I can't believe Lally and his team missed this
His phone was in pocket state (covered) for five hours and 20 minutes from 00.33am to 6.02am.

Damn -

Pulling it all together, paints the whole story of how Karen hit him and left him to die.
This is an excellent expert witness.

IMO

not sure what is meant by "pocket state" but his phone was supposedly found under him and picked up off the ground?

I think you can certainly say the entire circumstantial web looks bad for the defendant.

Which is the danger in arguing about unknowables like dog bite vs tail light. Experts will disagree, but we now know whatever happened to him, it happened 7 seconds after he checked his messages for the final time, and he never made it in the door. He was injured fatally sometime around 12.32

Of course the CW still needs to prove a collision, and intention. But at least the battle lines are properly drawn this time.

MOO

Pocket state is something blocking the camera

Could be in a pocket, under a body, etc

Seems to have been between the body and the ground then.

The defendants claim to have seen JOK go in is very bad now.

Huge mistake IMO.

  • #870
The witness seems to left many things out of his "timeline"

Every “accident” is different -
I’m sorry you were hit and injured.

John was hit and left to die

IMO
I was hit and left to die. Y'know what I did? Screamed. Called 911. Things John would've done if he could've, especially as a police officer. Both his arms weren't broken. His brain didn't just cease to function after his arm was scraped by a... tail light... and he got a black eye.

Didn't some of the commonwealth's own witnesses like Brian Higgins also claim to see JOK go inside the house too...?

Truly infuriating. An injustice for one of us is an injustice for all of us. They need to let the defense DO THEIR JOBS. So much of this case reeks of obstruction of justice, all from "officials".

John O’Keefe was immediately rendered incapacitated as soon as he fell backwards hitting his head

IMO

Can someone remind me when Karen’s car or phone connected to John’s wifi and hos long it takes to drive to his house from the Albert’s’ house?

<modsnip: It is the member's opinion>

A medical examiner later reported that O'Keefe had abrasions to his right arm, several lacerations to the face, two black eyes, and skull fractures which would have contributed to brain bleeding. They determined that hypothermia was a contributing factor to O'Keefe's death.

Most of the time, this sort of brain bleeding doesn't make you unconscious immediately.

Regardless, it doesn't explain why a dozen people didn't see him in the yard if they were coming and going. That yard is much smaller than some photos would have you believe. I think Jen probably could've seen John from the windows if she was looking out as adamantly/constantly as she says she was.

forensic testing of John O'Keefe's clothing in the Karen Read trial did detect pig DNA,
A forensic expert, Teri Kun from UC Davis Veterinary Lab, stated that the pig DNA could have originated from food, including dog treats.
Yes, that is absolutely correct- this DNA could have come from food (that John ate) or dog food that Chloe ate, or dog treats, it also could have come from food any of the people who handled the shirt in the hospital ate, or the police officers, or Karen herself that night.

And it shows how a good defense team can confuse a Jury. They will argue that something is probable based only on the evidence that it is possible, but you can't draw any conclusion about the probability something did occur from the possibility that it might have occurred.

There are a multitude of other explanations for porcine DNA that do not require a dog to deliver it.

You would never expect to find residue of the food an animal ate but absolutely none of its own DNA in the form of buccal cells or hair which would be mixed with that food.

To me this is great evidence that the assay was sensitive enough to pick up transient exposure to animal DNA and therefore if canine DNA had been present, it should have been more prevalent and would have been detected.

Tragically, I am watching it. Like a bad car accident you cannot look away from.
O'Keefe's Apple Health data indicates he took 80 steps and climbed three flights of stairs.<modsnip - personalizing>
3 flight of stairs in the car due to elevation.

I’m so sorry you got hit. In high school, my significant other was hit by a vehicle. His pelvis, femur, and some ribs were broken, and he had to learn to walk again. It’s been very present on my mind during this trial. I just don’t believe it’s possible for JOK to have no damage to his lower body if he was hit by a vehicle. MOO.
