ok wait.. did he just say items were found a foot to a foot and a half under the snow? they got how many feet of snow during that storm? Shouldn't it have been found under 'many' feet of snow?

Testimony from last trial: Lieutenant Tully
There is no report from the SERT team. Only one made by Tully - who was punished for his behavior during this investigation. Loss of 6 vacation days and transferred to a different unit.

His report was made 12 days after the search, and incorrectly dated Feb 10th, 2021. There was also a whole discourse in this testimony about incorrectly logged evidence regarding the number of pieces, etc.

The jury asked to see the official report from the specialized SERT team. It is a fact that the SERT team did not make a report. Which is not typical.

Thank you for bringing this forward. I was pretty sure that the jury in T1 had asked to see a SERT report.

Judge Cannone just sustained an objection from the defense regarding snow accumulation on the front lawn/near the flagpole.

Yes he just said it again ‘there was one particular item that was about a foot, a foot and a half, under the snow’

IIRC:
A foot and a half and by that time he said the snow was melting.

The jury did ask to see the sert report.

Needham Police Sgt. Gallerani is up. He will be discussing his swabs of Proctor and YB. Regarding possible tailight tampering - remember, there were DNA profiles of 3 people on Karen’s tailight.

  • #368
Brief cross for Gallerani. He was never asked to do buccal swabs for Chief Berkowitz, Kevin Albert, or Lt. Tully.

  • #369
Brent testifies that he does not have any personal knowledge of how any items he found on 2/3/22 got to the front lawn, or who had access to the lawn. No crime scene tape or tent up. Yanetti is really driving home reasonable doubt.

That’s all for cross. Lally following up.

Maureen Hartnett is up. She’s a forensic scientist with the Mass. crime lab who tested Johns clothing and sent out swabs.

it looks like the passenger side was to the left of the house so he might cross behind the car to get over by the house.
No that is not right. Is that what this witness is claiming( I am not able to watch in live time)?. The Lexus was was facing towards Chapman. The passenger (right) side was adjacent to the frontage/lawn, with the Lexus positioned on the RHS of the road facing towards the hydrant and flag pole. My apologies if this has since been addressed. Potential for tampering

"While the overwhelming majority of police officers adhere to the rules and would not consider tampering with evidence, this isn’t always the case. Officers may be sure that they have identified the culprit, but feel that the evidence is not strong enough. Even if there are no malicious intentions, evidence should never be tampered with, and an insecure crime scene provides a potential opportunity for this to occur.

The integrity of evidence is key to justice and a fair trial. If you have been charged and the crime scene was not secured properly, seeking legal guidance will help you to highlight this reality in court."

He wouldn't right? He'd get out straight onto the lawn and make a bee line for the house. God knows why anyone thinks he'd be wondering around on the road waiting to get hit by someone's lexus.

Damn you and your logic.

Edit.. Wait... so much confusion because I'm Aussie and we drive on the opposite side.
Pretty sure JOK as a passenger does hop straight out onto the curb side outside 34 Fairview, assuming they were travelling South. No road waddles needed.
You have it right. Drivers side in Aust is RHS, passenger is LHS. It's the opposite in the US and most of Europe. Jmo

I remember hearing they were used to testify about the ring camera access and to provide insight into John and Karen’s relationship. Kids don’t have the framework to properly understand romantic adult relationships. The CW’s case is plain desperate. Maybe call the lead investigator or the people who were at 34 Fairview instead of children.
100%. It was a horrible and imo exploitive thing for Lally to do, to have them questioned about the relationship. Whilst I recall thinking it was ok for the older child to testify about what she remembered that morning, questioning the other child and then both of them on their impressions of the adult dynamic was not ok. I have not caught up on testimony or the thread but if this is being repeated by Brennan that is horrible but I suppose not surprising. Jmo

Ms. Hartnett, who is on the stand right now, notoriously testified about “John’s hair” being found on Ms. Read’s vehicle. But it should be noted that DNA testing performed by Karen’s DNA expert, who was present for CW’s testing of the hair, determined the hair was not only inconsistent with Mr. O’Keefe’s DNA profile - it wasn’t even a human hair. This detail was included in a court filing - the defendant’s motion to modify conditions of release - and directly contradicts the implications made in Hartnett’s testimony. I wonder if she will testify on the ‘hair’ this trial.

Retraumatizing her, and for what?
Yeah right, re-traumatising and to what purpose? How can this even be relevant to the charges. Same old, same old as last year. No low is too low. Jmo

@DrLauraPettler

The manner of death "homicide" is the medicolegal term for is the killing of one human being by another human being. However, murder is a type of homicide that involves the unlawful killing of one human being by another human being. Not all homicides are murders, but all murders are homicides.

Generally speaking, as an expert in #DVHomicide, when I say #DVHomicide, I am talking about the killing of one human by another human in relation to #DomesticViolence.

@USDOJ's definition of #DomesticViolence, "Domestic violence is a pattern of abusive behavior in any relationship that is used by one partner to gain or maintain power and control over another intimate partner. Domestic violence can be physical, sexual, emotional, economic, psychological, or technological actions or threats of actions or other patterns of coercive behavior that influence another person within an intimate partner relationship. This includes any behaviors that intimidate, manipulate, humiliate, isolate, frighten, terrorize, coerce, threaten, blame, hurt, injure, or wound someone."

The way #KarenRead spoke to JOK in voicemails she left January 29th is not ok. No one should treat anyone the way Karen treated John in those voicemails. #MenToo #HisNameWasJohn #DVAwareness

John sold the kids' parents' home in the Ponkapoag region of Canton after they died. He then bought the house on Meadows where all three lived at the time of his death. (Public records - Norfolk Registry of Deeds).

After his death, his mother moved into 1 Meadows with the kids. John's father still lives in their Braintree home.
Do you have a link or did you google info? jmo

Not to mention he would of almost had to be sitting down to get a head injury from the tail light ,and had his glass up above his hit to get his glass to land on the bumper. I was really trying guys but I cant .

What is the CW's theory on the scratches?

I don't see how a human body would cause scratches?
