It's sad that this testimony was obviously coached. She never said "Maybe I like...hit him" in the last trial. Using a devastated and traumatized child is horrible!
It looks like she did say it last trial from this reporting

After Assistant District Attorney Laura McLaughlin showed her documents to refresh her memory of her prior testimony, the teen told jurors she also heard Read say, “maybe I hit him.”

This Brennan guy is brutal.
He's using his own witnesses he called to help make a stronger case for the defense.
Defense should pass on cross examining and just use the damage Alessi self-inflicted.

ETA..Oops..just realised I'm about an hour behind live testimony.

If someone regularly drinks and builds up a tolerance (?), can they have a high level but not necessarily be as drunk as someone who usually doesn’t drink but has that level?

Absolutely. Some people can drink a lot and appear to be perfectly fine. Others can't. For example I have a pretty high tolerance for my weight class and I'm not gonna sugarcoat it, years in the restaurant and bar business have contributed to that. I can drink a lot and appear pretty normal. My sister can as well. My Mom on the other hand? She would get a half glass of Prosecco in her and be completely sloppy and then claim she was hungover in the morning hahaha!! I think part of it is psychical and a part chemical.

However the chemical doesn't lie. Your Blood/Alcohol level is what it is and you're ability to appear "perfectly fine" isn't going to hold up in a court of law. There is knowing how to deal with your drunkeness, which may get you out of being tested, but if you're tested, you're likely going to be arrested. At least that's how I've always looked at it. The key is to not drink and drive in the 1st place.

Testimony from John's niece from a report last year (May 30th 2024) - in trial 1

"She also testified that Read changed her recollections of the night as she talked to people by phone around 5 a.m., shortly before she went to Fairview Road and found O’Keefe’s body.

“In the first conversation that she had, she had said that they were in an argument, and then the next person or the next phone call she had left that part out,” the niece said. “And also in the first conversation she had said like ‘Maybe like I –- maybe I hit him,’ like, ‘Did I hit him?’ and then the next conversation that part was left out, and it was ‘Maybe he got hit by a snow plow,’ and she left out the argument.”

Yes, I would think her memory of it was better, closer in time to the incident, last year. IMO

Given her histrionics, alcohol level and emotional ‘state’ during the 24 hours prior to the murder, even IF KR said ‘I hit him’, it doesn’t prove anything.

OMG, touchdown. The good doctor said that there was a party, walking to the house, an altercation and then Brennan objects and Judge says disregard that.

Alessi is on fire! He even corrected the doctor on a medical term when she was being somewhat obtuse.
