No witness was there to study what John was doing. No one saw him get out of the vehicle, but he did. He wasn't checking messages while the phone was underneath his body, it was locked after checking messages.
He wasn't in the car. He wasn't lying on the lawn. He wasn't sipping a drink and checking messages sitting on the curb.He had to have been in the house. No one needed to be studying anything. Those 3 witness would have noticed him. As every person who left that house should have seen him on the lawn. And Lucky. And every other rando car that drove by before the snow accumulated.

So why didn’t it match the glassware at Waterfall?? Karen’s would’ve come from the #aterfall, too. Imo
Julie Albert testifies that when KR & JOL entered Waterfalls KR took a glass out from under her jacket with clear liquid and a lime slice, and IIRC: JA assumed it was Vodka.
AJ did get her to admit she didn't know what the clear liquid was and it could have been water.
JA said she laughed and called KR 'crazy".
KR & JOK were coming from the other bar so I would think that is where the glass probably came from?

He had multiple skull fractures in the back of his head.
Did he get hit in the back of the head by KR’s car? If so, how did het get hit in the head by her SUV without any other part of his body suffering a vehicle strike injury?

The back of his head hit a hard surface with a lot of force.
But that was the only damage besides the arm injury? After being run over by a huge SUV?

80 steps is a lot of steps, especially with his height. That would probably be up to the door and back to the car. Has anyone gone and measured what 80 steps would be out of the car? Has this been talked about somewhere that I can read up on it?

I believe it was 36 steps, equal to approx. 84 feet. I am not sure if anyone measured from the curb to the front door but it seems reasonable he could have reached it in 36 steps, for a 6'1" guy.

Did you see her walk out with the Waterfall with a glass?

Begs a question as to why he'd want to carry two glasses into the Albert home and have his cell phone in his hand at the same time, no?
I believe no one has testified (yet) in this trial that he took a glass from the Waterfall.
If I was the Defence I would be tempted to say "glasses come from houses, not from cars".

The back of his head hit a hard surface with a lot of force.
His head most definitely did :( ME in trial 1 stated it would have been immediately incapacitating. Per the CW's opening statement in trial 2, he was hit by vehicle, stumbled around for 20 seconds and logged 80 some feet of distance on phone (he seems to want to ignore this in favor of Waze), and then sustained the fatal head injury. Brennan seems to be moving away from the initial timeline and now brings up spinning tires instead of hitting him at 24mph. I assume the math didn't math so he had to change up the theory.

Neither side is arguing his head hit the vehicle or at least it hasn't come up yet. I did find it interesting he told the jurors to look at the top of the Lexus when they did the Fairview visit.** I assume he'll try and put this all together with his reconstructionist.

**IIRC, someone should fact check this but I don't have time.

I’m playing catch up from yesterday. Sargent Yuriy says he thinks that bruises and abrasions are the same thing. How does this guy write accurate reports when he doesn’t know an abrasion (I don’t even consider the marks on JOK’s arm as that, lacerations is more accurate) and a bruise? And I know he was just playing dumb but geez!

As far as I know, no actual photos were taken of John where he was found and no actual measurements were taken. There are also very few photos of the taillight pieces, that were collected at the alleged scene, over a 3 week period.

No actual measured or marked locations for those pieces either.

The scene was never secured
and no taillight pieces were found until the evening, after her car had already been collected.

No actual photos of her taillight were taken when the car was taken into custody at her parents house, before it was placed on the tow truck OR upon its arrival to the Sallyport.

When the car was picked up at her parents, Proctor and Yuri lied and said it was 5:30pm.

Her parents had cameras and it was picked up at 4:12pm. Proctor and Yuri didn't know about the cameras.

Proctor USED 5:30 on the sworn affidavit 😡

Go back and watch AJ's cross of Yuri. When Yuri is asked that they did not know anything about her parents having a ring camera until after the sworn affidavit was put in place. Yuri takes his fingers stretches his collar out and tries to fiddle with his tie. LOL!!! Busted!! 🤣

I’m not sure if he’s playing dumb or if he’s actually dumb or both. But abrasions and bruises are two very different things medically speaking. Bless his heart.

Wait. Are you suggesting his head was hit by KR’s SUV? If so, how did the broken taillight pieces cause the cuts on his arm? I thought the CW argument was the SUV hit his harm, taillight pieces cutting his arm, spinning him around, flying him through the air, where he landed on the “very hard ground” which somehow cut and bashed his head such that he was immediately incapacitated. He lost a lot of blood, but we only found droplets of it. I guess the rest…. I dunno, soaked into the very hard ground?

Tail lights are hard plastic....I wonder what kind of force is needed to break them into 10s of pieces. Surely not just human flesh.
That’s a good question. I wonder if any of the experts have opined on that.
What exactly did hard plastic tail lights come into contact with in order to shatter it into 10's of pieces? 40 pieces?? Did it hit Metal? Brick? Flag pole? HAMMER?
I’m wondering if the defense ran some tests on that? They’re pretty thorough. Maybe they ran the tests and didn’t like the results?

According to AJ the Lexus does not arrive at the Sallyport until just after 5.30pm - this is common cause. So the 'window' is less than 10 mins. But is effectively zero because SERT is already searching the site.

16:54 - O'Hara and other SERT team begin arriving on site

I have a question. Has it been established if YB and MP were together in a vehicle while the Lexus was being towed? Or was one of them in the cab with the tow driver? Hmmm

This was a false rumor perpetuated on a misunderstanding of the testimony.

  • Vallier testified she was able to reconstruct the plastic fragments she was asked to examine into a bigger piece that she said was a physical match to the taillight from Read’s car.

Some pieces were too tiny to match edges, but they were still a match in terms of their physical properties.

It was the glass fragments which didn't all match John's cocktail glass, but now Karen has said he was holding her glass too.

Might he have finished his drink and only took KR’s drink when he went towards 34 Fairview? I did see the video with the straw, so he did have one, but it might’ve been empty.
