to retain text messages from a year ago. This has happened because the judge chooses to entertain Brennan's speculative, non- evidentiary based motion. Moo

So how is this fair? There is day 2 and 3 of the trial coming up right now. Then on Friday ARCA will have to fly in after being summarily supeonaed to appear for the day. So fair and proper for the defense and their experts that this all happens without adequate notice, whilst defense are in the opening days of trial. Moo

This judge gave no reasoning at all from the bench for her decision. She hurried Alessi along, when this was a non-written, oral motion suddenly sprung by the CW today. So fair and just right? . An oral, non-evidenced, purely speculative motion sprung today on the defense.

Yes, Brennan wants ARCA out via moo, a trumped up discovery violation. He thinks the defense should not be able to retain experts of their choosing. He blames the defense because they chose to wait for ARCA to be released by the DOJ. This is unjust. He didn't makes his own expert's final report available until March this year. Moo

It anyone thinks the decision by this judge to force an unexpected voir dire on ARCA in three days time is not going to unfairly impact the defense, then imo they are advocating that it is acceptable for the non -evidentiary speculation of a hired attorney of the cw to form the basis of a motion. A motion which when heard and granted results in unjust prejudice to the defense. Moo.

Yeah best I can follow, it seems from the documentary, Brennan knew there were more comms, which is why he pushed on this - so now he has finally revealed the defence deleted over 100 text messages with ARCCA

The Judge was annoyed and rightly so,

She ordered voir dire of ARCCA on friday, to get to the bottom of what the content of these texts was.
WOW. Alan Jackson deleted more than 100 text messages in an ongoing murder case. Is this man going to be disbarred??

The thing about this case that really drives me up the wall.... is that 90% of the content of this case really doesn't matter. If this case was a track and field event, it wouldn't be a marathon or a sprint, it would be the 110 metre hurdles. The commonwealth has a series of hurdles to clear before reaching the finish line. The first hurdle is proving that John O'Keefe's fatal injuries were caused by a car, let alone Karen Read's car. And they fall flat at that very first hurdle, with Dr Wolfe and Dr Rentschler of ARCCA being key components to that hurdle. And the CW know it.

If the defense said one of these experts had eggs benedict for breakfast one day when it turned out they actually ate pancakes instead, you can guarantee that the CW would be putting in a complaint and Judge Beverley would take it seriously!

I personally don’t think KR is a likeable person, but that doesn’t mean she didn’t strike down JOK, or that she did and law enforcement both conspired and did such a poor job of investigating that even is she did do it there is way too much reasonable doubt

I couldn’t agree more. All this whining and moaning about deleted texts, TB, et al are all just a series of desperate red herrings being planted by the CW because they have no substantial gotcha evidence. Sort of comparable to red taillight pieces.

Deleting 100 text messages is a big no no.

Clearly the Judge did not believe Alessi's explanation which was absurd. You can't do that. Especially you cannot say you've complied with discovery except for the 100 messages you secretly deleted.

Why they deleted them is the question, but it has to raise questions over the ARCAA witness relationship. Why else delete the messages.

Sounds like Brennan is proposing an unfounded conspiracy with no substantiated evidence against KR's attorneys and ARCA. I thought you weren't a fan of this sort of thing. Why should it only be defense lawyers who have potential to drink conspiracy kool aid ( sp?). Jmo

When ARCA is voir dired ( though what is going to happen if they can't do it this Friday with two days notice.? They weren't expecting voir dire until the defense's case in chief which is weeks away) nothing will come of this. Moo. Why do you believe the well respected professionals at ARCA would hide and delete nefarious text messages in some sort of conspiracy with KR's defense? And then lie on the stand under oath about their impartiality at the last trial? And risk their careers? I see no evidence of this in Brennan's hasty oral motion.. Moo

You are aware that the CW had equal access to ARCA's findings and naturally enough but imo unjustly chose to ignore them? Jmo

I am curious... How many of you believe that Karen Read is guilty? And how many of you believe that something else happened that night?
I followed trial 1 - it was actually the case that got me onto WS.

I don’t believe John was hit by a car, and I don’t believe this case was handled properly. Between the misconduct, missing evidence, and lack of any clear proof of a car strike, there’s no way i could vote guilty. Could something else have happened? Of course. But the investigation was so compromised that I honestly don’t know if John will ever get real justice. MOO.

Could not agree more. There is so much noise around extraneous minutiae.
While following the first trial the hope I guess was that it all might lead somewhere.
But **spoiler alert** most of it leads absolutely nowhere ! Most “aha” details do nothing to shine a light on whether Karen Reed killed John OKeefe. Can it be decided beyond a reasonable doubt that KR killed JOK.
Given what I know from the first trial only
Absolutely Not.
Frustrating and painful to see it start all over again and watch my tax dollars fly out the window knowing there can never be true justice for John.
I am sorry for John O’Keefe that he did not get the investigation he deserved.
I’m looking at you Mr Proctor.

Judge Beverly Cannone determined that Read’s defense had not fulfilled its reciprocal discovery obligations with regard to a pair of accident reconstructionists first hired by the federal government. The decision came after the first day of testimony in Read’s second trial.

Many of those text messages — between Read attorney Alan Jackson and the experts, who work for the firm ARCCA — were deleted, Robert Alessi, another lawyer for Read, admitted.

We wholeheartedly believe the truth will prevail in this case, and justice for Officer John O'Keefe and his family will be achieved."
