Why does the court allow some witnesses to use their notes, while other witnesses are not permitted?

It's cannone's Law. That rules over Canton law IMO. What she says goes and all that other law stuff is for other courts to decide.

Maybe the snow was there while MP and YB were also present? And therefore, the implication being the hair couldn't have be planted by them when they were present because of the snow? I forget what time was shown on the timestamp but the date was 1/29.

I could be wrong, but I think expert witnesses are typically allowed to use their notes, while lay witnesses are not.

‘If you want to get a picture of how things are going or how principled the prosecution is, as noted by @FKR102445, Brennan sought to preclude critical components of the M.E.'s conclusions (inconclusive manner of death) and then in his opening sought to discredit her findings by promising the jury he would bring in a neurosurgeon who would determine the manner of death. Is this a panic move, based upon a well-founded concern that he is "hiding" too many important witnesses in his case in chief and a fear that the defense will use this as another witness to advance their case? Another reason for the defense to call Proctor will be the text exchange in which he calls the M.E. a "whack job" for failing to give him the "homicide" determination.’

This is going much worse than the first trial for the CW, and I think a lot of people correctly speculated it would.

ME is describing the arm wounds as scrapes or scratches. She made no note on depth of wounds. Has no opinion to a reasonable degree of medical certainty how they occurred.

ETA

*the size of the abrasion/bruise on the lateral right knee is a half centimetre, which is even smaller than I remembered. Less than a dime in diameter?

* Rib injuries near sternum, ribs 4 and 5. These fractures due to resuscitation to a reasonable degree of medical certainty.

I re-listened and I actually think the defense objected to MH changing her testimony. Makes me wonder if the CW told MH she needed to correct something? I don’t know.

Uh… she didn’t correct anything post-sidebar, unless I missed it. The ME is up.
The judge said she couldn't, that they were done questioning her and she was free to leave.

I liked her, she was just being honest. The reflection photo of the glass made her look bad, I would put money on it that she wanted to correct her answer after she went home and looked at the pics again lol

10-4, thanks! I couldn’t tell if it was Judge Cannone or the defense team that didn’t want her to alter her testimony

So I wonder why he was showing the snow on the car over several hours on the timestamp.
He was trying to ask her if water would make the hair stick to the car... then showed that video... of the water/snow running OFF the car... it really made no sense.

I don't know what he was doing with his redirect, but I don't think he made any good points and should have just let her go without askign anything.

JMO because I was listening while driving lol

Suicide and Natural were ruled out.
Which leaves Accident. Homicide. Undetermined.
She could not conclude that enough evidence pointed more toward Accident or Homicide.
Therefore = Undetermined.
The MOD could have been a homicide.
And yet could have been an accident.

Did she talk about COD yet? Last trial she determined blunt force trauma AND hypothermia.

She was not allowed to talk to the CW while she was still under oath and testifying though. Brennan could have asked her about the picture with the reflection, see if her answer was different today, he didn't (dumb IMO) I was expecting a question about it because there is no way that she didn't take the time to look last night and "see" it now, but nope... lol

I wonder why she didn't bring it up at the beginning of her testimony rather than at the end. Then both sides could have easier cross-examined her on that again...

They objected, you were right.. but ultimately the judge decided, nope, you are done testifying. The defense and the CW didn't know what she was going to say, I suspect they both agreed she was done. JMO

A manner of death may be ruled undetermined by the forensic pathologist when there is insufficient information about the circumstances surrounding the death to make a ruling.
